Location: 411 Olive Avenue, 92648 To Whom It May Concern: On Monday, April 21, 2008 the City Council of the City of Huntington Beach held a Public Hearing to consider your application and took action to conditionally approve Conditional Use Permit No. 08-005. Attached to this letter are the Findings and Conditions of Approval for this application, and copies of City Council Resolution No. 2008-24 and Redevelopment Agency Resolution No. 371. Sister Cities: Anjo, Japan a Waitakere, New Zealand (Telephone:714-536-5227) Agency Resolution No. 371 Since there are no other reasonable means available to the City to finance the Improvements,the Agency proposes to pay the costs associated with the Improvements; and The Agency's agreement to pay the costs associated with the Improvements constitutes an indebtedness of the Agency for the purpose of carrying out the redevelopment for the Project Area;and The Improvements are of benefit to the Project Area and the immediate neighborhood in which the New Transformers are located; and All other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE REDEVELOPMENT AGENCY OF THE CITY OF HUNTINGTON BEACH AS FOLLOWS: 1. The Agency hereby finds and determines that the foregoing recitals are true and correct. 2. Based on substantial evidence in the record, the Agency hereby finds and determines that: a. The Improvements are of benefit to the Project Area and the immediate neighborhood in which the New Transformers are located and is consistent with the goats of the Five-Year Implementation Plan for the Project Area, including, without limitation, the goals of improving public facilities and providing electric infrastructure to both developed and undeveloped properties within the Project Area. This determination is based, in part, on the fact that the Improvements are in the best interests of the City and the health, safety, and welfare of its taxpayers, employees, business tenants, property owners and residents. The Improvements will benefit all employees, business tenants and property owners of the Project Area, as well as the residents, employees, business tenants and property owners of the City; b. No other reasonable means of financing the Improvements are available to the City. This determination is based, in part, on the fact that the City itself is not in a position to finance the Improvements. Without the assistance of the Agency, the Improvements would not be feasible; and C. The payment of funds by the Agency for the costs related to the Improvements will assist in the elimination of one or more blighting conditions within the Project Area and is consistent with the Agency's Five-Year Implementation Plan for the Project Area. This determination 2 Agency Resolution No. 371 is based, in part,on the information contained in paragraph a.,above. 3. The Agency hereby agrees to pay the costs of the Improvements as agreed upon and directed by the City Administrator (or his/her designee). The obligations of the Agency pursuant to this Resolution shall constitute an indebtedness of the Agency for the purpose of carrying out the Redevelopment Plan for the Project Area. 4. The City Administrator (or his/her designee) is authorized to take any action and execute any and all documents and agreements necessary to implement this Resolution. 5. This Resolution shall take effect immediately upon its adoption. Recommended Action: Motion to: 1. Agency Alternative Action(s): 1. Do not approve the transfer of Redevelopment Agency funds in the amount of $20,384.39. 2. Do not adopt Resolution # 371 of the Redevelopment Agency of Huntington Beach Analysis: The proposed SCE transformers are needed to meet electrical service capacity demands in the second block of Downtown. Each transformer is housed in a metal cabinet measuring -2- 4/8/2008 10:24 AM REQUEST FOR COUNCIL/REDEVELOPMENT AGENCY ACTION MEETING DATE: 4/21/2008 DEPARTMENT ID NUMBER: PL 08-03 three ft.-two in. by three ft.-two in. by three ft.-two in. tall (see photograph — Attachment No. 4). The cabinets would be spaced four feet apart and would displace one off-street parking space at the Huntington Beach International Surfing Museum (southeast corner of Olive Avenue and 5t" Street). The cabinet located nearest to the Olive Avenue street frontage would be setback 12 ft. from the property line, behind an existing four ft. wide landscape planter. Additional landscaping is proposed in this planter and in a new three ft. wide planter proposed along the east side of the cabinets. The additional landscaping is provided for screening purposes, as required by the Huntington Beach Zoning & Subdivision Ordinance (HBZSO). The Museum property, which is owned by the Redevelopment Agency, would maintain four on-site parking spaces. Staff has estimated the costs of the public improvements and landscaping to properly screen the proposed equipment to be $3,500, including contingency expenses and prevailing wage