After a substantial amount of negative comment by surrounding property owners and several issues and concerns expressed by the Planning Commission, the applications were continued and the :applicant given time to make revisions to the original plan _ The revised plan was presented to the Planning Commission on September 1, 1981 and included the following : 1. Construction of 42 "guest suites" over a semi--subterranean garage with 51 parking spaces . The "guest suites" consist of 24 bachelor units , 13 one-bedroom units and 5 two- bedroom units . None of the units will have kitchens . ' 2. The rearrangement of one finger of boat slips located at the east end of the facility and addition of 26 slips. 3 . Addition of a six -foot high wrought iron fence along the property line on Warner Avenue, Edgewater Lane and Sceptre Lane. 4 . Establishment of a pierhead line as shown on the site plan . 5 . Elimination oc the existing private beach and barefoot bar. 6 . Rearrangement of the present parking configuration. 7. Addition of a 600 square foot single-story gymnasium. 8 . Additior of a spa adjacent to the existing pool . 9 . Relocation o7 the main entry 240 feet to the east to a lo- cation 375 feet east of the corner of Sceptre Lane and Warner Avenue , CUP 81-6 r CE 81-09 f Sept . 23, 1981 Page 4 10 . Addition of restroom and shower facilities at both of the existing office buildings , An additional issue in addition to the issues listed in Section 3 . 0 of the attached staff report which was discussed at the .September 1 Planning Commission ni-,eting, is the fact that a portion of the proposed development as shown on the revised plan would encroach onto a parcel which was originally dedi- cated to the r:ity of Huntiz.g Lon Beach. The applicant presented another revised plan at the September 1 Planning Commission meeting ;rhich would mitigate this problem. Under t;-e original concept presented tc the Planning Commission at the August 4, 1981 meeting, the applicant' s Conditional Ex- ception request was for reliAf from two sections of the Ordinance Code. The applicant ' s revised porposal presented at the Septem- ber 1, 1981 Planning Commission me,-!ting eliminated the need for a conditional exception in every aspect presented under the original concept except a pr.oposel security fence within the front and exterior side yard setbacks. The criginal plan presented to the Planning Commission on August 4, contained the following proposed changes to the existing club: 1. Construction of 52 guest cottages over a semi-subterranean garage with 51 parking spaces. The guest cottages consist of 31 bachelor units, 16 one-bedroom units and 5 two--bed- room units . 2. The rearrangement of one finger of boat slips located at the east end of the facility and addition of 26 be,.i. :,.Lips . 3. Addition of a children ' s recreational ,Facility. 4. Addition of two tennis courts in the southeant corner of the site. I NOTICE OF APPEAL. Sept, 11 , 1981 Page 2 2 . Exhibit D constitutes a contract between the present landowner and the City of Huntington Beach , whereby the property owner possesses a legal contractural right to develope and renovate the property within the provisions of Conditional Use Permit No . 81-6 , and denial thereof constitutes a breach of contract between the landowner and the City of hunt.ington Beach . 3 . The reasons stated in Exhibits A and B for the denial of the Conditional Use Permit- No . 81-6 and Conditional Exception 81-09 are unreasonable , arbitrary , capricious and an excessive abu:-e of powers of the Planning Commission Agency of the City of Huntington Beach , as is more fully set forth , to wit : (a) Reason No . 1 states this is a proposed "residential development . " In fact , what is proposed is over-night guest cottages for use of recreational club memh,irs which could not be a residence because there are no kitchens provided . (b) Reason No . 2 goes on to state the proposed use does not conform to the use of surrounding property . Ilowever the adjacent property west of the subject property is improved with some 91 two-story condominium units , yet the property is still zoned R-1 . If this reasoning were to be followed , the subject property could nit be improved with the existing restaurant , gymnasium, cocktail Icange , social meeting center or a real estate brokerage office . (c) Reason No . 3 states that the lot coverage is doubled . This again is immaterial because the coverage is far Less than the 25% maximum coverage provided by RGIS zoning . (d) Reason No . 4 states that the tennis facilitN would bE virturally eliminated. This subjec' is within the sound discretion of the owner. (e) Exhibit B states the owner failed to show hardship . The present property owner is a corporation and does not claim ha;r.dship . The distance between the condominium units to the west and the nearest guest suite on the s>>bject prop3rty has been in- creased to approximately 55 feet from approximately 30 feet under the original concept . All balconies have been redesic;ncd to elimi- nate site lines through the railings. 4) The spa proposed under the original concept has been moved to a location adjacent to the existing pool . 