Financial Impact: Not applicable. Recommended Action: Approve Final Tract Map No. 17397 and accept the offer of easements pursuant to findings and requirements (Attachment No. 1). Alternative Action(s): The City Council may make the following alternative motions: 1. Deny Final Tract Map No. 17397 and reject the offer of easements. 2. BACKGROUND: On November 19, 2012, the City Council approved Tentative Tract Map No. 17397 and Coastal Development Permit No. 10-017 for the Pacific Mobile Home Park subdivision, which permitted the subdivision of an existing for-rent, mobile home park with a total of 252 units to create individual lots that may be sold (Attachments 4 and 5). Tentative Tract Map No. 17397 consists of approximately 18.22 net acres, 252 existing numbered lots, and 31 lettered lots representing interior drive aisles, landscape areas, and common areas. No new development, mobile home spaces, construction or improvements were proposed or approved with the tentative map. After the approval of Tentative Tract Map No. 17397 the following changes were made at the park that are inconsistent with the conditions of approval of the tentative map: 1) a residential unit was installed on Lot CC; 2) a storage/garage and laundry building on Lot C was demolished; 3) Lot C was graded and common recreational open space and guest parking spaces were removed and replaced in different locations; and 4) eight Recreational Vehicle residential units were installed on Lot C. Parties agreed that the residential unit on Lot CC will be removed and that the remaining issues regarding grading, common open space, and parking on Lot C will be resolved with the City Attorney's Office and the City Engineer. B. RECOMMENDATION: The final map has been approved by the City Engineer as complying with the conditionally approved tentative tract map. Environmental Status: The action to accept Final Tract Map No. 17397 is exempt from the requirements of the California Environmental Quality Act pursuant to Section 15268 (b). FINDING FOR APPROVAL -TENTATIVE MAP NO, 17397: 1, Tentative Tract Map No. 17397 for the purposes of converting an existing 252 space for-rent mobile home park to a mobile home park where residents can purchase the land where the mobile home is located is consistent with the General Plan Land Use Element designation of RM-15 (Residential Medium Density — Max. 15 units per acre) on the subject property. The tentative tract map complies with the Subdivision Map Act (Section 66427.5), for which Title 25— Subdivisions of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) was adopted to supplement and implement. In addition, the mobile home park is consistent with the following policies and objectives of the General Plan: A. Land Use Element Policy LU 7.1.3: Allow for the continued occupancy, operation, and maintenance of legal uses and structures that exist at the time of the adoption of the General Plan and become non-conforming due to use, density, and/or development requirements, Objective LU 15.6: Facilitate the preservation and development of Residential Mobile Home Parks. The mobile home park was established in 1954, prior the adoption of the current General Plan and zoning ordinance. The existing mobile home park is located in the Residential Mobilehome Park (RMP) zoning district. However, the developed park does not fully comply with the present development standards and would be considered non-conforming. The proposed tentative tract map does not include the creation of new mobile home spaces; therefore, the project is not required to comply with the current provisions of the HBZSO. In addition, as no new construction is proposed, the project would not increase existing nonconformities. The subdivision to convert the existing for-rent mobile home park to ownership facilitates the preservation of an existing legal use (mobile home park). No new development or change of land use is proposed as part of the subdivision, 2. The site is physically suitable for the type and density of development. The proposed subdivision converts an existing 252-space for-rent mobile home park to a 252-space ownership mobile home park at a density of approximately 14 units per acre and is physically suitable for the site. Item 2• - 17 H B -64- I The design of the subdivision will not cause serious health problems or substantial environmental damage or substantially and avoidably-injure fish or wildlife or their habitat as the no new construction is proposed. 4, The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision unless alternative easements, for access or for use, will be provided. The subdivision would convert an existing for-rent mobile home park to resident ownership and does not propose new mobile home spaces, construction or improvements. As such, the subdivision would not increase existing encroachments of mobile homes and accessory structures within the City's Huntington Street right-of-way. Additionally, conditions of approval require disclosure to future buyers of lots with encroachments to ensure the City's right-of-way along Huntington Street would be preserved for future use. FINDINGS FOR APPROVAL— COASTAL DEVELOPMENT PERMIT NO. 10-017: 1, Coastal Development Permit No. 10-017 for the subdivision an existing 252-space for-rent mobile home park to resident ownership conforms to the General Plan, including the Local Coastal Program. No new construction or mobile home spaces are proposed and therefore, the mobile home park will remain consistent with the density allowable under the Residential Medium Density land use designation on the property as specified on the City's certified Coastal Land Use Plan. The proposed subdivision will not conflict with policies of the City's certified Local Coastal Program requiring protection and preservation of coastal resources. 