7 . 0 SUBDIVISION COMMITTEE:
The Subdivision Committee met to review the project on January 12 ,
1982 . The major issues of concern expressed by the Subdivision
Committee are contained in the attached minutes . In the attached
letter dated March 8, 1982 , the applicant has addressed the Sub-
division Committee ' s concerns .
8 . 0 ANALYSIS:
A number of environmental and planning issues were addressed by the
staff and Planning Commission through the public hearing process on
EIR 81-3 and the Seabridge Specific Plan. The minutes of hearings
held regarding the EIR and the Specific Plan are attached, alcng with
the applicant ' s responses to issues identified by the staff and the
Commission. The applicant ' s development- proposal complies in all
respects to the final Specific Plan criteria adopted by the Planning
Commission on February 17 , 1982 .
The issuM of compact parking was discussed during deliberations on
the specific plan; however, no specific ratio of allowable compact
parking spaces was established . The applicant is proposing 25 per--
cent, or 174 of the total 755 spaces in Area B as compact parking
spaces. These spaces would be evenly distributed throughout the
parking facilities, and all of them would be unassigned . Another
237 full size spaces :,Auld also be unassigned , while the remaining 344
would be full-sized, assigned :spaces .
Subsequent to the February 17 , 1982 Planning Commission meeting,
the Department of Development Services received the attached letter
dated February 16 , 1982, From the State Department of Fish and Game
claiming that the City 's response to Fish and Game ' s comments con-
tained in EIR 81-3 was inadequate by standards of CEQA. On February
25, 1982 , City staff met with representatives of the State Depart-
went of Fish and Game and the State Office of Planning and Research
to discuss this response to Fish and Game 's comments . It was
agreed that the City would reorganize and expand its response to
emphasize more clearly the reasons why specific questions contained
in the Department of Fish and Came 's comments were not addressed.
The City's revised response to Fish and Game ' s comments (attachedi
was presented to the City Council at its March 15 , 1982 public
hearing on the EIR and Specific Plan. In addition, staff met with

the applicant and re resentztives PP P of the Department of Fish and
Game on March 9, 1982 and dis-ussed methods of preserving the
resource value of the existing ons.i.te pond within the context of
the current development proposal . The applicant an-,4, the Department
of Fish and Game are attempting to develop an acceptable design
solution which would partially mitigate the loss of wetland area
during the interim period between construction of the units and
development of a functioning saltwater marsh within the resource
production areas .
9 . 0 RECOMMENDATION:
Staff recommends that the Planning Commission approvo Conditional
Use Permit 81-34 and Tentative Tract 11673 subject to the follow-
ing findings and conditions :
FINDINGS.
1. The proposed development is in conformance with the policies F.,nd
development standards contained in both the City ' s General Plan and
the Seabridge Specific Plan . The General Plan has set forth provi-
sions for this type of land use as well as setting forth oLiectives for
implementation of this type of housing . The project complies with
the Land Use Element and all other elements of the General Plan.
2. The prof red subdivision of this 64t gross acre parcel of laird
zoned Seabridge Specific Plan is proposed to be constructed having
15 + units per gross acre.
3 . The property was previously studied for this intensity of land use
at the time the land use designation of Planned Community was placed
on the property.
4 . The lot size, depths , frontage, street widths , and all other design
and - implementation features of the proposed subdivision are proposed
to be constructed in compliance with standard plans and specifica-
tions on file with the City as well as in compliance with State Map
Act and supplenentarl City subdivision ordinance.
. SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PEIV-11T NO, 81-34 :
1 . The site plan, floor plans , elevations , and all other supplementary
plans submitted by the applicant and dated March 5 , 1982, shall be
the approved plans for this development .
2 . Natural gas and 220V electrical shall be stubbed in at the locations
of clothes dryers .
3. Natural ga., shall be stubbed in at the locations of cooking facilities,
water heaters, and central heating units.
4. Low-volume heads shall be used on all indoor. faucets,

surplus or unusable ma -e.rials shell be disposed of at an offsite
facility equipped to handle them.