5) The main entry has been moved 240 feet to the east to a location 375 feet east of the corner of. CONDITIONAL EXCEPTION NO. 81-09 Under the original concept presented to the Planning Commission at the August 4 , 1981 meeting, the applicant requested relief from sections of the code which prohibit structures within the front and exterior side yard areas and prohibit the construction of structures over 15 feet in height within 50 feet of a property that is used, master- planned, or zoned for residential use . The applicant ' s revised proposal has eliminated the need for a � • the original condi��^:ai exception in every aspect presented under concept except the proposed security fence within, the front and exterior side yard setbacks. The existing tennis courts are to re-- main in place and no new courts are proposed. All buildings proposed under the revised clan that are within 50 feet of a property line abutting residentially zoned property are under 15 feet in height. 7 .0 RECOMMENDATION: based on the above analysis, the analysi: contained in the August 4, 1981 staff report and the following finditigs, the staff recommends that the Planning Commission approve Conditional Use Permit No. 81--6 and Conditional Exception No . 91--09. FINDINGS FOR APPROVAL: (Conditional Use Permit No . 61-6) The Planning oonmission may approve a conditional use permit if it finds "the plan will substantially comply with the requirements of this article, the master plan of land use and development standards for tie particular use" (9841 . 5) . ' 1) The proposed project will not cause traffic conflicts on adjacent streets because Warner Avenue is a major arterial and has suf-- ficient capacity to accommodate project-generated -traffic. The existing circulation system will be redesigned to eliminate on and off-site stacking impacts . 2) The proposed "guest suites " conform with the purpose and .intent of the ROS district because they are incidental to the primary recreational facilities on the site. 3) The amount of parking proposed iL sufficient to accommodate the CUP 81-6/CF, 81-09 ND 81-32 September 1, 1981 Page 6 uses within the development because the parking conforms with the requir-rrients of Article 979 of the Ordinance Code, 4 ) The proposed project is compatible with surrounding land uses and is in conformance with general plan policies because the proposed improvements will not visually impact surrounding properties. FINDINGS FOR APPROVAL : (Conditional Exception No, 81--p9) The Planning Commission may approve a conditional exception if it makes findings that the Variance is necessary because of exceptional circumstances and the inability to enjoy property rights and finds that the exception would not be detrimental to the public health, safety and welfare or injurious to the surrounding area ; that the applicant is willing and able to proceed with the project without unnecessary delay. (9832. 1-9832. 4 ) :1) There are exceptional circumstances which apply to this property that deprive the subject property of privileges enjoyed on other Properties in the vicinity and under, identical zone classifications because of, the narrowness of the site. 2) The conditional excepticn is necessary for the preservation and enjoyment of one or more substantial property rights because th proposed security system is needed For this type of facility, e 3) Granting of this conditional exception request will not be materially detrimental to the pub:.ic welfare or injurious to property in the same zone claislfication because the proposed project will not adversely impact surrounding property and is consistent with the purpose and intent of the ROS district . SUGGESTED CONDITIONS OF APPROVA: 1 ) The site plan., floor plan and elevations received and dated August 26, 1981 , shall he the approved layout. 2) The 24 foot fire access road at the northwest corner of the project shall be secured against traffic and parking by a fence equipped with a Fire Department control lock subject to the approval of thc Fire Department . 3) Foot access for fire purposes shall be provided off Sceptre Lane just south of the garage entrance= in accordance with the requirements of the Fire Department. 4) All new buildings in the project shall be equipped with auto- matic fire sprinkler systems in accordance with Fire Department standards. In the staff' s view, dll of the existing and proposed facilities considered under this conditional use permit application are recreational in nature . The proposed quest cottages are not specifically defined or listed as a permitted use in the ordinance code ; however, the code does provide for approval of recreational uses and structures which are similar or incidental to those that are listed as permitted uses in the ROS district . Becau:3e the code under no circumstances would allow units intended for permanent habitation (e.g. , apartments, condominiums) in the ROS district , staff requested that the appli- cant submit supplemental information specifically describing the purpose and intent of constructing guest cottages. Ir the attached letter the applicant states, "Our concept of the cottages is to provide overnight facilities only for visitors , friends, and rela- t.