2.15.010 Establishment. There is hereby established a Finance Department which shall
include the staff functions of finance, and purchasing.
2.15.020 Objectives. The objectives of the department shall be to establish, facilitate and
maintain support to City operating departments.
2.15.030 Director-Powers and duties. The Director of Finance shall be appointed by the

(a) Direct, plan, organize and coordinate programs and activities of the Finance Department;
(b) Establish and maintain a system of financial procedures, accounts and controls for the
City government and each of its offices, officers, departments and agencies;
(c) Provide direction for the control of all expenditures to insure that budget appropriations
are not exceeded;
(d) Manage the business license functions including the issuance of permits.
(e) Direct and administer the City's centralized purchasing function with regard to
procurement of all supplies, services and equipment for all City departments and
agencies of the City.
(f) Administration and enforcement of appropriate sections of Title 5 of the Huntington
Beach Municipal Code relating to business licensing.
(g) Administer and enforce all Municipal Code regulations including but not limited to:
(1) Huntington Beach Municipal Code Licensing Procedures
(Chapter 5.08)
(2) Huntington Beach Municipal Code Natural Resource Production

(1) Maintains all trusts, bonds, securityagreements and funds for the City including the
filing. depositing,. refunds and releases, letters of release, and inquiries relating thereto.
2.15.040 Appointment of subordinates. The Director,.with the approval of the City
^aministfater Manager, shall appoint all other officers, assistants, deputies and employees of
the Finance Department.
2.15.050 Financial and Accounting Duties of City Clerk Transferred. In accordance with
Government Code sections 37209 and 40805.5, the financial and accounting duties imposed upon
the City Clerk by Government Code sections 40802 through 40805 are hereby transferred to the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH REPEALING RESOLUTION NO. 2005-21 AND
SETTING THE BENEFITS AND SALARY FOR THE PART TIME CITY TREASURER
WHEREAS, the City Council of the City of Huntington Beach desires to establish the
salary level and benefit for the part time City Treasurer,
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach as follows:
SECTION 1. Benefits for the part time City Treasurer shall be the same as the City
Council as referenced in Huntington Beach Municipal Code Section 2.28.020.
SECTION 2. The salary for the part time City Treasurer shall be $48,000.00 annually,
payable bi-weekly.
SECTION 3. Resolution No. 2005-21 as well as any existing provisions in conflict with
the foregoing, whether by minute action or other resolution of the City Council, are hereby
repealed.
SECTION 4. All benefits and salary established herein shall continue until further
modified by City Council action.

SUBJECT: Approve for introduction Ordinance No. 3907 amending the
Huntington Beach Municipal Code by repealing Chapter 2.16 of the
Huntington Beach Municipal Code and amending Section 2.15.030 of
the Huntington Beach Municipal Code relating to the duties of the
Finance Department; Adopt Resolution No. 2010-106 establishing the
salary and benefits for the part-time City Treasurer; and, authorize the
appointment of an Acting City Treasurer
Statement of Issue: The City Council is asked to amend the existing City of Huntington Beach
Municipal Code by adopting an ordinance deleting Chapter 2.16 of Huntington Beach Municipal Code
and amending Section 2.15.030 of the Huntington Beach Municipal Code including adopting
Resolution No. 2010-106 setting the salary and benefits for the part-time City Treasurer, and
appointing Bob Hall, Deputy City Administrator as the Acting City Treasurer effective January 4, 2011.
Financial Impact: Sufficient funds have been budgeted in the 2010/11 fiscal year. It is
estimated that modifying the City Treasurer's position will save a minimum of $100,000 annually
(additional savings may be realized following subsequent analysis).
Recommended Action: Motion to:
A) After the City Clerk reads by title, approve for introduction Ordinance No. 3907, "An Ordinance of
the City of Huntington Beach Amending the Huntington Beach Municipal Code By Deleting Chapter
2.16 and Amending Chapter 2.15 Relating to the Duties of the Finance Department;" and,
B) Adopt Resolution No.2010-106, "A Resolution of the City Council of the City of Huntington Beach
Repealing Resolution No. 2005-21 and Setting the Salary for the Part-Time City Treasurer;" and,
C) Approve the modified Class Specification for the Finance Director; and,
D) Appoint Bob Hall, Deputy City Administrator as the Acting City Treasurer effective January 4,
2011.
Alternative Action(s):
Do not approve the Ordinance and Resolution modifying the City Treasurer and Finance
departments.

