' ., 2 1 86 ( RCA 8/ -3_ 4194d) The proposal presented in this application would allow tip to 1 , 450 people to attend a church service . The applicant 's plan reflects a ' 5, 615 square foot addition to the existing footprint ( 2 , 240 square feet on the first floor , 3 , 375 square feet on the second floor) and an increase of 504 seats within the sanctuary . In order to accommodate the increase in vehicular traffic, the applicant has submitted a conditional exception request to operate a parking valet service , because spaces are more than 250 feet away. Pursuant to Article 979, the church facility would be required to provide 483 parking spaces ( 1 space for each 3 seats, ,naximum searing capacity is 1 ,450 ) . As discussed in the attached narrative, the parking valet would operate between the shopping center and office park to the east and possibly Huntington Beach fiigh School to the south, if needed. Staff analyzed the parking demand for the church in conjunction with the other uses in the center which Would be open on Sunday to determine toe number of available spaces ( see attachment: number 3) . As part of the Parkiag Management Plan, the staff can concur with the calculations presented in the letter of appeal (Condition Ito . 4 ) . This would allow the Church of Religious Science to use 136 spaces on site toward meeting the 483 parking space requirement . Staff L alieves that these spaces can be satisfied offsite (Seac?iff Business Park ) and through the overlapping of uses within the shopping center . In addition , the staff can support the applicant ' s request (cited in the letter of appeal ) to utiliie 347 ( of the required 433 space parking requirement ) spaces off site . With respect to Condition No. 2, staff believes that the term of the conditional use permit should be For a two year period . This will provide a safeguard against any unfcceseable problems which may arise . It will also provide an opportunity for tenants of- Lhe shopping center to raise their concerns ( if necessary) at a public fcrum within a two year time frame. Both the Planning Commission and staff see this as a good compromise position . The two year time frame was a compromise solution which was arrived at after the initial staff recommendation to the Planning Commission cf denial . The second appeal is from Lucky ' s Market: which is a r►.ajor tenant in the center . They feel as though the proposed expansion would have a detrimental impact upon their market and customers . The concerns they rained in their appeal were not raised by them at the time of Planning Commission review and action on this application. Staff 's recommendation of approval for a period of two years will allow staff and the tenants an opportunity to ascertain how compatible the expanded use is with the commercial. canter . If there is a problem with , L-he expanded use , it will give the Planning Commission an Opportunity to review i�: at a public hearing. The Planning Commission at its December 17 , 1985 meeting conditioned that the term of the zoning entitlement be for a maximum of two years . The letter from Mr . Bare states that Lucky Stores and all concerned parties have reached an agreement on an acceptable parking plan . The letter also states that the church is withdrawing the challenge to condition no, 4 on the parking agreement . Therefore, the only j remaining issue as of this moment is the determination on the four ye�ir term versus the two year term as origi ally established by the Planning Commission . Use Permit No. 85-57 and Conditional Exception No . 85-85 at the request of the applicant , with the concurrence of the appellant ( Lucky Corporation) . The Church of Religious Science ( applicant ) is seeking a 5,615 square , foat expansion to an existing church facility '504 seats) with joint use of parking located further than. 250 feet from the building it sorves, The Church of Religious Science has recently met with Lucky Corporation in an effort to resolve their differences which stem from the expansion request . As of the writing of this report , Lucky Corporation has indicated to staff that they will be withdrawing their appeal , pending the execution, of a parking management program vr%rbally agreed upon by the respective parties . City staff will be meeting with Lucky Corporation and the Church of Religious Science prior to the scheduled City Council meeting on February 18, 1986 to review the parking management plan developed by the parties; to determine its adequacy. Even though this tentative agreement has been reached between the applicant and Lucky Corporation, the Church of Religious Science has indicated that their appeal of the conditions of approval is still in effect an discussed in the January 21 , 1986 report (attached) . RECOMMENDATION: The planning Commission and staff reconnend that the City Council uphold the Planning Commission: approval of Conditional Use Permit no. 85-57 with conditions outlined in the attached report. Although the Church believes that the Staff' s compromise resolu- tion , as set forth above, would place a hardship on the Church and in addition , could create a legal problem for both the Church and its Landlord ( in that: the Church ' s contractia1 commitment with its LandlorJ extends for a period in excess of. those 4 years ) , the Church will , for purposes of expediency and to allow the Church to get on with its necessary expansion program so that it may safe- ly and comfortably accommodate its congregants, agree (although reluctantly) to the Staffs offer of compromise --that being, to have the Church ' s use reviewed after a 2-year period to bJ:.; able to continue for another 2-year period . It is the Church ' s hope and intention that this ?-year review and overall 4-year term bA merely a temporary solution . DISCUSSION: In February 1983 the Planning Commission approved the establishment of a church facility within Seacliff Shopping Center ('Conditional Use Permit No. 83-2 ) The church facility, including a book store is approximately 15 ,000 square feet with a congregation of approxima!,ely 31000 people . The church is primarily utilised on Sundays with three morning services . a RCA 1/21/86 . �3� i4041d �` r: i .,I The Proposal presented in this application would allow up to 11450 people to attend b church service . Tite applicant 's plan reflects a -5,615 square Foot addition to the ekisting footprint ( 2,240 square < feet on the first floor, 3 , 375 square feet on the second floor ) and ar increase of 504 seats within the sanctuary, fn o-rder to accommodate the increase in vehicular traffic, the applicant has submitted a conditional exception request to operate a parking valet service . Pursuant to Article 979 , she church facility would be required to provide 483 parking spaces ( 1 space for each 3 cents, maximum seating capacity is 1 ,450 ) . As discussed in the attached narrative, the parking varlet would operate between the shopping_ center and office perk to the east and possibly Huntington Beach High School to the south , if needed . Staff analyzed the parking demand for the church in conjunction with the other uses in the center which would be open on Sunday to determine the number of available spaces (see attachment number 3 ) . As part of the Parking Management Plan , the staff can concur with the calculations presented in the letter of appeal ( Condition No. 4 ) . This would allow the Church of Religious Science to use 1.36 spaces on site toward meeting the 463 perking space requirement . Staff believes that these spaces can be satisfied offsite (Seacliff Business Park ) and through the overlapping of uses within the shopping center . In addition , the staff car, support the applicant 's request ( cited in the letter of appeal ) to ,utilize ?•�I (of the required 483 space parking requirement ) :paces aze site . With respect to Condition No . 20 Staff believer that the. term of the i conditional use permit should he for a two year period. T;hls will provide a safeguard against any unforeseable problems which may arise . it will also provide an opportunity for tenants of the shopping center to raise their concerns ( if necessary ) at"a public forum within a two ,year time frame . Obviously , It is not reasonable to imply the termination of a permit in less than t two years from the time .a structure could actually be occupied. There is no exception to the reasonableness of reviewing the acceptability of the occupancy in two years and a review of the conditions and Workability of the parking agreements. IL is also accepted that, upon recommendation of the Planning Department, fees might be necessary for the review process and a public hear!rg required. tt is, of course, always possible that the C.U.P. can be cancelled ; however, our objection is to the automatic cancell?.ng implied by the conditions. I'he second issue addresses the basic planning cc»>cepL of the joint use of Parking facilities. Although it is arbitrarily determined ghat t}te actual factor or ,joint use is between a church and retail users, it is obvious that some significant factor gill apply on Sunday morning for the hours from 9 to 12:30. The apf.eal has requested at least the minimum allocation of a 20% factor; however, with neveral banks, the Chamber of Cotnmerc+e, and other office users, the factor should be �mch higher. even in a conservative analysis.
