Following conciderable discusitf.on, as mot an was made by Erskluey seconded by Green, to instruct staff to Notify the Public Facilities Corporation that there is no approved capital inprovezent project for the Central Library which exceeds t1,100,000, t.hdt no such project is anticipated to be approved prior to next year' s budget (July 1, 1988) and that the City Council reaffirms its December 1, 1.986 request to the Public Facilities Corporation to release all excess funds to the city as reimbursement for rent previously paid; and to direct staff to schedule a Study Session on further expansion of the Library and funds in the future to do this . Staff has analyzed two alternative parking lot layouts, both of which would provlde a total of six (b) on-site parking spaces in lieu of the existing five (5) spaces. Alternative "A" maintains the existini alley access to the parking lot, and would Involve restriping the surface of the lot to'obtain an additional space. Alternative "B" would propose taking access from a new curb cut on Olive Avenue and restriping the lot to obtain six spaces. The zoning board denial was 5-0 and the planning cormni$sion. vote was 5-2 . Neither was a close vote 'because the main s consideration in each case were the followi.ngr The applicant anchor his representatives (One being an Qx- planning cormdissianer) were made aware upfront by the city on the number of parking spaces required to sell alcohol (12 spaces are required) . There is no doubt to this fact. ' Lt is , important that you know that Richard Dorn, Shari LiLy, and myself have over $700 , 000 invested in our homes . At the city council hearing the applicant and hisrepresent ati a tea'v s stated he would go out of business without alcohol .At the zoning board hearing the applicants brother stated liquor sales would only account for 101 of their total business . Their story has certainly changed since the zoning board hearing. When the building was approved in March 1905 , we were not notified . The reason for tris is ' -he law states that only ''abutting" property owners were required to be notified,. ':he abutting properties consisted of an empty lot, a vacant lot, a vacant Huntington tavern, an office buidling and and apartment building . Some of the owners of these properties don ' t even live in Csl.iwornia . The home owners ware never notified. We really can' t complain because by tha .strictest definition of the law we did not have to be notified, even though we are most affected . The point is we' ve had to live by the law and so should the applicant . Our neighborhood is a now growing single family residential 1 area . it does not need another liquor store sla=ed in illegally and unptoperly . if this flagrant variance 45 parking spaces instead of the: 'required .12 spaces) is granted it is the home owners on 17Th street and not the stores customers that have to live with the consequences . Mayor and City Council members* given the above, l as a home owner and resident have to rely solely on my elected officLals in protecting the home owners by upholdinq the lams on behalf of the homeowners and businesses In the neighborhood. Zeidan contends that the City changed the zoning on his property aster he obtained o.s permit to build a store with Intentions of selling iilcohol, thereby increasing his parking requirement and creating a hardship. Although the City did Initiate a zone change from 0 to C2 after the,applicant had obtained building permits and started construction, the previous. C3 coning only allowed alcohol sales if the use complied with CZ ataridards. The approved use p.'&mlt (Use Permit No. 95-14) had a condition whica clearly stated that a use permit would be required In order to sell liquor and that C2 standards would have to ' be complied with. Therefore, 12 parking spaces have always been required for alcohol sates, as was reinforced by the condition of approval for Use Permit No. 85-14. The appellant also contends that granting of his requests would not constitute a grant of special privilege, because other restaurants and liquor stores in the vicinity operate with t less parking than is required by Code. Many of the examples cited (see letter or appeal to Planning Commission) are existing legal eon-conforming uses which, when expanded or recycled.,will be required to conform with current Codes. Several other businesses cited arc iln tLe Downtown Redevelopment Area (China Wok, Morzotti's, The Shed, Pete's Mexican Food) and have agreed to participate In a parking assessment district when formed by the Redevelopment Agency, to provide the required parking. The approved use permik (Use Permit Na. 85-14 ) had a condition wh16i cleanly stated that a use permit would be required in order to sell liquor and that C2 standards would have to be complied with. Therefore, 12 parking spaces have always been required for alcohol sales , as was reinEorced by the condition of approval for Use Permit No. 85--14 . The appellant also contends that granting of his regvests would not constitute a grant of special privilege, bocause other restaurants and liquor sores in the vicinity operate with less parking than is required by Code. Many of the examples cited (see letter of appeal) are existing legal non--conforming uses which, when expanded or recycled , will be required to conform with current Codes . Several other businesses cited are in the D-owntown Redevelopment Area (China Wok, Mozzotti 's, The Shed, Pete' s Mexican Food) and have agreed to ,participate ir. a parking assessmeAt district when formed by the Redevelopment Agency, to provide the required parking . At the time, the affidavit was completed, the subject property was zoned C3 and required minimum entitlement by Administrative Review or as required by Cl, C2, or C4 require— ments for those permitted uses.
