Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2016-63 Amending Permit Parking District "T"within the City of Huntington Beach, affecting residents on Montecito Drive Statement of Issue: Residents on Montecito Drive have petitioned the City to be included in Permit Parking District "T." Financial Impact: The provisions of Huntington Beach Municipal Code Chapter 10.42 requires that the residents choosing to participate in a residential permit parking district pay a proportionate share of the cost to establish or amend the district making the district cost-neutral to the City. Typical costs include, but are not limited to, installation of signs, curb markings, staff time to issue permits, and administrative costs to create or amend the district. Recommended Action: Adopt Resolution No. 2016-63 "A Resolution of the City Council of the City of Huntington Beach Amending Permit Parking District"T"Within the City of Huntington Beach." Alternative Action(s): Deny the recommended action. Analysis: On November 16, 2015, City Council adopted resolution No. 2015-75 creating Permit Parking District "T" due to parking impacts residents experienced on their streets by commuter vehicles. The streets comprising District "T" are Softwind Drive and Angler Lane. The neighborhood is located just south of Edinger Avenue east of Springdale Street, as shown on Attachment 1. In early 2016, Public Works received a petition signed by residents on Montecito Drive requesting Permit Parking District "T" be amended to include addresses on Montecito Drive from Angler Lane to Woodstock Lane. Residents expressed that since Permit Parking District "T" had been implemented, on-street parking by commuter vehicles moved to Montecito Drive; in particular, in areas immediately adjacent to the current parking district. The residents indicated that the reason for the request is due to the lack of on-street parking in front of their homes and the inconvenience these parking impacts have caused. Attachment 2 shows the area of the current parking district and the proposed area to be added to District "T." Staff reviewed the request, determined the petition and concerns of the residents were valid, and examined the proposed boundaries. Staff prepared and mailed letters to the affected properties HB -161- Item 4. - I Dept.ID PW 16-057 Page 2 of 2 Meeting Date: 10/3/2016 explaining the permit parking district requirements, proposed boundaries, and ballots for voting on the parking district amendment. Per City Municipal Code 10.42 a minimum of 75% of the property units shall be in favor of the parking district amendment to move the request for further consideration. Of the 30 affected properties on Montecito Drive, twenty-five (25) ballots were returned with sixteen (16) voting in favor (53%). The original request did not receive the required 75% in support of the amendment. However, based on discussions with the residents in the recurring impacted areas, staff reexamined the amendment boundaries. The majority of the properties supporting the request to include Montecito Drive in the current parking district were residents along the west-half of the street. Thirteen (13) of the sixteen (16), or 84% of the properties along the west half of Montecito Drive, voted in support of the amendment. Because these residents had a strong interest in permit parking, staff reconsidered the boundaries and determined it would be reasonable to revise the original amendment request and include just the west-half of Montecito Drive as the proposed parking district to be added. As required by code staff investigated the conditions on Montecito Drive at various times of the day and days of the week to assess the parking conditions and associated issues that were expressed by the residents. Based on the field observations and discussions with the residents, staff finds that the unrestricted parking along the west -side on Montecito Drive creates a situation where parking unreasonably and regularly interferes with resident and guest parking and is, therefore, in support of the request. The number of addresses that would be added to Permit Parking District "T" is sixteen (16). Per Municipal Code 10.42 notices to the affected properties and properties within 500 feet of the proposed district boundaries were sent with the date and time of the City Council meeting. Figure 1 shows the boundaries of the current Permit Parking District and the proposed areas requested to be added. The addresses of the residents who signed the petition are shown below in Table 1. The number of properties that would potentially be included in the requested amendment is thirty (30) properties. In March 2016, staff prepared and mailed letters to the affected properties explaining the permit parking district requirements, boundaries, and ballots for voting on the parking district amendment. Staff followed up with a letter a few weeks later to remind residents to return their ballot. The last of the ballots were received by Public Works in mid- April 2016. Per the City Municipal Code (10.42) a minimum of 75% of the property units shall be in favor of the parking district to move the request for further consideration. Of the 30 affected properties, twenty- five (25) ballots were returned with sixteen (16) voting in favor of the parking district amendment. The ballot results for the original amendment request are presented in Table 2. Various times of the day were examined to assess the parking conditions and associated issues that were expressed by the residents. These areas are shown on Figure 3. These locations appear to be impacted by commuter vehicles of residents from the nearby apartment complexes. The residents' concerns are the lack of on-street parking for family members and guests, and being unable to place trash bins along the curb (rather than across the driveway) due to the parked vehicles. Residents of the impacted areas have expressed their concerns to staff on several occasions and have stated the parking issues exist for them all day. Photos of the impacted areas are shown on page 9. Based on provisions in the Municipal Code (10.42) specific conditions shall exist for a parking district request to move forward for consideration to the City Manager's office. These include: unrestricted parking creates a situation where on-street parking cannot be regularly used by residents and guests; or, unrestricted parking by commuter vehicles produces significant sources of health, safety, or welfare concerns. After discussions with the residents and conducting the field evaluations, staff finds that the unrestricted parking on Montecito Drive creates a situation where the commuter parking regularly interferes with residents and their guests parking. Staff supports amending Permit Parking District T to add Montecito Drive from Angler Lane to mid-block. Et �z a e u a�' ' L cyan ;, As a result of the parking impacts, residents have found it difficult to place trash bins along the curb on pick-up day without having to block their driveway. 