I HB -418- Dept ID CD 16-009 Page 2 of 3 Meeting Date 7/18/2016 Location Along Hampton Lane and Shelburne Drive in Sandover and along future Bristol Lane in Brightwater (south of Los Patos Avenue and west of Bolsa Chica Street), 92649 General Plan RL-7 (Residential Low Density— Max 7 du/ac), undesignated Zonin RL-CZ (Residential Low Density— Coastal Zone Overlay), Brightwater Specific Plan (uncertified) No of Acres 3 17 acres No of Numbered Lots 7 No of Lettered Lots 9 B BACKGROUND On August 12, 2014, the Planning Commission approved Tentative Tract Map No 17662 to subdivide approximately 3 17 acres into seven numbered lots for purposes of developing single family residences and eight lettered lots for streets, landscaping, and utility/fire access as part of the Brightwater and Sandover Subdivisions by Signal Landmark The subdivider satisfied the park and recreation requirements by payment of Quimby Act Park Land In-Lieu Fees Additionally, the developer satisfied the affordable housing requirements by paying in-lieu fees for the four new Brightwater single family dwellings The affordable housing requirements for the three new Sandover single family dwellings were met with the original Sandover tract On March 7, 2016, the City Council took action and approved Final Tract Map No 17662 for a portion of the Brightwater and Sandover Subdivisions by Signal Landmark C ANALYSIS When TTM No 17662 was approved by the Planning Commission, it included the entire length of Bristol Lane as a private street and a lettered lot (Attachment No 4) At that time, Bristol Lane was owned by Signal Landmark, the owner/developer of this new tract While Final Tract Map (FTM) No 17662 was being processed through the City and County for final check and approval, Bristol Lane was still under the ownership of Signal Landmark The City Council ultimately approved FTM No 17662 on March 7, 2016 After City Council approval and prior to recordation, Signal Landmark procured a title search for FTM No 17662 The title search revealed that Bristol Lane was now owned by the Brightwater Maintenance Corporation (the "Association") and not Signal Landmark The lettered lot (Bristol Lane) was conveyed from Signal Landmark to the Association via a grant deed on January 15, 2016 Because Signal Landmark no longer owns Bristol Lane, which was shown on the original FTM No 17662 (and the Association is not signatory on said map), the subject map previously approved by City Council is now factually inaccurate Signal Landmark is now requesting that City Council's approval of the original Final Map be rescinded and the revised Final Map No 17662 (which excludes Bristol Lane) be approved The revised final map (Attachment No 3) has been examined and certified by the Departments of Public Works and Community Development and the City Engineer on July 5, 2016, as being in conformance with the conditions of approval of the tentative map, as filed with and approved by the Planning Commission on August 12, 2014 HB -419- Item 20. - 14 ATTACHMENT NO. 1 FINDINGS AND CONDITIONS OF APPROVAL TENTATIVE TRACT MAP NO. 17662/ CONDITIONAL USE PERMIT NO. 14-010 FINDING FOR CEQA: The Planning Commission finds that the project was analyzed in EIR No 551 approved by the County of Orange for Brightwater FINDINGS FOR APPROVAL -TENTATIVE TRACT MAP NO. 17662 : 1 Tentative Tract Map No 17662 to subdivide±3 17 acres of land into seven residential lots for purposes of developing seven single family residences and eight lettered lots for streets, landscaping, and utility/fire access is consistent with the General Plan Land Use Element designations of RL-7-sp (Residential Low Density— Max 7 du/ac—Specific Plan Overlay) and RL-7 on the subject property, and any applicable specific plan, or other applicable provisions of this Code 2 The site is physically suitable for the type and density of development The project site is surrounded by property that is developed with or approved for the construction of single family residences The proposed project is an extension of the surrounding development type and density and represents the last phase of the Brightwater and Sandover residential developments 3 The design of the subdivision or the proposed improvements will not cause serious health problems or substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat The project was anticipated and analyzed in the EIR for Brightwater that was approved by the County It is an infill development on property that has been previously graded and is surrounded by similar single family residential development that is either existing or approved for construction 4 The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision unless alternative easements, for access or for use, will be provided The project will provide all necessary easements to maintain needed access or use of the property FINDINGS FOR APPROVAL -CONDITIONAL USE PERMIT NO. 14-010: 1 Conditional Use Permit No 14-010 to permit a max 3 5 foot high retaining wall topped with a max 6 foot high block wall along the north (along Los Patos) and east (along fire lane) lot lines of lot 3 located at the terminus of Shelburne Drive in Sandover will not be detrimental to the general welfare of persons working or residing in the vicinity or detrimental to the value of the property and improvements in the neighborhood The retaining walls are a result of the existing grade differential between lot 3 and the surrounding improvements to the north, east, and west The proposed walls will match the design, colors, and materials of the existing Sandover walls A 20 foot perimeter landscape planter with sidewalk is ',WOA�20141CUP 