The Commission requested the applicant to submit revised plans indicating access to the subterranean parking from 8th Street instead of the alley and to provide additional information regarding the feasibility of incorporating an adjacent 50 foot wide lot , which will become isolated and substandard in size if the proposed motel is approved, within the motel development . At the Planning Commission meeting of July 16, 1985 , the Commission reviewed the revised plan and agreed that it was a more efficient site .layout of circulation and structure design. The su;';terranean driveway ramp was widened to 23 feet and a continuous loop system was provided in the subterranean parking area for better circulation . The landscaping area alone Pacific Coast Highway and Sth Street will be intensified to screen the ramp which partially encroaches into the front setback . However , the Commission still had concerns about the abutting 50 foot wide parcel . The applicant indicated that a verbal offer to purchase the parcel was made and rejected. The Commission continued Conditional Use Permit No. 85-26 and Coastal Development Permit No . 85-11 to the August 5, 1985 meetinri, directed staff to obtain additional information pertaining to the oil operation on the 50 foot wide lot , and directed the applicant to hake a bonafide written offer to acquire the lot and provide evidence of rejection of the offer . Conditional Use Permit No. 85-26 and Coastal. Development Permit No . 85-11 were approved by the Planning Commission on August 5 , 1985 r based on the findings and modified conditions of approval outlined i under the Analysis section of this report . Based on current oil production figures and size of the parcel , a preliminary appraisal of the subject propert by our Real Property Manager indicated that its value ranged f;or., L25 , 000 to $25n, 000 , which included removal of two wells . The applicant had made an offer of t200# 000 t:o purchase the property which was rejected by the property �%',-'ner mainly because the offer was based on the owner financing 801 of the loan. Approval of Conditional. Use Permit No . 85-26 by the Planning Commission was appealed by Robert Orr , Legal Representative for Larry Vasterling who is the owner of the adjacent 50 foot wide parcel . The appe-al is based on the contention that the 52 _uni.t motel development will have a detrimental impact upon the value of Mr. . Vasterling 's property, contrary to Finding No. 1 of the staff report which reads, "The development will not have a detrimental i FCA - 9/3/95 �6 (3129a ) i I 7 Alit r -aa impact upon the value . of the property in the vicinity. " The apppellant has requested that the appeal be heard on September 16 , *' 1985 since he will be out of the office from August 29 through September B . ENVIRONMENTAL STATUS: The proposed motel project is exempt from, environmental review ' because it is in conformance with the Downtown Specific Plan Environmental Impact Report pursuant to Section 15181 of the California Environmental Quality Act . The location , site Layout , and design of the proposed three-story motel structure dogs not properly adapt to streets , driveways , and alleys , and uses in a harmonious manner because of the intenvity of use . 3 . Wentworth : +, Please be advised that this office represents Larry R. Vasterling, the owner of the vacant lot on the northwest boundary of the above referenced project site . On August 5 , 1905, the Planning Commission granted the above refer- enced Conditional Use: Permit over the objections of Mr. Vasterling, Accordingly, notice is hereby ci.ven that M;'', Vasterling intends to appeal the decision of the Planning Carunissi.on to the full City Council . The general ground for the appeal is that the propos-,d development of a 52 unit motel upon the project site wV,A have a detrimental impact upon the value of Mr. VastM ling' s property. Specifically, Mr . Vasterling objects to Ttem No. (1) of the Planning Commission Findings in this regard, which stated that the development would not have a detri- mental impact upon the value of the property ;n the vicinity of the project site. A local ordinance requires a minimum par._e2 size for develop- ment with a 100 ' frontage on Pacific Coast Highway. Mr. Vasterling' s property only has a 50 ' frontage on Pacific Coast Highway. A Taco Bell restaurant is situated on the northwest boundary of Mr. Vasterling' s property. Thus, the proposed development would leave Mr. ► asterling with ;an ioo- lated 50 ' wide parcel which he could not develop on 'his owns His only alternative Would be to sell the property , to ono of his existing -neighbors . Unless Mr. Vasterling is q'ranted some relief from the provisions of the ordinance requiring I t { t Ms . The project site borders one side of Appell.ant' s lot , and a Taco Bell restaurant borders the other sine of Appellant' s 6 lot. Both the project sit , and Appellant' s lot are located 7 within the area designated ae District 1 in the Specific Plan for 8 the City of Huntington Beach . 9 Section 4 . 3 . 02 of the Specific P3an provides that the 10 minimum parcel s•:ce for development in District 1. is 100 feet OF 11 frontage on Pacific Coast Vi.gh.way. By permitting the propot4d 12 development , the City would in affect be forcing the Appellant: 13 to either sell his lot to once cif the ;adjoining owners or resort i 14 to leaving it vacant and undeveloped for an indefinite period 15 of time. Because Appellant' s .lot has less than 100 feet Of lie frontage on Pacific Coast Highway, Appellant mould effectively 17 be prevented from dcvelcping the lot on his own . Farther of these 1{1 results would severely affect the r,:arketabil.ity and the value of 19 Appellant ' s property. 20 For the foregoing reasons, the proposed development would . 21 have a detrimental impact on the value, of Appellant' s property . 22 Section 4 . 1.. 02 of the Specific Plan specifies that a special + a` 23" ' permit , such as was granted by the Planning Commission herein , i 2$ may not be granted unless , among other things,. the ,proposed , J 25 development will not be detrimental or injurious to the value, 26- of the property in the neirlIhborhCod. The site plan dated July 11 , 1985 , and floor plans and elevations dated June 61 1985 shall he revised and submitted for review and approval by the Planning Director reflecting the following modification;: a . The drive approaches on 8th Street: shall conform to Public Works standards . b. The driveway ramp to the subject parking shall net Exceed a 15% slope. C. Additional architectural trea'-zmenL along the north elevation , such as inset windows or projecting horizontal bands , shall be provided, d.