9 1 P a g e HB -173_ Item 4. - 13 ATTACHMENT #4 RESOLUTION NO. 2016-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING PERMIT PARKING DISTRICT "T" WITHIN THE CITY OF HUNTINGTON BEACH WHEREAS, the City Council has adopted Chapter 10.42 of the Huntington Beach Municipal Code (HBMC), regarding the establishment of permit parking districts in residential areas; and The citizens owning certain properties along the residential street known as Montecito Drive have petitioned to be included in Permit Parking District"T", as more particularly shown on the snap attached hereto as Exhibit "A" and incorporated by this reference as though fully set forth herein; and The Director of Public Works reviewed the petition, and following the process established in HBMC Chapter 10.42, sent a ballot for further consideration to residents of the petitioned streets, and caused an investigation which reasonably established that unrestricted parking interferes with available parking for residents and guests, and produces sources of health and safety concerns; and The Director of Public Works finds the requirements of Chapter 10.42 of the Huntington Beach Municipal Code to be reasonably fulfilled, including a finding that the Permit Parking District will not affect other uses of on-street parking. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: 1. The above recitals are all true and correct. 2. I'm not sure what sort of opportunity we'll have to speak,so I wanted to bullet point the issues I've experienced on a daily/weekly basis,so at least it's on record if required. • Cars are regularly abandoned outside our house for 4 or 5 days on end,thus making it hard for our visitors to park—these cars belong to residents at the apartment blocks on Springdale St.,we know this they don't live on our street and can be seen parking, locking their cars and then walking towards Springdale,after a while you get to recognize the cars and the individuals who drive them. ® 1 am regularly awoken by loud stereos,alarms or loud conversations etc. right outside our house at anti-social hours—this is worse at the weekends when people arrive back late after going to bars etc.watching them trying to part in a straight line is interesting Also,it seems some individuals work shifts?, leaving at 4:00 in the morning etc. and those individuals show no consideration for the residents in our otherwise quiet street. • Our driveways are regularly used to turn-around and we have had damage to the planting in the mouth of the drive accordingly—I generally find using somebody drive to turn-around as being pretty obnoxious. • The nature of the parking of often inconsiderate as hell.i.e.cars overhanging the end of my drive,or 3 feet from the curb making It hard for me to reverse my car out of my garage,in some cases the cars blocking my drive are left for several days.....I leave polite notes on the cars,asking them not to block my drive, but it seems to make no difference. • On Trash Collection Days,we leave our trash bins out on the street in front of our house on a Tuesday evening, but the parked cars make this very difficult sometimes.Assuming they leave sufficient space and we manage to actually put the bins out, I have noticed people trying to park on the street using their cars to nudge them out of the way. I hear from my neighbors that their bins have even beer moved onto the sidewalk or into the road by people trying to part—this means they will not be emptied by the garbage collectors. • Having numerous parked cars on the street makes it dangerous for my kids who have to cross the road from behind the cars so that they are obscured from the view of oncoming traffic,this was not the case before the permit zone was extended to Angler lane earlier this year. • The road outside our house is now covered in oil spots from the Apartment resident's cars,they also leave trash,cigarette butts, bear bottles etc.on the street on the sidewalk,which we are obliged to clean up. ® I avoid taking to the owners of the vehicles as I hear from my neighbors that they can be abusive. I received a letter from your office regarding the city council meeting on October 3, 2016 at which parking restrictions on both sides of the western end of Montecito Drive (8 residences on each side of the street).will be discussed. There currently are no restrictions for parking on Montecito and those of us who live on the western end of the street experience unavailability of parking because of the many vehicles from other areas which are parked here. Unfortunately, I am unable to attend the meeting; however I would like to offer my views on the situation. The density of parking has frequently impeded various vehicles such as delivery vehicles, service vehicles and maintenance vehicles which need the availability of street parking for short times to perform their respective functions. In addition, the parked vehicles also impede the placement and pickup of trash cans, potentially causing tipped over or emptied trash cans left out in the street. Some of the vehicles remain parked for 3 or 4 days at a time without being moved thus increasing the problems. At times the parking has been dense enough to cause service vehicles to park in the middle of the street. As yet,there has not been a problem of the parking situation impeding emergency vehicles, although two of them arrived a week or two ago and were fortunate to find adequate parking. My name is Sylvia and I live in the Lamplighter Apartment complex right on the corner of Springdale and Softwind Dr. Parking is constantly an issue in the area due to Springdale being a main street and lots of red curbs in the area. This petition would limit the already scarce parking even more than before and I feel this is too extreme and very unneighborly. I understand some of the homes in the area dislike it, but the street is a public space and does not belong to them. They all have driveways and 2 car garages for their vehicles. It's unfair to restrict others from parking in an area that would remain empty otherwise and especially in the middle of the night. Even the people that live by the beach do not restrict the parking in front of their homes by permits. Hundreds of people drive to the beach on a regular basis and park all around these homes and there are no permit restrictions to any of those areas, why would these streets be any different. I hate that I have to park my car half a mile away from my apartment sometimes and have to walk alone in the dark to get home. This will make it even worse. It's unfair and would effect more people negatively than it would positively. I appreciate you taking the time to hear my thoughts on the petition.