REQUEST FOR COUNCIL ACTION

Analysis:
On January 4, 2011, the current City Treasurer will depart the City of Huntington Beach to become
the Orange County Treasurer. Administration has evaluated the current organizational structure by
review of other comparable municipalities. A recently completed (draft) report on the Treasurer and
Finance Departments included a survey of nine Southern California cities between 100,000 —
250,000 population with an elected City Treasurer [Burbank, Carlsbad, Escondido, Glendale,
Oceanside, Orange, Oxnard, San Bernardino, and Torrance]. Three of these cities, Carlsbad,
Orange and San Bernardino, have part-time Treasurers.
The Treasurers of these three cities perform many of the duties identified as the "core" Charter
responsibilities of the Huntington Beach City Treasurer. These include receiving and depositing city
funds and investing these funds in accordance with adopted investment policy. These cities have
part-time Treasurers who have the authority to perform many of the "core" treasurer functions found
in the Huntington Beach Charter.
The basic Charter powers and duties of the City Treasurer for the City of Huntington Beach involve
"receiving" all City funds either directly by that Office or from other Departments; maintaining
custody of these public funds and depositing (investing) them in accordance with Council
resolution; paying out monies as authorized; submitting monthly financial reports to the Finance
Director; and performing such other duties consistent with the Charter as required by ordinance or
resolution adopted by the City Council.
These "core" duties of receiving, depositing and investing all City funds and making authorized
payments are similar to the treasurer charter duties found in the other cities surveyed. These other
cities, however, have much smaller staffs than in Huntington Beach and (sometimes) are headed
by a part-time Treasurer.
The City Treasurer's authority must be preserved since the City Charter still requires that fund
receipt, investment and disbursement duties be performed by the elected City Treasurer.
Accordingly, the Treasurer must have the ability to exercise this Charter authority. This includes,
independence in administering the City's funds including investments, securing and maintaining
banking relationships for the deposit of city funds, and exercising signature authority for making
authorized payments.
These functions can still be accomplished in a part-time capacity. By limiting the City Treasurer's
Office to its "core" responsibilities, there is opportunity to consolidate some of the existing
Treasurer's responsibilities with the Finance Department. This will present opportunities to become
more efficient and to better serve the public at significant cost savings of a minimum of $100,000
annually.
Administration has analyzed the current operational structure and fiscal condition of the City and
has determined that the best option is to modify the City Treasurer's function to reflect those
operational requirements mandated by the City Charter and to reallocate non-core/ancillary
functions to the Finance Department. The duties and responsibilities not required by the City
Charter to be performed by the City Treasurer shall be migrated to the Finance Director. This
reallocation of duties will not result in modification of the compensation for the Finance Director
position. It has been determined that this alteration will result in the City Treasurer retaining
approximately 1/3 of the current assignment, resulting in a change in annual base compensation to
$48,000.00.

The City Council process for appointing the successor City Treasurer shall be compatible with the
process used previously in the City Clerk's office. The City Administrator will receive and review
applications and screen same for minimum qualifications and will forward all qualified applicants to
the City Council for interview and selection. The timetable for this process shall not exceed 60
calendar days following the position vacancy.
The appointment of Bob Hall as acting City Treasurer ensures continuity of operations until Council
can appoint a successor. To become and remain eligible for City Treasurer, the person elected or
appointed shall have a minimum of five years of financial and/or treasury experience, and have
either a Masters degree in accounting, finance, business or public administration; or a Bachelors
degree in accounting, finance, business or public administration with certification by the California
Municipal Treasurer's Association, or their successor, within three years of election or appointment.
Bob Hall has a Masters degree in Public Administration and a Bachelor of Science degree, and has
worked in an executive capacity handling departmental financial matters since 1988.