14-010 TTM 17662(Bnghtwa+^•0--A—er) Attachment 1 1 Item 4. - 15 xB -60- provided along Los Patos and a condition is recommended to require a planter area in front of the wall on the east lot line next to the fire lane to soften the appearance of the walls 2 The conditional use permit will be compatible with surrounding uses because the walls are needed to address the existing grade differential between lot 3 and the existing improvements surrounding it As conditioned, landscaping will be provided in front of the walls to soften its appearance 3 The proposed max 3 5 foot high retaining wall topped with a max 6 foot high block wall along the north (along Los Patos) and east (along fire lane) lot lines of lot 3 will comply with the provisions of the base district and other applicable provisions in Titles 20-25 of the Huntington Beach Zoning and Subdivision Ordinance which allows block walls to exceed the maximum permitted height subject to approval of a conditional use permit 4 The granting of the conditional use permit will not adversely affect the General Plan It is consistent with the Land Use Element designation of RL-7-sp and RL-7 on the subject property In addition, it is consistent with the following goals and policies of the General Plan a Goal LU 4-Achieve and maintain high quality architecture, landscape, and public open spaces in the City b Objective LU 4 1 - Promote the development of residential, commercial, industrial, and public buildings and sites that convey a high quality visual image and character The proposed retaining wall and above ground wall will match the existing walls in the development in terms of design, colors, and materials As proposed and modified by conditions, landscape planters will be provided to soften the appearance of the wall to make it compatible with the area CONDITIONS OF APPROVAL—TENTATIVE TRACT MAP NO. 17662 : 1 The Tentative Tract Map No 17662 received and dated June 19, 2014 shall be the approved layout with the following modifications to the approval of Planning staff a Lot 1 in Sandover shall be modified on the final map to remove the angled lot line on the northeast corner, if feasible, to create a corner closer to 90 degrees b Lot E shall be re-labeled on the final map as Utility/Fire Access instead of Open Space 2 The final map for Tentative Tract Map No 17662 shall not be approved by the City Council until a General Plan Amendment No 13-003, Zoning Map Amendment No 13-003, and Local Coastal Program Amendment No 14-001 are approved and in effect b The California Coastal Commission has approved a consolidated coastal development permit for the development 3 Tentative Tract Map No 17662 shall become null and void unless exercised within two years of the date of final Coastal Development Permit and Local Coastal Program G\PC\NOA\2014\CUP 14-01 0 TTM 17662(Brightwater Sandover) Attachment 12 xs -61- Item 4. - 16 Amendment No 14-001 approval by the Coastal Commission or such extension of time as may be granted by the Director pursuant to a written request submitted to the Planning Division a minimum 30 days prior to the expiration date 4 Incorporation of sustainable or"green" budding practices into the design of the proposed structures and associated site improvements is highly encouraged Sustainable building practices may include (but are not limited to)those recommended by the U S Green Budding Council's Leadership in Energy and Environmental Design (LEED) Program certification (http //www usqbc orq/DisplayPage aspx?CategorylD=19) or Build It Green's Green Building Guidelines and Rating Systems (http //www builditgreen orq/index cfm?fuseaction=quidelines) 5 Prior to issuance of a grading permit and at least 14 days prior to any grading activity, the applicant/developer shall provide notice in writing to property owners of record and tenants of properties within a 500-foot radius of the project site as noticed for the public hearing The notice shall include a general description of planned grading activities and an estimated timeline for commencement and completion of work and a contact person name with phone number Prior to issuance of the grading permit, a copy of the notice and list of recipients shall be submitted to the Planning Department 6 During demolition, grading, site development, and/or construction, the following shall be adhered to a) Construction equipment shall be maintained in peak operating condition to reduce emissions b) Use low sulfur(0 5%) fuel by weight for construction equipment c) Truck idling shall be prohibited for periods longer than 10 minutes d) Attempt to phase and schedule activities to avoid high ozone days first stage smog alerts e) Discontinue operation during second stage smog alerts f) Ensure clearly visible signs are posted on the perimeter of the site identifying the name and phone number of a field supervisor to contact for information regarding the development and any construction/ grading activity CONDITIONS OF APPROVAL -CONDITIONAL USE PERMIT NO. 14-010: 1 The grading concept plan which shows the location of the proposed project walls received and dated June 19, 2014 shall be the conceptually approved design with the following modifications a The 6 ft tall wall on top of the 3 5 ft tall retaining wall on the east lot line of lot 3 next to the fire access lane shall meet the minimum 15 ft front setback b A planter shall be constructed in front of the max 3 5 foot high retaining wall topped with a max 6 foot high block wall along the east lot line of lot 3 (along fire lane) to soften the appearance of the wall to the approval of Planning staff The planter shall have the Item 4. -
