Staff has been in contact with representatives of the applicant and they have indicated that Conditional Use Permit No. 85-14, a request to construct a new convenience market with gasoline sales, will be withdrawn and Conditional Use Permit No. 84--30, a convenience market conversion , will be implemented . During the public hebcing for the zone change to C4-SS, the concerns of the adjacent property cwner addressed the proposed new construction (Conditional Use Permit No . 85-14 ) and were not raised during the public hearings for Conditional Use Permit No . 84-30, conversion of the existing facility. The zone change to C4-SS, effective November j 21 , 1985, is no longer required to convert the existing service station to a convenience market combined with gasoline sales . During the past year, the City Council are Planning Commission have expressed concern with the decline of service atationa and :conversions to self-service and/or convenience markets. Staff has been directed to evaluate convenience markets in relationship to commercial development standards, i . e . setbacks , parking, sight angle visibility. The proposed conversion to convenience market with gasoline sales will be incompatible with this new direction. r . RECOMMENDATION: Stiff recommends the Planning Commission disapprove a six month ; extension "of time based on the following findings . s FINDINGS FOR• DENIAL: 1. AIIALYSTS: Conditional Use Permit No . 84-30 is a request to permit an existing service station to convert to a convenience market pursuant to 5.9472 . 2 of the Huntington Beach Ordinance Code . This project was approved on November 13, 19b4 , and valid for one year unless construction has commenced and is proceeding without undue delay. No building permit has been issued . Attached within the staff report package is a chronology of the site : (northeast corner of Beach Boulevard and Garfield ) . Subsequent to the approval of Conditional Use Permit No . 84-30 , a new development plan (Conditional Use Permit No. 85-14 ) was filed in %--.onjunction with zone Change No . 85-11 . Zone Change applications were being held by the Cicy Council during the processing of a node amendment to prohibit beer ind - wine sales at service station . The zone change ..ways scheduled and approved by the Council as a new conditional use permit had been ' filed and possible conditional approval would preclude the sale of beer and wine . During the zone change public hearing before the City Council , caveat minute action required the . Planning Commission to address the parking and setback concerns of an adjacent property owner when reviewing the new convenience market development plan . The view proposed convenience market application 3 was not accepted for. processing (Conditional Use Permit No. 85-14 ) based on noncor .plie,nce with the Zoning ordinance. The possible condi►:ion of approval on the new conditional use permit .-prohibiting beer slid wine sales may have influenced the applicant to pursue:completion of plane and to Secure building permits on ch•= approved Conditional Use Per-.-tt No . 84-30 . On November 18, 1985 the, C,ity ' Council adopted Ordinance 2808B, an ordinance to prohibit sales ' of beer and wine in service stations . 6iring the plan check process for the existing service station conversion, .the .6xpirat1d' date was incorrectly noted . The attempt to obtain & building permit prior to finalization of the request for Extension of time malt have been based on the recommended condition of approval prohibiting the sale of beer, and wine on subject extension . The extension of time request was removed from the Planning Commission ' -. ,November 5 , 1985 , consent calendar and scheduled for a public heaL-ing on November 19 , 1985 . The request was continued at the appli,cani: ' s request to the December 1 , 1985 Planning Commission meeting . At this meeting the applicant 's representative agreed to work with staff to prepare a refined site plan addressing the City Council 's concerns ; therefore, the Planning Comission again continued the public hearing. However, the applicant was unwilling w' staff and ,nake an modification to their lar.s . At the tc west with y p De..rember 17 , 1985 Planning Commission meeting , the request frr a six-month extension of time on Conditional Use Permit No. 84-30 was denied based 'on the attached findings . Also, prior to issuance of building permits anI satisfaction of conditions of approval , a beer and wine license was issued to the station .operator by Alcohol Beverage Control (ABC) . At the time ABC j issued the license, they were not aware of the fact that the � . conditions of approval of the CUP had not been met . They t;,iought they were issuing a license for the sale of beer and wine in a convenience market and not in a gas station . A request for revocation of this license has been sent by City staff to ABC. ENVIRONMPNTAL STATUS: No additional review or action is required for an extension of time . This is an appeal specifically of their decision to refuse an extension of time of this Conditional Use Permit as well as their refusal to issue building permits pursuant to CUP 84-30 as requested on November 15, 1985 . The basis for :he Atlantic Richfield Company's appeal or the extension denial is grounded in the Planning Cammissioners ' inability to reach a decision as to the appropriate site plan as well as the relevant conditions. ARCD's appeal to the Staff and Planning Cxmission's refusal to � issue the building permits for CUP 84-30 on November 1S, 19859 is based on the fact that ARCO was advised in writing by the Planning Staff chat the permit did not expire until November 16, 1985. Upon re,Qscst fnr the permits on November 15, 1985, how ever, the sv ff determined it had made an error aAd that the actual terinination dal-e was November 13, 1985 and, therefore, the Conditional Use Permit had expired. Since that date Zone Change No . 85-11 , a change of zone from C4 to C4-SS, and Conditional Use Permit No. C5-14 , a request for construction of a new convenience market building , have been filed on the subject property . Conditional Use Permit No . 85-14 was rejected and Zone Change No . 85-11 was approved by the City Council with nev zoning to be effective November 21 , 1985. The City council adopter', the ordinance with the caveat minute action that the Conditional Use Permit , when considered by the Planning Commission, address the parking and setback concerns of an adjacent property P 9 j P P Y • owner .