DUTIES SUMMARY
Under general direction of the City Administrator, performs responsible supervisory and
administrative work in planning, organizing, coordinating and directing the financial and
central services activities of the City, which include accounting, banking, budget and
research, cash collection and management, utility billing, accounts receivables, business
tax management, central storestwa rehouse, purchasing, reprographic and mail delivery
services; coordinates assigned activities with other City departments and outside
agencies; and provides highly responsible and complex administrative support to the City
Administrator.
DISTINGUISHING CHARACTERISTICS
The Director of Finance receives general administrative direction, from the City
Administrator and exercises direct supervision over management, supervisory,
professional, technical and clerical staff. This classification is designated as "at will."
An "at will" designation excludes a position from the competitive service of the City and
the City's Classification Plan. The position requires an advanced knowledge of
municipal finance, budgeting and purchasing for the development and administration of
programs designed to address primary areas of City service. The incumbent is
expected to exercise independent judgment in establishing efficient and effective
financial operations consistent with City Council policies and administrative guidelines
established by the City Administrator.
EXAMPLES OF ESSENTIAL DUTIES
Assists in directing the fiscal management of the City, including budget preparation and
monitoring, revenue forecasting, general accounting, financial reporting, pre-auditing
and internal controls, debt issuance and administration, capital financing, financial
systems design, implementation and control; recommends and administers policies and

and correctness of claims, demands and charges; draws warrants upon the City
Treasurer for all claims and demands that are approved; specifies the purpose for which
drawn and the fund from- which payment is made; supervises and is responsible for the
proper accounting, collecting, management and record keeping of all revenues and
expenditures; conducts studies or oversees the conduct of complex studies relating to
the development of rates, fees and user charges; prepares and supervises the
preparation of reports to the State Controller, County Auditor Controller and other
Federal, State or County agencies; may serve on the City's negotiation team for labor
contracts; calculates costs of proposals and various scenarios and may present
information in sessions with the City Council; serves as the liaison to the Finance Board.

DUTIES SUMMARY
Under general direction of the City Administrator, performs responsible supervisory and
administrative work in planning, organizing, coordinating and directing the financial and
central services activities of the City, which include accounting, banking, budget and
research, cash collection and management, utility billing, accounts receivables, business
tax management, central stores/warehouse, purchasing, reprographic and mail delivery
services; coordinates assigned activities with other City departments and outside
agencies; and provides highly responsible and complex administrative support to the City
Administrator.
DISTINGUISHING CHARACTERISTICS
The Director of Finance receives general administrative direction from the City
Administrator and exercises direct supervision over management, supervisory,
professional, technical and clerical staff. This classification is designated as "at will."
An "at will" designation excludes a position from the competitive service of the City and
the City's Classification Plan. The position requires an advanced knowledge of
municipal finance, budgeting and purchasing for the development and administration of
programs designed to address primary areas of City service. The incumbent is
expected to exercise independent judgment in establishing efficient and effective
financial operations consistent with City Council policies and administrative guidelines
established by the City Administrator.
EXAMPLES OF ESSENTIAL DUTIES
Assists in directing the fiscal management of the City, including budget preparation and
monitoring, revenue forecasting, general accounting, financial reporting, pre-auditing
and internal controls, debt issuance and administration, capital financing, financial
systems design, implementation and control; recommends and administers policies and
procedures.
Plans, directs and coordinates the administration of the City's finance, purchasing, utility
billing, business licensing, reprographic and mail services; recommends policies and
implements procedures to conduct activities; ensures that all activities are conducted in