7 . The covenants, conditions , and restrictions sna11, contain a pro-
vision that will prohibit storage_ of boats , trailers , and recreational
vehicles onsite , unless an area that .is specifically designed for
such storage and which is in compliance with the provisions of
Article 936 is provided for the project .
8 . Tne location and design of all entry ga ;;es shall be reviewed and
approved by the Department of Development Services and the Fire
Department.
9 . The design and materials of thr. perimeter wall shell be subject to
the approval of the Department of Development Services prior to
issuance of building permits .
10. A detailed landscape and spri.nkl�� r plan shall be subject to the
approval of the Department of Development Services prior to the is-
suance of building permits .
11 . All approved drives shall be considered required fire lanes and
shall be signed as such subject to the approval of the Huntington
Beach Fire Department .
12 . A fire sprinkler system shall be dosigned and installed in those
structures as deemed necessary by the Hurtington Beach Fire Depart-
ment.
13 . Units facing water-scaped areas shall maintain a sufficient setback
subject to the approval of the Huntington mach Fire Department.
14 . The termination of al ', public streets at the boundaries of the
development shall be designed and constructec, by the developer in a
manner acceptable to and approved by the Department of Public Worts .
15 . All interior roadways, with the exception or the north/south most
easterly roadway , and parking courts shall be a minimum of 27 feet
in width .
16 . The applicant shall coordinate with the State Department of Fish and
Game in mitigating to the greatest extent Feasible the immediate loss
of wetland area .
CONDITIONS OF' APPROVAL - TENTATIVE TRACT 11673 :

Jim Barnes gave a presentation of the project. "e cited the change
of wording in Condition 09 ( listed below) fo. the Conditional Use
Permit regarding the perimeter wail.
The public hearing was opened . frank Mola, the applicant, addressed
the Commission stating his reasons for granting the request . The
public hearing was closed .
Commissioners Sebumtscher and Kenefick agreed that some provisions

need to be made addressing the .low to moder-ite income housing issue.
However, Commissioners flaggins and Paone disagreed stating that the
affordable housing was only imposed on areas in the coastal zone,
and , furthermore, it was never stated at the time the Seabridge
Specific Plan was before the Cotnrnission . At this time, the applican
wa:s asked to come forward and state his opinion on the affordable
housing question. Mr . Mola stated that he will have units that he
feels are affordable and felt that at this stage, it was out of the
question for him to build affordable units with the same stipulations
imposed on other projects in the coastal zone.
Further discussion took place regarding the rewording and adding
of other conditions on the Conditional Use Permit that are listed
below. In addition, staff added four conditions of approval for
CUP 81-3 4 .

motion to delete that. requirement.

DISCUSSION:

Tha letter of appeal (attached) submitted by Councilman Thomas,
states that the issue of low income housin; was not addressed at the
Planning Commission hearing, and requests City Council consideration
of the matter . At the March 16 Planning Commission meeting, the
Commission `id discuss whether it would be appropriate to require
a percecicage of the 744 units within the proposed development to be
offered for sale in an "affordable" range. It was the consensus of
the Planning Commission that the appropriate implementation mecha-
nism for requiring affordable housing within this development would
have been through incorporation of specific standards in the Sea-
bridge Specific Plan.
At the March 16th public hearing , the applicant statod that a large
percentage of the units within the development would be in an "af-
fordable" range.
The City Council has adopted the policy contained in the Housing
Element to "promote, and where possible, require the continued
affordability of all units produced with participation by the City
or its authorized agents (including inclusionary zoning) " . At
present, the City has no ordinance requiring that a percentage of
housing be provided in an "affordable" range within residential
developments. The Planning staff is in the process of preparing a
report outlining options for implementation of the Housing Element
goals and policies pertaining to affordable housing .

The inclusion of "affordable housing units" has been required as a
condition of approval either by the Coastal rananission or Planning
Commission on several condominium projects within the Coastal Zone.
Presently there is no precedence for this requirement in areas out-
side of the Coastal Zone.
FUNDING SOURCE:
Not applicable.
ALTERNATIVE ACTION:
1 . Reverse the Planning Commission ' s action anc modify the conditions
of approval to include a condition requiring that a percentage of
the units be offered for sale in an "affordable" range .
2. Deny the project on the basis that a percentage "affordable units"
was not prescribed through the Planning Commission' s conditions of
approval .

The Seabridge Specific Plan was considered by the Planning Commission
and recommended for City Council adoption subject to some minor
amendments at the Planning Commission' s February 17 , 1982 r�n„i �►
meeting . An amended copy of the Specific Plan incorporating all of
the recommendations of the Planning Commission is attached.
The development site is bisected by an Grange County Flood Control
District channel . For descriptive purposes, the site has been divided
t into tt;o devE.lopment areas : Area A, consisting of 38.1 acres lying
east of the flood control channel; Area B, consisting of 12. 99 gross
acres lying to the west between the flood control channel and Beach
Boulevard. In addition to the develo,;pment areas , approximately 8 acres
on the site will remain in oil produc ,Aon and will eventually be
dedicated as common open space.
Area A consists of 400 one- and two-story attached dwelling units
over tuck-under parking. There are four main recreational areas in
Area A, which include tennis courts , swimming pools , spas , and other
active recreational facilities .
i Area B consists of. 344 dwelling units in three structures three to
four stories in height with full subterranean, semi-subterranean, and
surface parking . There are two main recreational areas in Area B.
A major circulation element for the entire development consists of
a 50-foot collector street which bridges the channel and connects
Areas A and B . Direct access to the individual units will be via
secondary roads and parking courts connecting with the collector
street. Access to the site is through controlled entry intersections
along Beach Boulevard and Adams Avenue .

