The Child Care Day Facility is proposed to be located within a .
single-family subdivision on a cul-de-sac street south of Warner
Avenue and west of Goldenwest Street . Currently the applicant is
caring fei four children in her home with a County License which
permits six children. The granting of the Conditional Use Permit ,
as requested, would permit the applicant to care fo: a maximum of

Section 9331 of the ordinance Code requires that 75 square feet vt

be planted with grass and enclosea with a 6-foot-high fence. Also,

My .reasons for appealing the planning conmissions decision to decline me a
Conditional Use Permit 1 85-3 are as follows:
At the time of the hearing I was unaware of any of nay neighbors being
unhappy with the situation as I 've received No complais;ts for the full
year I 've operated family child day care in my home.
It was only at the time of the hearing that a possible problem was bothering
some of my.'neighbors and I feel I was unprepared to state my case properly
at the time.
Since the hearing I have spoke to all neighbors on Argo Circle. Including

Please attach this to and make it a part of my Original liter
to you dated March 12, 1985. x r
My main reason for this appeal is that 1 strongly feel the great
nted of larger licensed Child Cars Homes in our community. I receive
on the average of three to four phone calls each week from parents
I seeking day care for their •coddlers and infants. I have to refuse
these parents as I have to comply with my existing licensing capacity.
I am currantiy, and have been taking Early Childhood classes
at Orange Coast Community College for the past 18 months. I am
the mother of two daughters and I have a four year old grandson.
I sincerely feel that when Mr. do Mrs Brusewits were notified
as to the public hearing of I:he Planning Commission he/they saw the
chance to take advantage of the situation. (Mr. Brusowitz circulated
the petition against the issuance of the Conditional Use Permit$ and
I feel he did it for perbanal reasons, )
By him taking advantage of the situation, I mean it wes approximately
ft year ago lust February when I wrote Mir. & Mrs . Brusewitz a letter
requesting that they please control the overgrowth of their weeds► j
bushes and t_.ass, which were really out of control onto my property.
Evidently they orere insulted by my request, as we have not spoke to
each other sl%-.ce that time . There have been other problems between
us that DO NOT concern Child Day Care that I will not go into detail
about.
Myself having a ten year background in Real Estate and Escrow
know from expariance. ALSO $ as Mr, a Mfrs. Brusewits know that a CAIld
�y Care Home does NOT decrease property values, however negl`ot doeso

submit my petition at :he time of the next public hearing.
There are three homeowners on Argo Circle that refused to sign
my petition, N..:T because of any noise or traffic probloms but because
they .art fearful of the terminology of Day Care. CENTER and 11G
business on OUR street. I consider what I'm asking for is a licensed
'DAY CARE HOMES Not a tenter a:- Dig business.
I also spoke to one property owner on Taurus Ln. , whereas he
stated to me that he hRs Not been bothered with any noise or traffic
but refused to reverse his decisior; (he signed the earlier petition)
because he is a FRIEND of Mr. & Mrs. Brusewitz. (he had no compl? nts
against me or the day care) .
At the hearing a°�1property owner who :lives on Taurus Ln. , stated
that he works nights and the ehildrnn' s noise 61 sturbes his sleep at
8• :)0 A.M. every morning. Please be aware that my husband also works
nights, the children' s outside play area is just ;outside of our
bedroom window. If anyone were ao complaint it would be say own husttiand.
Howwer the children are occupied and cared for INSIDE till about 1000.
A. M. every morning (IM-F) , The children are outside for about an hour
then 'it is time to clean up, have lunch and napa.
I apologize for this p,.rpeal letter being no long, but 1 Felt
all 6f this information is too important to leave it out.

additional vehicle trips generated per day as significant .
THE PUBLIC HHATtIbG WAS UPLNED: _
Albert Brown, homeowner in the proposes project 's neighborh000. spoke
in opposition to the project . He stated that he took the liberty of,
polling the neighborhood and received 17 names on a petition opposed
to the noise the children presented . He stated that 10 of the 17
, . names on the petition live on the same street . he stated that this
increase of children would be detrimental .
David Sander , homeowner in the proposed project ' :; neigt.torhood , spoke
in opposit:ior. of the project . Ht� stated that he worked rotating shift
work and the noise of the children prevented Trim from getting adequate
sleep.

