Conditonal Use Permit 81-15 in conjunction with Tentati -:` Tract 11498 is a request to permit the conversion of an existing 120-unit apartment complex to condominiums. The subject property is located on the east side of Magnolia Street south of Garfield Avenue. RECOMMENDATION: The Planning Conunission recommends approval of Conditional Use Permit 81-15 and Tentative Tract 11498 . The staff ' s .recommendation to the Planning Commission was for denial of the subject applications . ANALYSIS : Appellants : Mayor Ruth Finley and Councilman Ron Fattinson P.O. Request: To permit conversion of a 120-unit apartment complex to condominiums . THE AMENDED MOTION TO APPROVE CONDITIONAL USE PERMIT 81-15 AND TENTATIVTs TRACT 11498 WAS APPROVED BY THE FOLLOWING VOTE, WITH THE CONDITIONS AND FINDINGS AS CONTAINED IN THE ATTACHED MINUTES: AYES: Bannister, Kenefick, Paone, Porter, Mahaffey NOES: Winchell, Schumacher ABSENT: None ABSTAIN: None (See the attached minutes of the September 15 , 1981 Planning Commission meeting for findings and conditions . ) DISCUSSION: Conditional Use Perr:it 81-15 in conjunction with Tentative Tract 11498 is for the conversion of a 120-unit apartment complex to condo- miniums , in order to allow individual ownership of these units . As pointed out in the original Planning Commission staff report of May 19, 1981 , since the City of Huntington Beach does not hava a condo- minium conversion ordinance at the present time , the conversion of this project must comply with the provisions set forth in Article 936, Planned Residential Development, of the Huntington Beach Ordinance Code. This project was analyzed in relationship to Article 936 and the following deficiencies were identified: 1) The subject property is presently zoned R3, allowing 25 units per gross acre. The project is built at 27 . 2 units per gross acre. 2) There is approximately a 25 per^ent deficiency in the required number of parking spaces . 3) The existing project is approximately 75 percent deficient in the re4uirement. for common open space. 0-The existing building bulk exceeds that permitted by thri Planned Residential Ordinance. 5) The existing, carports are not set back the required 5 feet from the tratvel, lanes . 0 . ,"ie front yard setback along Magnolias Street ie only 12 feet, the code r6qiiires a minimum of 15 feet with an average setback of 2nfeet. C .U.P. 81-15/TT 114981ppeal) f October 9, 1981 Page 3 7) Both of the existing entranceways are substandard in relationship to the Planned Residential Ordinance, which requires 48 feet en- trances for a minimum of 100 feet into the project. 8) All of the private patios and balconies are substandard per the PRD ordinance requirements. In light of the number of deficiencies in this project in relation- ship to the ordinance for planned residential development, which are explained in detail in the attached staff report, the staff recom- mended denial of this conversion. During the time that this project was being reviewed and discussed by the Planning Commission, the staff was working on the preparation of an ordinance for condominium con- version. ;A"ie development standards set forth in this prcposed ordin- ance require that projects being converted comply with the minimum standards set forth under Article 932 , Apartment Standards, of the Wiritington Beach Ordinance Code. The subject project was reviewed in relationship to Article 932 and a number of deficiencies were identi- fied, including common open space , driveway width, and parking. This project was reviewed by the Planning Commission on May 19, 1981, July 22, 1981, September 2 , 19bl , and final action was taken on September 15 , 1981 . Considerable discussion took place between the applicant and the Planning Commission at each of these Planning Com- mission meetings . At the September 2 meeting , the applicant indicated that his client was willing to provide 66 percent of the units for sate within the affordable housing range. The Planning Commission expressed considerable interest over this proposal. by the applicant and requested that the applicant submit additional detailed information outlining the sales program for the protect. The applicant presented a sample schedule based on the latest County median income studies and a 16 percent interest rate, which he said would enable a qualified buyer to start out with a monthly payment of about 30 percent of his income, going down in four years to about 22 percent of his income. He also stated that this is only a sample , because there are an in- finite number of variables which could affect the figures. Commissioner Bannister discussed provisions of the housing for the elderly as recently required by Los Angeles ; the applicant was asked if it would be feasible to agree to hold 25 percent_ of the units specifically for elderly persons . The applicant indicated that it could be done but that he would need a provision to specify a defin- ite. period of time for which the units would have to be held. The Commission agreed on a one-year period of time from the actual con- version date. . Xfter considerable discussion regarding the , affordability of the proposed project, the Planning Commission approved the conditional , use permit and tentative tract, allowing the conversion of this 120-unit. project. I i 1 PPOfJ'ECT DESCRIPTION The Beachwood Apartments consist of a 120 unit complex located on the west side of Magnolia Street just south of Garfield Avenue. The project was constructed in 1970 . The unit mix is as follows : 80 2 BR - 2 Bath units @ 1000 sq. ft . 