HomeMy WebLinkAboutCentral Park Historical - Lease Agreement Between City and D 1 REAL PROPERTY LEASE 2 3 THIS LEASE , dated the lst day of February 1972 , between 4 the CITY OF HUNTINGTON BEACH, a municipal corporation , hereinafter 5 called "Lessor ," and DUWARD R. BROOKS and LOIS A. BROOKS , husband. 6' and wife , hereinafter called "Lessee" ; , 7 W I T N E S S E T H: 8 Lessor hereby leases and lets unto Lessee the private 9 residence and those certain premises situate in the Southwest 10 Quarter of Section 26 , Township 5 South, Range 11 West , partly 11 in the Rancho La Bolsa Chica 'and partly in the Rancho Las Bolsas , 12 City of Huntington Beach, County of Orange , State of California , 13 more particularly outlined in red on the attached plat , both 14 residence and premises being hereinafter referred to collectively 15- as "Premises , " together with the right of ingress and egress 16 thereto and therefrom over the strip of land outlined in blue . 17 Subject to the following, : 18 1 . Said premises shall be used for purposes of a 19 private dwe•11 ing only.. 20 2 . This lease ' shall be for. a Primary Term of fifteen 21 (15) years from the -date hereof or so long as Lessee 22 remains in the employ, of Standard Oil Co .. of 23 California in the City• of Huntington •Beach, whichever 24 date . shall come first , and thereafter until thirty 25 (30) days ' notice in writing from either party to 26 the other of an intention to terminate the same , 27 provided , however , that this lease may be terminated 28 by Lessee at any time upon thirty (30) days ' notice 29 in writing of such termination to Lessor prior to 30 the expiration of the Primary Term of this lease . 31 3 . Commencing February 1 , 1972 , Lessee shall pay 32 to Lessor the sum of Twelve and No/100 Dollars ($12 . 00) � II I per month, and payable monthly in advance on the 2 first day of each calendar month thereafter . 3 4 . Lessee shall not , without written consent of 4 Lessor , assign or transfer this lease or any 5 interest therein or sublet said premises or any 6 pant thereof or make any alterations in or 7 additions to said premises or to the same except 8 as hereinafter provided ; and Lessee will not do 9 or permit to be done thereon anything that may 10 constitute a public or private nuisance or 11 violation of any law or any rule of the fire 12 underwriters . 13 S . Lessee shall at all times and at Lessee ' s own 14 cost and expense keep said premises (including 15 garden and sidewalks) in good order , repair , 16 and in a neat and safe condition , free from 17 waste or damage and in accordance with local City 18 ordinances . 19 . 6 . Lessee shall pay for all gas , heat , electricity , 20 water , and other utilities of whatsoever nature 21 brought on or used on said premises during this 22 lease . 23 7 . Any alterations , additions , and improvements 24 which may be made by Lessor or Lessee upon said I 2.5 premises shall become the property of Lessor and 26 remain upon and be surrendered with said premises 27 as a part thereof at the termination of this lease . 28 8 . Lessee shall hold Lessor harmless from any and 29 all losses , expenses , claims , and demands for 30 injury to. or :death of person or damage to or 31 losses of property arising out of or connected with 32 the use of said premises by or under Lessee .. - 2 - 1 9 . Lessor shall have the right . at all reasonable 2 times to enter the premises to inspect the same 3 and make such repairs and alterations as the 4 Lessor shall see fit , and Lessee agrees to 5 surrender said-premises at the expiration of 6 this lease in the same condition in which they are now, reasonable use and wear thereof and 8 damage by fire or Act of God excepted. .9 10 . Lessor shall have the use of that portion 10 of the demised premises not now occupied by 11 lawn or other improvements for the purpose of 12 parking and storage of equipment and other 13 property of Lessor . 14 ! 11 . The waiver by Lessor of any breach of any i 15 covenant or promise to be kept or performed by 16 Lessee shall not be considered to be a waiver 17 of a subsequent breach of the same covenant i 1$ ' ) or promise or a waiver of the breach of any 10 other covenant or promise of this lease . 20 12 . Any notice to be given Lessor , hereunder i 21 shall be mailed to it at P . 0 .