Assists in ensuring that the financial needs of the City are met; raises funds through
creative financing, bond issues, certificates of participation and lease purchase
financing; evaluates alternative financing methods for all major acquisitions; supervises
and controls capital financing projects; assists in negotiating major financial
transactions; directs and coordinates revenue collection, disbursement activities,
purchasing, and inventory control functions.
Advises department heads and the City Administrator in the review of estimates and
proposed budget allocations for the City and the Redevelopment Agency; estimates
anticipated revenues; conducts fiscal analyses and submits data and reports for use in
evaluating operating department proposals; provides the City Administrator and
department heads with timely and informative financial reports and statements;
manages and participates in the development and administration of the Finance budget;
directs the forecast of additional funds needed for staffing, equipment, materials, and
supplies.
Determines, with the advice of the City Attorney when necessary, the regularity, legality,
and correctness of claims, demands and charges; draws warrants upon the City
Treasurer for all claims and demands that are approved; specifies the purpose for which
drawn and the fund from which payment is made; supervises and is responsible for the
proper accounting, collecting, management and record keeping of all revenues and
expenditures; conducts studies or oversees the conduct of complex studies relating to
the development of rates, fees and user charges; prepares and supervises the
preparation of reports to the State Controller, County Auditor Controller and other
Federal, State or County agencies; may serve on the City's negotiation team for labor
contracts; calculates costs of proposals and various scenarios and may present
information in sessions with the City Council; serves as the liaison to the Finance Board.
Selects, trains, motivates and evaluates Finance personnel; provides or coordinates

AMENDING THE HUNTINGTON BEACH MUNICIPAL
CODE BY DELETING CHAPTER 2.16 AND AMENDING CHAPTER..15
RELATING TO THE DUTIES OF THE FINANCE DEPARTMENT
The City Council of the City of Huntington Beach does hereby ord "as follows:
SECTION 1. Chapter 2.16 of the Huntington Beach Municipal�Code is hereby deleted in its
entirety.
SECTION 2. Section 2.15.030 of the Huntington Beach unicipal Code is hereby amended to
read as follows:
2.15.030 Director-Powers and duties. The Director of Finance shall be appointed by the City
Manager with the approval of a majority of the City Council. The Director shall have the
following powers and duties: (3807-8/08)
(a) Direct,plan, organize and coordinate programs and activities of the Finance Department;
(b) Establish and maintain a system of financial procedures, accounts and controls for the City
government and each of its offices, officers, departments and agencies;
(c) Provide direction for the control of all expenditures to insure that budget appropriations are
not exceeded;
(d) Manage the business license functons including the issuance of permits.

uncollectible items up to $10,000 without further authorization,between $10,,000 and
$50,000 with the prior approval of the City Manager and in excess of$50,060 with City

(j) Makes cash flow projections on a weekly and monthly basis.
(k) Receives all City monies including taxes, fees, water, sewer an 'trash fees including oil well
royalties and transient occupancy taxes.
(1) Maintains all trusts,bonds, security agreements, and fund for the City including the filing,
depositing,refunds and releases, letters of release, and in uiries relating thereto.
SECTION 2. Section 2.15.040 of the Huntington Beach Municipal Code is hereby amended to
read as follows:
2.15.040 Appointment of subordinates. The Director,with the approval of the City Manager,
shall appoint all other officers, assistants, deputies and employees of the Finance Department.
SECTION 3. This ordinance shall become effective 30 days after its adoption.

AMENDING THE HUNTINGTON BEACH MUNICIPAL/ '
CODE BY DELETING CHAPTER 2.16 AND AMENDING CHAPTER 2.15
RELATING TO THE DUTIES OF THE FINANCE DEPARTMENT
The City Council of the City of Huntington Beach does ereby ordain as
follows:
SECTION 1. Chapter 2.16 of the Huntington Beach Municipal Code is hereby
deleted in its entirety.
SECTION 2. Section 2.15.030 of the Huntington Beach Municipal Code is
hereby amended to read as follows:
2.15.030 Director-Powers and duties. The Director of Finance-.shall-be----�
appointed by the City Managerfwith the_approval of-a majority of the City Council

(a) Direct, plan, organize and coordinate programs and activities of the Finance

(e) Direct and administ�e'r the City's centralized purchasing function with regard to
procurement of al�§upplies, services and equipment for all City departments
and agencies of the City.
(f) Administration and enforcement of appropriate sections of Title 5 of the
Huntington Beach Municipal Code relating to business licensing.
(g) Administer and enforce all Municipal Code regulations including but not limited
to:

2.15.010 Establishment. There is hereby established a Finance Department which shall
include the staff functions of finance, and purchasing. '»