-.ves of club members and people who rent boat slips . The intent is to extend the boating and recreational facilities of the club to its members , and we feel. that this in conjunction with the modernized restaurant will certainly enhance the amenities which ; we extend to our members for tennis, swimming, boating, as well as the social functions of our club. We have no intention to either lease this facility or to open it to the general public. " Within the context of the above definition submitted by: the appli- cant , staff has concluded that the proposed guest cottages are incidental to the primary recreational facility within the develop- ment . Ingress and egress to and from the site is provided by two access drives off Warner Avenue . Warner Avenue is classified as a major arterial with a capacity of 45, 000 vehicle trips per day . The proposed development will not significantly impact the adjacent street system. The main entrance to the development is at the western end of the site adjacent to the existing clubhouse. The applicant proposes the use of electronic security gates to allow closure of the majority of the parking lot to the public during certain night tithe hours . Two parking areas will remain open to the public at all times -- the area comprising 15 parking spaces adjacent to the quest cottages and the area comprising 20 parking spaces adjacent to the existing office building at the eastern end of the property. Answer ; "The property consists of a long, L-shaped parcel only 115 feet wide and, due to its recreational open space zoning, a 25-foot setback is required which consumes approximately 25 percent of the width, creating a hard- ship in achieving the proper use of the property. The property is completely surrounded by streets and a secur- ity problem has developed requiring the construction of a 6-foot high architecturally designed fence compatible with the entire project. The addition of the security wall will enhance this con- tinuity and also provide the protection of property needed for this type of facility . The following is in reference to, and `. identifies details of specific interest and concern to us. 1 . MARIMA WHARFAGE OR PIER-HEAD LINE. In discussion of ,the. overall piano it was agreed by the. Ahadpours (Club owners) , the HHPOA 1 Comittee, and, the several neighboring property owners present, that. regardless of any other definition of the wharfage or pier head rights, under no circumstances would marine slips or gangways. be extended beyond a line as shown on the attached drawing . This agreed-to line extends from the beach t' the existing outer end of Pier "F" , then continues easterly, following the existing contour of the marina Its it now. extends into the channel . z. CLUB HOUSE BUILDING. No, objectionabl a features were noted in,' the, plans for renovating the clubhouse facilities. It being under- stood that intent is to enlarge the existing mezzanine floor area in order to create a larger private dining room/bar for club members only. , the first floor dining area will then be converted to a, public. restaurant facility. These and other related changes to the interior of, the existing building are not of real co.icern to the HHPDA board of Directors.- at the 3. . TENNIS COUPTS . The tennis facilities now 1octhedWeitherly west end of the club property between the clubhouse and Bay condos will be removed. To compensate for these, one additional court will be added east of those existing along Warner Avenue, or be placed in the southeast corner of the property at Edgewater and warner Avenues . I 4. A FIFTY FOUR UNIT GUEST HOUSE. This is planned to be located in the area vacated by the tennis courts at the west end of the property. This structure would include semi-underground parking beneath . The motor entrance to serve this guest house will be through the existing main driveway entrance to the club, off of Warner Avenue. Extensive landscaping is included in the plans to screen the guest house structure from the Weatherly Bay condos . Since removal of the tennis courts will undoubtedly eliminate some noise in that area and night-time lighting of the courts will be eliminated, the end result would seen less objectionable than existing conditions . 5. THE PRIVATE CL118 BEACH . This presents serious concern as result of the 9 February 1981 ruling of the Regional Coastal Commission relative to application by the club owners for a permit to proceed with the desired remodelling of the club building interior, described in paragraph 2 , above. The Coastal Commission, after lengthy contradictory discussion as to adequacy of parking should the restaurant be serving the public (question as to enough parking for a public restaurant - no questions raised as to regard for public beach goers if it is made public) decided to approve the remodelling if the owners Save the beach to the State for public usage with physical access to it at the owners expense. (Note : The HHPOA Board of Directors has filed an appeal of this ruling regarding the beach to the State Coastal Commission) . CONCLUSION. The HNPOA Board of Directors finds no objections to the planned changes described above and as depicted on the Master Plan drawing submitted for review. Particular emphasis is repeated in regards to understanding the wharfage or pier head line limitations (paragraph 1 ) and as delineated on the drawing. It is also emphasized that the Board .loins in continued effort to resist the Coastal Com fssfan action fn regards to public access and usage of the beach. This requires a revision to the site plan which the applicant agreed to address. The following con- ditions were added to the Conditions of Approval : 1. A fire h,rdrant will be provided. 