2. The proposed subdivision would convert and existing for-rent mobile home park to resident ownership and would not result in new construction inconsistent with the requirements of the CZ Overlay District, the base zoning district, as well as other applicable provisions of the Municipal Code. 3. The proposed subdivision consists of a conversion of an existing for-rent mobile home park to resident ownership and does not propose new construction that would necessitate new infrastructure. Existing infrastructure serving the mobile home park will remain in place. 4. The development conforms to the public access and public recreation policies of Chapter 3 of the California Coastal Act. The project does not propose new construction that would place additional demand on existing public access and recreation opportunities in the coastal zone. Since no new construction is proposed, the subdivision will not increase existing encroachments within the City's right-of-way along Huntington Street. Furthermore, the conditions of approval provide assurance that the City's right-of-way along Huntington Street would be preserved for improving pedestrian access to the coast in the future consistent with the public access policies of the Coastal Act. CONDITIONS OF APPROVAL—TENTATIVE TRACT MAP NO. 17397: 1, The Tentative Tract Map No. 17397 for subdivision of an existing 252-space mobile home park received and dated December 7, 2010 shall be the approved layout. 2. Prior to submittal of the final tract map to the Public Works Department for processing and approval, the following shall be required: a. Prior to the submittal of CC&Rs to the Department of Real Estate (DRE) and at least 90 days before City Council action on the final map, CC&Rs shall be submitted to the HB -65- Item 2. - 18 Planning and Building Department and reviewed and deemed acceptable in compliance with these conditions of approval by the City Attorney. The CC&Rs shall identify the common driveway access easements, and maintenance of all walls and common recreation and landscape areas by the Homeowners` Association. The CC&Rs must be in recordable form prior to recordation of the map. b. Final tract map review fees shall be paid, pursuant to the fee schedule adopted by resolution of the City Council (City of Huntington Beach Planning Department Fee Schedule). (HBZSO Section 254.16) 3. The final map shall be recorded with the County of Orange. 4. Prior to the sale of the first lot, the following shall be required: a. Covenants, Conditions and Restrictions (CC&Rs) in a form reviewed and deemed acceptable in compliance with these conditions of approval by the Office of the City Attorney shall be recorded. The CC&Rs shall be binding on each of the lots, shall run with the land affected by the subdivision and shall be included or incorporated by reference in every deed transferring one or more lots in the subdivision. b. The CC&Rs shall disclose to lot buyers that: 1.) According to the Subdivision Map for the Park, some of the existing mobile homes and accessory structures abutting Huntington Street extend beyond the Park and lot boundary into the recorded City of Huntington Beach right-of-way, 2.) The purchasers of any of the 23 lots abutting Huntington Street may be responsible for any action taken by the City to remove any of the mobile homes and accessory structures which are determined to be unlawfully encroaching into any City right-of- way or into the 3-foot setback area along Huntington Street. 5. The subdivider shall offer each existing tenant an option to either purchase his or her subdivided unit, which is to be created by the conversion of the park to resident ownership, or to continue residency as a tenant. (Subdivision Map Act§ 66427.5) 6. The subdivider shall be required to avoid the economic displacement of all non-purchasing residents in accordance with the following: a. As to non-purchasing residents who are not lower income households, the monthly rent, including any applicable fees or charges for use of any pre- conversion amenities, may increase from the pre-conversion (commencing at the time of final map recordation) rent to market levels, as defined in an appraisal conducted in accordance with nationally recognized professional appraisal standards, in equal annual increases over a four-year period. (Subdivision Map Act§ 66427.5) b. As to non-purchasing residents who are lower income households, the monthly rent, including any applicable fees or charges for use of any pre-conversion amenities, may increase from the pre-conversion rent by an amount equal to the average monthly increase in rent in the four years immediately preceding the conversion (commencing at the time of final map recordation), except that in no event shall the monthly rent be increased by an amount greater than the average monthly percentage increase in the Consumer Price Index for the most recently reported period.