requirement. The Economic Development Department is proposing to replace the lost parking space by participating in the Downtown Parking Master Plan In-Lieu Parking Fee Program using Redevelopment Agency Funds, pursuant to the provisions of HBZSO Section 231.10 and Downtown Specific Plan Section 4.2.13(c). The Economic Development Department intends to transfer Redevelopment Agency funds in the lump sum amount of $16,884.39 to the In- Lieu Parking Fee Program account. The $16,884.39 represents the in-lieu parking fee for a single parking space, as adopted by Council Resolution No. 6720 and adjusted based on the Consumer Price Index (CPI) for the year ending June 30, 2008. SCE has determined that there are no other viable locations for the proposed transformers, which would replace an existing undersized, pole-mounted transformer located in the Olive Avenue right-of-way. Furthermore, SCE has advised that failure to install the transformers may result in further service disruptions in the Downtown area. Approval of the conditional use permit is consistent with General Plan policies to ensure that adequate natural gas, telecommunication, and electrical systems are provided and to continue to work with service providers to maintain current levels of service and facilitate improved levels of service. Accordingly, staff recommends approval of the request, with the installation of additional landscape screening as proposed. Resolution No. 6522, adopted by the City Council in 1993, provides for fees deposited into the in-lieu parking fund to be used for creating additional parking opportunities (e.g., valet, re- striping) or construction of new parking facilities in the downtown area. To date, the City has approved payment of parking in-lieu fees for 262 parking spaces totaling $1,222,229. Payment of the in-lieu fee effectively replaces the lost parking space and will ensure that no detrimental parking related impacts will result from installation of the transformers. Strategic Plan Goal: Develop strategies for resolving critical infrastructure problems to preserve the physical foundation of the community and enable the community's value to grow. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 08-005: 1. Conditional Use Permit No. 08-005 to participate in the Downtown Parking Master Plan in lieu parking fee program and allow elimination of one off-street parking space located at the International Surfing Museum by paying an in-lieu fee of$16,884.39, will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. Payment of the in-lieu fee will provide for the effective replacement of the parking space to be eliminated and will ensure no detrimental impacts to parking availability in the Downtown. 2. The conditional use permit will be compatible with surrounding uses because elimination of the parking space will allow installation of two Southern California Edison transformer which are necessary to meet the electrical service requirements of the surrounding uses. In addition, the proposed transformers will be largely screened from view from Olive Avenue by the addition of landscaping in an existing planter on the north side of the transformers and a new landscape planter on the east side. 3. The conditional use permit will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) and the Downtown Specific Plan. Participation in the Downtown Parking Master Plan in lieu parking fee program, as proposed, is permitted pursuant to the provisions of HBZSO Section 23 1.10 and Downtown Specific Plan Section 4.2.13(c). In addition, the conditional use permit will comply with the HBZSO requirement for screening of mechanical equipment by providing additional landscaping on two sides of the proposed transformers. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Mixed Use on the subject property including the following goals, policies and objectives identified in the General Plan: A. Utilities Element Goal U 5: Maintain and expand service provision to City of Huntington Beach residences and business. Objective U 5.1: Ensure that adequate natural gas, telecommunication and electrical systems are provided. Policy U 5.1.9: Continue to work with service providers to maintain current levels of service and facilitate improved levels of service. The requested conditional use permit will provide for installation of infrastructure necessary to meet electrical service capacity demands in the second block of Downtown and avoid service disruptions. The project represents a joint effort of the City and a critical service provider (Southern California Edison) to facilitate improved service levels. B. Coastal Element Policy C 4.7.8: Require landscape and architectural buffers and screens around oil production facilities and other utilities visible from public rights-of-way. The project includes installation of new landscaping for purposes of screening the proposed transformer cabinets from the public right-of-way. CONDITIONS OF APPROVAL — CONDITIONAL USE PERMIT NO. 08-005: 1. The site plan received and dated April 17, 2008 shall be the conceptually approved. 