Helen Deon spoke in opposition to the project stating. that she can
always hear the children . She stated that tier husband corks Tights
and she suffers from an illness that requires her to naintain a lot of
sleep day and night . She stated that the proposed project would be
detrimental to tier and ?jer husband 's well -being ano felt the children
were not cared for in a proper. manner .
Barbara Cooper Leonard, applicatit , statea that tier husbanu also works
nights . She felt there is a great need for cay cares centers , -Her
day care service was her way of contributing to tilling that need.
She stated that she was surprised by her neighbors actions , except for I
Mr . Brown whops she feels has 'animosity towards her for another reason,
no one has ever expressed their feelings to net personally .
There were no other persons to speak for or against the proposed
project and the public hearing was closed .
Chairman Livengood asked staff if dray care centers neea a conditional
use permit to operate . Howard Zelefsky of staff stated that if the
day care center consists of pore than 6 children , a conditional use
p-ermit is required. . Chairman Livengood asked staff if the city was
in any way involved in licensing this type of business. howara
Zelefsky of staff stated the city did not , however , the fire
dep&rtment and the state licenser and monitored these types of uses.
commissioner Rome stated that he was surprised at the response; of the

and other impacts to the neighborhood from this type of activiLy .

However , the ordinance coae requires 35 square feet of indoor play area
be provided for each child . Staff ' s plan check indicates that the
' childrens playroom" consisting of 352 square feet of floor area would be
the only usable portion of the house to be calculated toward the indoor

play area requirement . Theretore, because of the limited indoor
revreation area, the applicant can only be permitted a maximum of ten
children; this would include any or the applicant ' s own children ( under
18 years of age ) living at home .
In the applicant ' s written narrative ( attached) , she indicates that the
hours of operation are between 7 : 15 am. and 5 : 15 p.m. The pick up and
drop off tires are staggered during the morning and evening hours to
reduce the need for parking . As the number of clients attending this
facility increases , the accoripaniea traffic impact will change. At this
time , the staff does not view the additional vehicle trips generated per
day as significant .
Staff views the proposed clay care facility as a desirable and needed
business within the City of Huntington Beach as long as it does not
adversely effect surrounding neighbors . To date , staff has not received
any complaints from the immediate community regarding the existing day
care facility. Staff recommenas that the maximum number of children be
limited to ten , due to the defiency of indoor play area .
6 . 0 RECOMEENDATION :
Staff recommends that the Planning Commission approve Conditional Use
Permit No . 85--3 based on the following findings and conditions .
FINDINGS FOR APPROVAL :
1. The proposea day care facility will not have a detrimental effect
upon the general health , welfare , safety and convenience of persons
residing or working in the neighborhood; and is not detrimental to
the value of the property and improvements in the neighborhood.
2. The proposes day care facility is consistent with the goals and
objectives of the General Flan and will substantially comply with
the provisions of Article 933 of the Huntington Beach ordinance
Code.
3. The access to the parking for the day care facility will not create
undue traffic problem.

To Whom It May Concern :
I am writing this letter with regard to Barbara Leonard' s
application to change her day care license from a six
child to twelve child capacity.
I have two children, aged 4 -1/2 and 1 1/2, who were
cared for full time for the year starting February 1984
and ending February 1985• My daughter was 4 months old ;
at the time we started having; Barbara watch Paul and
Julie. I can say with all honesty that Barbara was the
best child care situation that I have ever encountered.
My husband's business is now in a place where we are able �
to do without my income so I am staying home with the
children full time until they are ready for school. This
is what we would have preferred all along. However, since a
we did need my income during that year I can' t tell you
how exceedingly glad we were to find the love and care
1 our children received in Barbitra' s home. I could arrive
at any hour of the day (and often did ae I worked a
freelance type Job) and the children were always in good
' shape, mentally and physicallye
Mon Barbara went on vacation last summer my sistor-in-law,

To Whom it May Concern:
Barbara Leonard has •been caring for my daughter Leila in her ,home
at 17242 Argo Cr. , Huntington Beach on a daily basis since February
1984. Leila was six months old when I started to take her there .
In my opinion, Mies. Leonard has given Leila the best po�seible care
in '& . safe and comfortable environment . In these days when it is
necessary for most mothers to work outside the home, it is most ,
important that our children are in an environment that is as Much
like home as passible.
For someone to feel secure in their choice of a caregiver its the
main objective in these times of unrest with regard to day Care
centers.
I've Bald to Mrs. Leonard as well as to a number of my acquaintances.
that should I move from the area or change jobs, I'd do everything
in my power to continue to bring Leila to her home.
To have to find a new care giver now (with all the
g publicity about
the insane goings on at places like the McMartin School) would
throw me into a panic
