The request is for an eleven-unit project which would result in two fourplexes and a triplex ;• eac h ch on a separate parcel .l . The P project was appealed ' PC to chi, Planning Commission by the Sunset Heights Neighborhood Committee based on their asse.7tion that the proposed eleven-unit project will, create potential traffic and parking impacts ; will not be compatible with the area ; and the fact that the proposed project is apartments rather than condominiums or single family dwellings . On June 17, M6, the Planning Commission overturned the Board of zoning Adjt,Stments ' approval and denied the project . At both the Board of Zoning Adjustments ' level and at the Planning Commission level , the Traffic Engineering section of the Department of public Works has maintained that the proposed eleven unit Apartment project will not create excessive traffic and safety impacts . The land to the East of the subject property , and immediately adjacent to the proposed site , is zoned R-2 (Medium Density Residential ) , and has multiple and single family dwellings constructed on it. Further East of the subject property, the land is also zoned R-2 Medium Density Residential , and consists of multiple-family dwelling unit . The land to the South and West of the subject property, not immediately adjacent to nor adjoining the proposed site, is zoned R-t-CZ (Low Den sity Residential-Coastal Zone ) , and consists of single-family dwellings . On July 10, 1985, the Board of Zoning Adjustr_ents approved Tentative Parcel yap Ho . e5-239 which consolidated five non-conforming parcels into three legal, parc`ls per the R1 zoning standards . As part of the approval of ' the tentat?ve parcel map, a twenty foot wide private driveway easement was established across parcels 3 and 2 in order to pravide street access for parcel 1 . :'here are three lots on the site on which two of the lots there will be four unit structures and on the third lot there will be a tri-plex . The appeal to the BZA ' s approval is based on the assertion that the, project is high density a "is not good For the area" (see letter, dated May 131 1986 ) . The appeal lists five major reason- why the residents in the vicinitl, of thus proposed project oppose the construction of the 11 unit apartment ps o jest . Thc: appeal letter identifies (1) future traffic incr6:msa ; ( 2 ) the private driveway across, parcels 2 t.ad 3; ( 3 ) the cloae proximity to R11 low density residential areas (custom homes on Marina View Place and Huntington Harbor homes across warner Avenue) ; ( 4 ) the potential of tenants parking off site; and ( 5 ) ''fault.-line" hazards as the five major reasons to deny Use Permit No . 86-17 . In response to .he concerns of the appeal letter, staff maintains that the project is consistent with the General Plan and with Division 9 development standards . The subject property was ennexed into the City in 1986 and has been zoned R2 since 1965 . The subject property has been vacant the entire time . The site is located il, the Alquist-Priolo Earthquake Hazard zone and the applicant is aware that the possible problems associated with fau',ts will need to be addressed and mitigated prior to construction . In the last paragraph of thc appeal letter there is a request for the Planning Commission to initiate a decrease on the permitted density at the site and rezone the site to R1 ( Low Density Residential ) . Staff maintains that the R2 zoning cla,sif'ication its consistent with the City' s General Plan and the R2 zoning is appropriate for the site . In summary, staff feels that a comparison of development .standards and density will assist ;n evaluating this situation. Since there is an approved parcel map on the site which created three legal . building sites , each parcel is subject to R2 zoning standards which is more restrictive than Apartment Standards . Marina View, originally an undedicated street , is much narrower than a normal size 2treet at the Orion Street intersection. This resulted in the City recently restricting parking (none) in order to lea.,,e as much room as possible to negotiate the turn . The City also put double lines to try to control the tendency of drivers to drift over beyond the middle of the road. The system has not worked very well b`cause of the 1 unusual radius and the narrowness of ►.he street . � The apartment complex has a proposed alley that will entrance and exit at precisely the worst point in the intersection. B) An alley, in itself, is a da.. ereus situation that causes problems in any community. Recent years have brought a tremendous traffic increase to the intersection 1 o- "curve" of Marina View and Orion . Many cars traveling at relatively fast speeds up Warner , make "race course" type right turn on Los Patos and then a similar "race course" type fast ? eft on Marina View . Even without those shenanigans , the intersection at Orion and Marina View is for some reason conclusive to encouraging drivers to drift over the double line that the city recently (within the last two or three ,years ) painted there . Normal , non-speeding drivers drift over the line because of the configuration of that intersection and at the present tine , there is NEVER a car parked anywhere near the intersection . If there is an entrance or egress put within 100 feet of that curve , it will be probably the most dangerous intersection in Huntington Beach within •18 hours of the first tenants arrival . For your further consideration, this is a single family neighbor- hood . Admittedly, there are some multi-unit buildings nearby but if you make an on-site inspection , I think you ' ll agree this, is . not a neighborhood that would be well served by ;r. 11=unzt apart- sent . I ' am not sure but I believe the lot was changed from a single lot to two lots within the last few years . In the 13 years I ' ve lived in the neighborhood, there have been at least 3 multi -unit projects turned down.