2. Prior to installation of the transformers the following shall occur: a. Redevelopment Agency funds in the lump sum amount of$16,884.39 shall be transferred to the In-Lieu Parking Fee Program account. b. The easement agreement between SCE and the Redevelopment Agency, as approved by the City Attorney, shall be executed and recorded with the County of Orange. USE PERMIT NO. 08-005 SUGGESTED FINDINGS FOR PROJECTS EXEMPT FROM CEQA: The City Council finds that the project will not have any significant effect on the environment and is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section Class 5, Section 15305 of the California Environmental Quality Act which states that minor alterations in land use limitations which do not result in any changes to land use or density are exempt from further environmental review. SUGGESTED FINDINGS FOR APPROVAL. - CONDITIONAL. USE PERMIT NO. 08- 005: 1. Conditional Use Permit No. 08-005 to participate in the Downtown Parking Master Plan in lieu parking fee program and allow elimination of one off-street parking space located at the International Surfing Museum by paying an in-lieu fee of$16,884.39, will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood. Payment of the in-lieu fee will provide for the effective replacement of the parking space to be eliminated and will ensure no detrimental impacts to parking availability in the Downtown. 2. The conditional use permit will be compatible with surrounding uses because elimination of the parking space will allow installation of two Southern California Edison transformer which are necessary to meet the electrical service requirements of the surrounding uses. In addition, the proposed transformers will be largely screened from view from Olive Avenue by the addition of landscaping in an existing planter on the north side of the transformers and a new landscape planter on the east side. 3. The conditional use permit will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) and the Downtown Specific Plan. Participation in the Downtown Parking Master Plan in lieu parking fee program, as proposed, is permitted pursuant to the provisions of HBZSO Section 231.10 and Downtown Specific Plan Section 4.2.13(c). In addition, the conditional use permit will comply with the HBZSO requirement for screening of mechanical equipment by providing additional landscaping on two sides of the proposed transformers. 4. The granting of the conditional use permit will not adversely affect the General Plan. It is consistent with the Land Use Element designation of Mixed Use on the subject property including the following goals, policies and objectives identified in the General Plan: A. Utilities Element Goal U 5: Maintain and expand service provision to City of Huntington Beach residences and business. Objective U 5.1: Ensure that adequate natural gas, telecommunication and electrical systems are provided. Policy U 5.1.1: Continue to work with service providers to maintain current levels of service and facilitate improved levels of service. The requested conditional use permit will provide for installation of infrastructure necessary to meet electrical service capacity demands in the second block of Downtown and avoid service disruptions. The project represents a joint effort of the City and a critical service provider(Southern California Edison) to facilitate improved service levels. B. Coastal Element Policy C 4.7.8: Require landscape and architectural buffers and screens around oil production facilities and other utilities visible from public rights- of-way. The project includes installation of new landscaping for purposes of screening the proposed transformer cabinets from the public right-of-way. After discussing the various scenarios, it was determined that the proposed site location of the transformers would remain in the parking space located closest to the museum entrance; however the transformers will be repositioned to minimize the impact on footage space in the parking lot (please see attached amended site plan). Furthermore, it was decided between city staff and the tenant that additional screening should be uniform and consistent throughout current landscaping; increasing previously estimated public improvements from $3,500 to $5,300 at prevailing wages. Public improvements include the install 15-gallon sized Dietes as the screen scrub, removal of existing Agapanthus, add a new irrigation line, adjust current irrigation system and provide a layer of bark mulch over planting areas. This total requested amount with this action increases from $20,385 to $22,185, and will be appropriated from the Unappropriated and Undesignated Merged Capital Projects Area Fund Balance of the Redevelopment Agency (amended Fiscal Impact Statement attached).