40 1 BR -- 1 Bath units @ 725 sq. ft. 120 Total Parking is provided as follows : 138 spaces in carports 76 open spaces 3.14 Total Each unit has a private patio or balcony. Recreation facilities consist of a pool and spa plus a recreation room in the central open court. Two centrally located 3 laundry rooms are provided . Each unit is separately metere-3 for electricity and has its own electrical appliances including stove , oven, water heater, and air conditioner. We believe this proposal, as described in the following paragraphs, will be a very desir- able project for the city, the current owners , and the future homeowners . The project: as proposed will provide home ownership oppor- tunities for several, low and moderate income households, and also provide the opportunity to upgrade the existing structures and living environment. We have been working with the City ' s Condominium Conversion Ordinance Committee , and understand the difficulties entailed in seeking approval of this conversion prior to the city establishing new criteria through a new or revised ordinance; however, it is imperative that we seek approval at this time, since the financial base of the existing complex will change very significantly in the first one half of 1981 when three separate loans are due to be paid in full , requiring new financing. With the present financial base it is -possible to offer significant benefits to the new home owners in the form of lower prices which would not be possible at a late.- date. The proposed program for conversion of the Beachwood Apartments to condominium ownership has been caref_+illy structured to provide home ownership opportunities for the existing tenants, including opportunities for low and moderate income buyers , with the least possible inconvenience for those tenants who cannot or choose not to purchase. The program is outlined below: NOTIFICATION TO TENANTS * Notification of intent to convert was sent to all tenants on February 23. 1981. (copy attached) . PURCHASE OPPORTUNITIES AND INCEN►I'IVE117 * 25% (30 units) will be reserved for sale to low and moderate income households at $40 , 000 . 00 to $6C , 000:00 with an average price of $ 50 , 000 . 00 . The remainder (90 units) will be sold at inarket rates . * The developer will work with the city to secure low cost financing and develop reasonable resale controls on the affordable units. * Tenants ,rill be given first opportunity to qualify for below market rate units. * Tenants who wish to purchase the unit they occupy will be given a 5t discount from the sales price and an additional 5% discount if they elect to purchase "as is" (Total=10%) . This offer will be in effect for the first 30 days of the 90 day exc]usive right to purchase. REHABILITATION The developer will perform certain rehabilitation and improvement work prior to sake, except for those purchased "as is" . The work. will include, at a minimum, the following : * Complete interior and exterior painting . * Replace carpet and drapes and floor coverings. * Repair or replacement of all applicances and plumbing fixtures . * Sound attenuation to city standards . * Certification that plumbing, electrical and roofs are in sound condition. * Enhancement of pool and spa area , including additional fencing. * Repair and re-surface parking and drive areas as necessary. * The rehabilitation of up to six units will be specifically designed to accommodati- needs of handicapped persons . RELOCATION ASSISTANCE The developer will provide the following assistance to - tenants: * Current tenants who move out of the project after the 180 day notice of intent to convert will receive a $1000 . 00 payment to off-set the cost of relocation expense. 12 * All security and c'_ea,:ing deposits will be returned, provideu that there is no physical damage to the unit. * A 'Full time relocation specialist will be on site during the sales program to assist in finding comparable housing , securing needed transportation , etc. Extended occupancy agreements will by available such as " last month free" for tenants who agree to stay until the start of the actual conversion . * (Tenants who move prior to the notice of intent to convert will be deemed to have waived any claim for relocation assistance . ) It has been determined that , under current zoning regulations , a conversion project must be evaluated against the site development standards for a planned residential development (PRD) . This project is built to apartment standards , and , therefore , does not meet PRD standards in all respects . We respectfully submit that "condominium" is a form of ownership and not necessarily a site design concept, and , therefore , request that the technical variations from the PRD standards be allowed to facilitate the opportunity of home ownership at affordable prices . In order to meet PRD standards the project would have to be essentially redeveloped , which is neither practical nor desirable , since it would probably result in loss of some units , thereby reducing the city' s lower cost housing in•7entory ..