3 . 0 SUMMARY OF ISSUES :
The major issue of concern regarding Tentative Tract 11673 and
Conditional Use Permit No . 81-34 is whether the specific development
project being proposed conforms with policies and development
standards contained in the Seabridge Specific Plan.
4 . 0 ENVIRONMENTAL STATUS:
+ An environmental impact report (EIR 81-3) was prepared assessing
the Seabridge Specific Plan and the development project under con-
sideration. The FAIR presents a detailed assessment of the existing
environmental setting of the project , project-related impacts, alter-
natives, and measures intended to mitigate adverse environmental
impacts. The EIR was considered by the Planning Commission on
February 2 , 1982, and recommended for certification by the City Council.

CONDITIONS FOR APPROVAL :
1 . The site plan, floor plans, elevations and all other supple-
mentary plans submitted by the applicant and dated March 5 , 1982,
shzill be the approved plans for this development .
2 . Natural gas and 220V electrical shall be stubbed in at the lo-
cations of clothes dryers. This requirement irsay be waived pro-
vided that the applicant: will, install a more energy efficient
alternative subject to the review and approval of the Department
of Development Services .
3 . Natural gas shall be stubbed in at the locatriuns of cooking fa-
cilities, water heaters, and central heating units . This re-
quirement may be waived provided that the applicant will install
a mar . energy efficient. alternative subject to the review and Lp-
proval of the Department of Development �-ervices .
4 . Low-volurne heads shall be used on all indoor faucets .
5 . All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable materials shall be disposed of a� an
offsite facility equipped to }candle them.
6. Energy.-efficient lighting shall be used in parking lots and/or
recreation areas .
7 . The covenants, conditions, and restrictions shall contain. a pro-
vision that will prohibit storage of boats, trailers, and re-
creational vehicles onsite, unless an area that is specifically
designed for such storage and which is in compliance with the
provisions of Article 936 , is provided for the project .
S. The location and design of all entry gages shall be reviewed
and approved by the Department of Development Services and the
Fire Department .
9. The design and materials of the perimeter wall alone property
lines at the terminus of public streets shall be subject to the
approval of the Department of Development Services prior to th6
issuance of building permits.
10. A detailed landscape and sprinkler plan shall be subject to the
approval of the Department of Development Services prior to the
issuance of building permits. A plan for intensified landscaping
along the east and south property lines in Areas A and n shall
be reviewed and approved by the Department of Development Services.

Fish and Game in mitigating to the greatest extent feasible,
the immediate lot cf wetland area .
17 . Signal improvements shall be installed by the applicant at his
own expense at the entrances located on Beach Boulevard and
Adams Avenue, pursuant to Department of Public Works standards .
16 . Design of the bridge across the flood control channel shall be
in accordance with Department of Public Vlorks standards . Fen-
cing shall be installed alone the edge of the flood control
channel, a minimum of five (5) feet in height. Embankments 7
along the flood control channel shall be fully landscaped.
19 . Freshwater lakes and ponds within the development shall use
reclaimed water from the Orange County Sanitation District,
if made available in adjacent streets .
20 . The freshwater pond located north and south of the main entry
drive off Beach Boulevard shall be designed in accordance with
the conceptual freshwater pond design received and dated
March 15, 1982.
21 . A11 standards and provisions contained in the Seabridge Spe-

tions. The ordinance will establi.=+h requirements for notification
of mobile home park residents, and •:11 rat guif?e- lines for approval
of a Tenant Relocation Assistance Plan prior to the change of use
of a mobile hone park.

code amendment.

Opposition was to various concerns . Public consensus was definitely
against the use of Kelley Blue Book as a guideline fo, compensation
of the displaced tenants . Most persons stating that this was con-
siderably less than even their initial investments. Robert Williams,
representing Huntington Shores Mobile Home Park suggest+id that 2
study session be conducted . Ile especially objected to i sentence
in the proposed ordinance which states that temporary lodging ex-
penses incurred by the move shall be identified and paid by the
applicant at the time of the wove . He would like: staff to define
"temporary lodg.i.ig expenses" . One citizen cit-ed an incident where
his mother, who was a tenant at a park, actually sold her mobile
home for a very low sum when she was "frightened" by the rumors of
park conversions. The public hearing was cloned.
Commissioner Kenefick was concerned about the public being notified
with some sort of information sheet regarding the proposed ordinance.
Mr . Pailin stated that this could be done by staff . Corrunissl,oner
