Several people who spoke in opposition matte falue and misleading etateuert6 lending the Coaxission meabrer•n to boli-eve otir plan was inaccurate and the Red Onion was virilattng soning regulations. 2 . Upon the ani)ouncement of this item for Public Hearing Commissioner Slates publicly commented that no matter what was said his intentions were to deny our request and further stated that he had ties with the Costal Commission and they would never approve this application. We feel that those tents mts will as other derogatory remarks made by commissioner Slates before any testiLaony was given denied us a fair and iupartiai hearing. As to finding no. 1 there will be no additional noise generated i as this is a public walkway facing a busy harbor area. Th s space was designed and approved for public use end the sound of a small group of people having a quiet brunch could not be overheard above the noise of the many boats in the harbor. In addition, the 1inited hours of operation should not disturb any persons residing in the aria. Am to finding no. 2 the ;persons utilizing the dining area are the persons working and residing in this area. The decision to dine at the Fled Onion is one made of choice. we simply request tha same nights en juyed by every other busintit:r and resident in the area . Virtually every Broadeeoor resident has patio furniture outside as well as every restaurant in Peters Landing. The Red Onion is the only one not allowed this i privilege. ..s to finding no. 3 by creating a place for the public to sit in sight of the shops in Peters landing we feel this would give the other ±aerdhants +exposure without the detrimental effect of .:outdoor advortlaing. Thia mast likely will increase business thus raising property v-luea and generating additional sales tax for the City. The proposed use would be for the overall benefit of Paters Landing. 1Pinding no. 4 states that our proposal would narrow the walkway co e1 and Mould conflict with thk spirit of the Coastal iswicn intent for a 10' public accessway. At no time would our proposaI create anything less than loll of rccessway. In fact, with the aftitioh of landsoape planters we feel this would add to the beauty and create a warmer and more people friendly atmarphn%- It is the spirit of the Costal Commission that r ireM this area to be dedicated for the public use and e mart. The minutes for those actions have br4n ottacbed to this report . The mandatory one--year time f rama for resubmitting a request which has been denied has expired; therefore, the applicant has resubmitted their request . The applicant 's request shows 5 too-parson tables and 5 four-person tables for a total of 30 seats along the west facade of the building facing the marina . The applicant is proposing to leave one set of fresh doors open along the Nutt side of the building to provide sec*e$ to the outdoor tables . Subject property is located at 16450 Pacific Coast Highway (North side of Pacific Coast Highway approximately five hundred feet ( 5001 ) West of Admiralty Drive) . This request is covered by Categorical Exemption, Class 1, • Califdrnia Environwatal Quality Act , 1985. The Staff mea:ber , Laura Phillips, reminded the Board this item had been continued from the previous meeting to readvertise the request. 'Staff Is understanding of the Original request had been for amA w 1, Nt Minutes , If . 15 , Board of ioni.ng Adjustments June 3 , 1987 Fags 2 outdoor dining on the patio fc,r Sunday brunch only; however , the applicant ' s represontat.ive stated they were requesting dining on the patio for the entire time they were open for service . The applicar ;: proposes eleven (11,1 tables on the patio facing the walkway. Staff has several concerns -- one of which is maintaining the minimum lien font ( 1.01 ) clearance on the walkway as required by the Coastal Commission . The site plan shows tables along the building well which would extend outwardly approximately four feet (4 ' ) . L'i ase tables would be situated between the several doors on that side of the building . Maintaining the proper clearance would necessitate waiter service through t:hosb doors without encroachment into the walkway clearance . They Fire Department is requiring that Table 10 be relocated because it is blocking a fire exit . Some type of railing or division would be required between the tables and the walkway or smaller table$ could be installed, allowing service around tbeim. Staff has received several letters and calls from adjacent residents in objection to this request; because of added noise, . increased) parking demands , traffic, late night disturbances , and difficulty of reaching their buats whrough the walkway access . Staff recommended approval of the request with conditions, including those presented to the Board . Daryl Smith asked Staff if the applicant had previously been made aware of, the recommended conditions and Staff replied in the affirmative . The public Hearing was opined by Chairman Dennis Kreici . The applicant ' s representative, Ralph Salteman, was present , along with Bradley Anderson . Mr.'. Saltsman stetted he concurred with the conditions and recommendations made by Staff and would have no problems adhering , to them. He -added the Red O:Mori wanted to be a flood neighbor to the adjacent residents and held meetings with them periodically to discuss and resolve any problems which might occur. Dennis Krejci reminde' d the applicant that Staff .was recommending the operation be conducted in such' a, manner that no customer or employee would enter the area within the ten feet (10 ' ) walkway space . Mr . Saltzman stated he understood this restriction. - Leonard Itkoff, 3205 Moritz Drive, stated he docked his boat in the marina and had, on many occasions over the last three years, been stopped' by pet:eer ' s Landing security or restaurant employees from going along the walkway to reach his boat. He mentioned that the Red onion held ps ctAox in thin areea* and had plastic canopy dividers with pipe on the *bottom with which they blocked off the area. ilea also added he had measured , t:he available space, and the area between the planters and the water Line would be only six and one--half feet (6-1/21 ) wide. Mr, itkoff also objected to the noise from the digco .area upstairs over the main restaurant . -Z- 6/3/87 BZA i t Minutes , H . B. Board of Zoning Adjustments June 3 , 198 Page 1 Stefan Steinberg , 16591 Tropez Lane , zt-ated he lived in the nearby hroodmoor complev and had mailed a letter of objection to the Board . Mr . Steinberg added he was a member of the Sroanmoor F.o0aowners ,Association but was: unaware of any "good neighbor" policy meetings such as ientioned by Mr , Saltsman . Mr, Steinberg also saiA he and other people cc casionally walked their dogs along the wall.way area and wondered if the Health Department might not hags objections to food being Served in an area li.ko this . He further expressed complaints about the late night noise, parking problems, etc . He xtated the Homeowners Association presently had an injunction against "the Red Onion because of past problems and he and others had been keeping a log showing dates and times of various intractionn or infringements upon their personal rights . Dennis• Krejci said it seemed many of the problems mentioned might stern from alcoholic beverages being served on the premises . Glen Godfrey &sked Mr . Eteinberq if he would be able to furniba "the Board a copy of the complaints covered in the "daily log" they were keeping. Mr . Steinberg said he could make it available to' the Board, along with a copy of the temporary injunction. Daryl Smith asked Staff if she had analyzed the parking situation in relation td the additional restaurant seating . Staff said it would be minimal - something liken two and one-half (2-1)'2) spaces . There wias no one also present wishing to speak for or against the, request so the Public Hearing was closed . Glen Godfrey added he did not think the applicant was providing ample parking as requirid by Code. He said vAlet parking • joint une parking, and a Parking Management Plan had heen worked out in the past ..tb allow joint use parking and the plan had been approved by the city Council , Tom Poe stated he had many concerns over approval of the request because of blocking of fins exits and circulation around . th& tables and through the building . He added the fire Department had problems in than past with access and circulation and ' he would snot be comfortable with approving the site plan as presented : Dennis Krejci ''asked if .
