Re. Letter of Appeal regarding revocation of Massage. Technician permit
Dear Ms. Flynn:
Im writing you to request an appeal to the Chief of Polices decision to revoke my
Massage Technician permit. I was cited and paid a fine for extending the hours of
allowed operation at two locations, both in 2007. One violation was for extending beyond
the permit hours of 9:00 PM by 11 minutes, the other by extending the hours of operation
permitted, of 9:00 PM by 20 minutes. These infractions cost me a total of $750.00. All
for extending beyond permit by a combined total of 31 minutes.
Rules are rules but isn't a punishment of $750.00 enough, now my ability to earn a living
is being taken away. Please give me another chance.
As stated in the revocation letter, I am accused of engaging in a lewd act in exchange for
money with an undercover officer. I deny this allegation. I have not been arrested or
charged and this allegation is false. I operated 11 minutes after closing time only on
November 23, 2007 as mentioned above. I provide a professional massage at a
professional establishment. I have many women among my customers and we provide a
quality service to the community.
It is also mentioned in the revocation letter that on November 24, 2008 I was observed
operating beyond the 9:00 PM time period. Of course this is not true either, as we have
not reached the date of November 28, 2008 yet on the calendar. I can only presume this is
a typographical error and refers to the November 23, 2007 alleged infraction.
The revocation letter is written as if four violations occurred when it was two and I have
paid a large fine for those.

The Huntington Beach Police Department has reviewed your application to renew your
Massage Technician Permit at Revitalization and Facial Massage, which was submitted
to the City of Huntington Beach on May 22, 2008. Due to three documented incidents
where you were observed operating in violation of local municipal codes and state laws,
we are revoking your Message Technician permits for Revitalization and Facial
Massage, and the Body Centre Day Spa.
§ 5.24.250(b) Huntington Beach Municipal Code (HBMC) states, '.'The Chief of Police, or
his designee, may suspend or revoke a permit if a permittee has: Violated any provision
of this chapter or of any statute relating to his or her permitted activity'.
On February 02, 2007, while working at Elite Spa, you were observed providing
massages after 9:00 PM, a violation of 5.24. 1 70(b) HBMC. You were issued a $250-00
Civil Citation for this violation. This incident was documented under case number 2007-
002139,
On November 23, 2007, you agreed.to engage in--alewdact in exchange for money -with
an undercover police officer. This Is aViolation of 647(b) PC and 5.24.230(a) HBMC.
This case, case number 2007-020878, has been forwarded to the Huntington Beach City,
Attorney's Office for prosecution.
On November 24, 2008, officers conducted an inspection of Revitalization and Facial
Massage after 9:00 PM. During that inspection, the officers observed you providing a
massage to a customer in violation of 5.24. 1 70(b) HBMC. You were issued a $500,00
Civil Citation for this violation. This incident was documented under case number
2007-020883.
If you wish, you may file an appeal with the City Clerk within twenty (20) days of the
mailing of this letter. If you fail to file an appeal within the prescribed timeframe, you
forfeit any rights to appeal my decision.
You are reminded that if you conduct any massage activities, as outlined in Chapter 5.24
HBMC, without a valid permit, you miay be subject to criminal prosecution.

In February 2007, an undercover police. officer entered Elite Spa. and received a
massage from you that concluded at approximately 9:20 PM, 20 minutes after the
required closing time. During this massage you also failed to use the name listed on your
permit and you did not wear your city issued massage. technician identification card, in
violation of Huntington Beach Municipal Codes.
Enclosed is a $250.00 civil citation for the violations observed by the officer.
You are reminded that per §5.24:225 HBMC, the folowing municipal codes are
applicable to all people and businesses offering massage services.
Huntington Beach Municipal Code §5.24.170(e) states:
"Each massage technician shall wear a photo. identification card prepared and issued by .
the City while administering a massage. The identification card shall be worn on outer
clothing with the photo side facing out. 'The massage technician shah not use ,,ply name
other than specified on the photo identification card white on duty."
Huntington Beach Municipal Code C5.24.b) states:.
"Bath and massage operations. shall be carried or and the premises shall be open only
between the hours of 7 a.m. and �-4 c.m. A massage begun anytime before 9 p.m. must
nevertheless terminate at 9 p.m. No person. v)ether iicensed under this Chapter or not,
may provide massage in exchange for anything, of value after 9:00 p.m."
Any additional violations of Huntington Beach Municipal Codes may result in civil
citations andlor criminal charges, along with the possible suspension or revocation of
your massage technician permits.

On November 23, 2007 at 9:11 PM, officers from the Huntington Beach Police
Department conducted an inspection of Massage and Facial Revitalization per.
§ 5.24.170(q) HBMC. During the inspection the officers noted that the business was
open and you were providing massage services to a patron when they entered.
§ 5.24.170(b) HBMC states "Bath and massage operations shall be carried on and the
premises shall be open only between the hours of 7 a.m. and 9 p.m. A massage begun
any time before p.m. must nevertheless terminate at 9 p-m. No person, whether
licensed under this. Chapter or not, may provide massage in exchange for anything of
value after 9:00 p.m."
You were previously issued a $250.00 civil citation for a violation of 5.24.170(b) HBMC
on February 2, 2007.
Enclosed is a $500.00 Civil Citation for your second violation of the above -mentioned
section.
