A recent revision to the Ordinance Cody: regarding child care centers
requires the installation of a 6 foot high masonry wall around the
outdoor play area . This requirement was to protect adjacent
residential properties from possible noise ispacts .
The applicant is seekAng a conditional exception to this requirement
and proposes to use a 6 foot high wrought iron fence around the
outdoor play area .
The Newland House , which is inrr•ediately north of the proposed child
care center, is surrounded by a decorative wrought .''ran fence . 'The

The Newland Center has a total of 950 parking ;paceu . At the tine
the parking calculations were made;, this parcel of land wa;j

parking spaces . The day care center_ will only muire a total .i45 parking spaces. Therefore, no parkinv impacs anticipated.
The parking lot: north of the building pad will be the parking area
primarily used by the patrons of the day care center. La Petite
,academy also offer a van service which pici.s up the children from
nearby elementary schools , thus further reducing the parking demand .
On-Sites Circulation
The applicant has revised the site plan to show the entrance to the
parcel . his

parents to drop off and pick up their children from the large
parking area on the north side of the building without interfering
I with the circulation through the Newland Center .
Outdoor Play Area
{ As shown on the site plan , they applicant ' ;s providing 12 , 602 square
fleet of outdoor play area . The applicant has Indicated that the
maximum, enrollment at the school will be 180 children. However,
since a variety of programs are offered ( i . e . after school care,
morning programs, Tuesday/Thursday programs , etc. ) the number of
students expected to be in attendance at: any one trine will be
approximately 130 to 140 children. . The outdoor play area provident
will accommodate 168 children a;. one time .

STATEMENT OF ISSUE:
On January 21 , 1087 , the rlanning Comnissioi; conditionally approved
Conditional Use Permit No. 86-62 and Conditional Exception
(Variance ) No. 86-107 for a day care center wi .hin a comrercial
center located at 19860 teach Boulevard (The Newland Center ) . Staff
recommended in the staff report dated January 21 , 1987, Ocat the
owner of the Newland Center enter into a irrevocable reciproctil
access agreement with the property to the north of the tiewlan6
Center in order to create a single% access point for both rropertie9
at the northern boundary of the Newland Center and to create
internal circulation between the two properties.
The condition of reciprocal access was deleted by the Planning
Commission . This appeal his been filed on behalf of the property
r owner to the northr Splegal Enterprice5t requesting the. City Council
to include t`.e condition of reciprocal access as part of the
approval of Conditional Use Permit No. 86-62 and Cnnditional
Exception (Variance ) No. 86-167 .

ANALYSIS :
Conditional Use Permit No , 86-62 is a request to permit a day care
center for 180 children within the Newland Center . The building
I will be located on a vacant pars uouth of the Newland douse and east
of the Landmark Building . This building pad is the last remaining
vacant pad within ,';he Newland Center.
As a ;;onditlon of approval for this project , staff recommends that
the project be condiiened that the owner of the Newland Center
provide a reciprocal acceaa agreement to the property owner north of i
the Newland Center ( a bowling alley) in order to create a single �
acceen point for both properties at the northern boy-dart' of the
Newland Center and to facilitate circulation betweer %he two sites.
At c :ee present time , there are two curb cuts along Peach Boulevard
providing access to the bowling alley and the Newla.nd Center . There
two curb cuts are separated by a strip of concrete approximately two
feet wide. In additions there it a left hand twin pocket at this
location can Beach Boulevard which allows left hand turns to be made
into either of the two entrances. A hazardous traffic situation
exists as vehicles mar ng right hand turns onto Beach boulevaLJ must
negotiate not only the high traffic volumes traveling along Beac:�
Boulevard, but also vehicles making left hand turns, acroan Brach
` Bouleverd into either of the two entrances ,
A single point of access for these two properties of. the NevIand
Center would improve traffic circulation and safety .
Reducing the number of curb cuts along Beach ,Boulevard trill
facilitate the goala of the Beach Boulevard Super Street Project .
The concept, of a single access point for these two properties -along
Beach Boulevard is recommended by the Public storks I3epartsaent,
Redevelopment Staff and Department of Development Services.

In addition to creating a single access point along Beach Boulevard
for these two properties , Condition of Approval No. G, as
recomaiended by staff, would also create internal circulation between
these two parcels.
The property owner to the north, Spiegel Enterprises, has approached
the Denartment of Development .Services regarding the possibia;t~y , of
recycling the bowling alley site . It is anticipated that this site
would recycle as a commercial center, compatible in terms of use and
architecture with the Newland Cuter .
Reciprocal access between there two siteF when the bowling alley
recycles is highly desirable . Reciprocal access would allow patrons
to circulate between both centers without having to exit onto Beach .
boulevard and then enter into the next commercial center .
La Petite Acp;demy Is proposed to be located on the last vacant
parcel within Newland Center, it is now appropriate to place thin
condition can the project . The owner of Newland center authorized La
Petite Academy to apply for the conditional use permit and in the
fresponsible party for providing the easement on the Newland (7onfi-�ur
should the condition be retained by the City Council by upho?;cling
the appeal .

has been recommended by the Public works Department along with
support by the Redevelopment staff in order to facilitate the goals

The environmental impacts of the project were covered in EIR '79-3.
The site was analyzed as a 21 ,000 square foot office building with
greater traffic impacts than the day care center .

Joe Remsa , applicant , spoke in support of the project . lie stated j
'S that he had reel concern with the condition regarding the
irrevocable access agreement . He feels the condition is vague and
should be removed..
The Deputy City Attorney was asked for a legal opinion regarding
this condition since some of the Coarnissioners did not feel that the
applicant should be conditioned for an agreement involving the
owners of the property.
The Attorney stated that the condition requested an offer to enter
Into an irrevocable agreement only and could legally be imposes
under this entitlement .

Mark Spiegel , owner of the property to the north of the subject
site, vtated that he is willing and ready to enter into a reciprocal
agreement for access . He wants to recycle his property and would
like to develop plans for better ingreus arsd egress . He feels that
there will be an increase in traffic due to thin project and wants
the impending dangerous situation addressed.
There were no other persons present to speak for or against the
project and the public hearing was closed.
The repreiventa:ive of the Newland Center property owner was asked if
any discussions had occurred regarding, the reciprocal agreement.
Mr . John Souva, property owner repraseentative, stated that he had
Gust received a letter requesting the agreemant . He feels that
since he deleu- not know what the expansion plans are for the property
to they north that the condition regarding the agreement is unfair to
the applicant and the property owner. ' ,
Some of the Commissioners felt that the condition requiring anA,offe,c
