This letter is to formally appeal the Huntington Beach Planning Commission's decision to deny Use Permit Number 86-2, To respond to the Plunning Commission's 1 �ndinFs for den;.al in order: 1. Cit ., Ordinance #9730-84 - Sale of Alcoholic Beverages Prohibited -- Applies only to ser,%.'ce stations selling gasoline. Although this prohibition is desirable, in the !:ase of this dairy this prohib;Lien is koapp.licable. As its name clearly indicates, the dairy is in the business of selling milk and milk products and has nothing to do with gasoli.nd or car repair sales. j Additionally, as this is the only drive-through dairy in Huntington Beach, any additional Policy the city may adopt regarding i drive-through dairies would discriminate again,^,,'. These specifically include requirements that the use meet all of the toning code requirements regarding landscaping and the drive-through lone. 3. (Cunt d. ) The only objections to the Use Permit made at the Board of Zoning meeting or at the Planning Commission hearing were brought by people associated with Chalet Liquor. Indeed, 'Mr. M. Disokeyi spol•,e at the Planning Commission hearing and represented himself as the ownur of Chalet Liquor. The preservation of Chalet Licuor's business advantage is not proper grounds for the City of Huntington Bench to deny this Use Permit Application. GROUNDS FOR APPROVAL Some discussion concerning the safety of alcoholic beverage sales from this dairy occurred at the Planning Co:n►ni sioa meeting. ;I The alcoholic beverage commission will grant licenses to drive-through facilities only on the: specific conditions that purchasers must exit the vehicle before sales can be made. I The AEC Regulations and the threat of loss of the ABC license certainly will guarantee that the dairy will make no ;,ales to driver+ or their passengers within cars. The Planning Commission hearing further heard objections regarding the density of alcoholic beverage permits in this area. Sales of beer and wine from the dairy will be made solely for the convenience of milk purchasers. The peak hours of sales are immediately after school and immediately after work. The entire dairy closes at 8:00 p.m. Obviously, concerns about loitering teenage gangs and parking problems are inapplicable to this dairy as the late-night loitering occurs long after the dairy is closed for the evening. The Applicant, Linda Prith Kien, requests Huntington Beach City Council to grant this Permit. It will allow a valuable community resource -- a dairy with 15 years history in providing milk products to this community --- to continue to operate. The dairy site is nonconforming to the requirements 'of- the Zoning Code regarding landscaping and the drive-through lane . Staff recommerdation: Deny the appeal and uphold the Planning conmissinn 's action to deny Use Permit No . 06--2. k4ALYSIS: Oil February 51 1986, the Board of Zoning Adjustments reviewed and de+niea Use Permit No . 86-7 . a request by Linda Prith Kien , dairy operator , to add beer and wine sales to an existing drive-through dairy located at 15492 Edwards Street just norO of Edinger Avenue . Subsequently, the applicant appealed the decision to the Planning Commission. The Planning Commission upheld the Board of zoning Adjustment ' s action and denied the appea:i on March 4 , 1986 , based upon the ` concept of drive-through bee,:* and wine sales as being inconsistent with the City ' s intent to prohibit beer and wine sales in conjunction with drive-through or drive-up uses . Last December, the City adopted an ordinance prohibiting concurrent sale of alcoholic beverages on the same premises as gasoline sales . This was to limit the a•, ailability and ease of procuring alcoholic beverages which could easily be consumed in the vehicle and to eliminate the convenience or purchasing packaged consinnable alcoholic beverages whhn buying gasoline . This principle applies to the applicant ' s request to sell beer and wine in conjunction with adrive-through dairy. °t) Received at the Planning Commission Meeting were letters and a petition signed by 1.6 neighbors who oppose the project . Their main objections are (1 ) alcoholic beverages sold in conjunction with a drive-thru dairy would promote drinking and driving ; ( 2 ) there are five sources of liquor sales already existing in the vicinity; ( 3 ) there are many schools and churches within walking distance of the proposed facility; and (4 ) another liquor establishment in the vicinity would be detrimental to their neighborhood . The applicant ' s representative has submitted an appeal to .the Planning Commission 's denial with a response to each finding for denial (see attached) . She has indicated that the City 's proh.ibAtion of beer and wine sales in conjunction with gasoline sales 3s desireable but inapplicable, to this request . Although the orohibiti.on does not expressly incl 'ade drive--thru.'dairies , the =. 'intent .was to limit: the ability to purt;hase alcoholic beverages in conjunction with drive-thru facilities . ALTERNATIVE ACTION: Reverse the decision of the Planning commission and approve Use Permit No . 86-2 based on the following findings and conditions: FINDINGS FOR APPROVAL: 1 . The establishment, maintenance and operation of the e.: ive-thru dairy with beer and wine sales will not be detrimental to: a . The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building. 2 . The granting of the use permit will not adversely affect the General Plan of the City of Huntington Beach . 3. The proposal is consistent with the City "s General Plan of Land Vse . 4 . Improvements to the site will be mad-, which will bring it. in conformance with current zoning code requirements.