2. The parking lot layout shall be in accordance with the Public Works Department. " The Commission discussed the meaning of the ROS district, especially the interpretation of the phrase "recreational diversion" . The public hearing was opened. Don Hartfelder addressed the Commission to describe the history of the club and outline the proposal being made by the present owner. The following persons addressed the Commission in opposition to the project: Don Watson, 17071 Edgewater Lane Cecil Hubbard , representing Weatherly Bay residents Morris Stone , Weatherly Bay resident Norman Smith, Weatherly Bay resident Mark Rugen, 16692 Bolero Lane Luis Cardenas , Huntington Harbour resident Lorraine Faber Ken Kirk, Weatherly Bay resident. Two of the above persons submitted petitions signed by other resi- dents of the Huntington Harbour area opposing the project. The major area of concern was the construction of the guest cot- tages. The speakers cited the density of the project, saying it is really an apartment complex which does not comply with apart- 1 ment standards ; the lack of adequate parking in a project which is already 74 spaces deficient in parking; the blocking of the line of sight for some of the units in Weatherly Bay; the lack of proper separation from buildings of this height and the adjacent 18 foot high condominiums ; the balconies which will overlook the neighbor-. ing residences ; and the impact of traffic on Sceptre Lane , the only access into the Weatherly Say units . The general feeling of the speakers was that providing the guest cottages with kitchens and two bedrooms would ensure that the applicant would try to obtain maximum occupancy of those units , even though assurances have been given that thef will be for use of members ' guests and relatives only. -5- 6-4-81 - P.C. It was asked that the line depicted on the plans be straightened out to make sure that no more docks are added in the future, and that the area outside of that pierhead line be dedicated to the public to e; sure retention of the turning basin; 2) Elimination of the beach; 3) Lack of enforcement of the prohibition of live-aboards in the harbor; 4) Moving of the tennis courts. It was asked that if the relocation is approved the courts be limited to daytime use to prevent intrusion of lights and noise on the neighboring residences; 5) Use of the commercial build- ing in the center of the existing parking lot, which a speaker con- tended should be deleted from the plan; 6) The need for retention of the launching ramp when there is the Fire facility only two blocks away which can be used; and 7 ) Current and past management of the club, which some speakers contended had largely contributed to its present problems. It was the consensus of these speakers that the project if approved would constitute a major, dramatic change in the nature of their community with which they could not concur . Bill Matthews, representing the Huntington Harbour Homeowners Asso- ciations , informed the Commission that there is a letter, in the file signed by him which could be misconstrued as supporting this project , but in fact the letter had been written to attempt to dissuade the Coastal Commission from forcing the beach and the club to go public and did not apply to the present proposal . Mr . Matthews added that he had been unaware of many of the modifications which have been in- eluded in the present proposal and could not say what its effect would be without further study . He asked that the Commission post- pone a decision until all residents have had an opportunity to review the total plans as submitted . The public hearing was closed. very extensive discussion took place between the Commission and staff. Included were the items touched upon by the above speakers , princi- pally the guest cottages and their impact on the area. It was the Consensus that the inclusion of kitchens in the units was unacceptable and might lead to some future conversion request, that there was in- adequate buffering between the proposed units and the adjoining dwellings , and that the plans need to be redrawn to minimize the im- pacts from those units. The pumpout systems were reviewed, and Savoy bellavia suggested new wording to require a pumpout system to be in- stalled adequate to accommodate the total number of boat slips in the facility and that such a system might require a sewer hockup for each individual slip.
