Mayor Moulton-Patterson called the regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 5:00 p.m. PRESENT: Bauer, Moulton-Patterson, Winchell, Leipzig, Sullivan, Silva (arrived 5:20 p.m.), Robitaille (arrived 6:30 p.m.) ABSENT: None ******************************************************************************************************** (City Council) PUBLIC HEARING - GENERAL PLAN AMENDMENT NO. 94-1 - NEGATIVE DECLARATION NO. 94-7 - PROPERTY BOUNDED BY SIXTH STREET/PACIFIC COAST HIGHWAY/EIGHTH STREET AND FIRST PUBLIC ALLEY PARALLELING PACIFIC COAST HIGHWAY (440.50) The Mayor announced that this was the day and hour set for a public hearing to consider the following: APPLICATION NUMBER: General Plan Amendment No. 94-1, Negative Declaration No. 94-7 APPLICANT: City of Huntington Beach LOCATION: 602-720 Pacific Coast Highway ZONE: Downtown Specific Plan, District 2 (Residential) REQUEST: To amend the Land Use Element and Coastal Element of the City's General Plan which includes redesignating approximately 2.5 gross acres of property generally bounded by Sixth Street, Pacific Coast Highway, Eighth Street and the first public alley paralleling Pacific Coast Highway from Residential-High Density to Commercial-Visitor Serving and amend pertinent exhibits in the Coastal Element. ENVIRONMENTAL STATUS: The subject application is covered under Negative Declaration No. 94-7. COASTAL STATUS: The subject property is located within the apealable portion of the Coastal Zone. Final action of the redesignation will be required by the California Coastal Commission. The Planning Director presented a staff report. Mayor Moulton-Patterson declared the public hearing open. South of.4ubiect Property: GENERAL PLAN DESIGNATION: Open Space Recreation ZONE: Downtown Specific Plan, District 11- FP3 LAND USE: Condominiums West of Subject Property: GENERAL PLAN DESIGNATION: Commercial Visitor Serving ZONE: Downtown Specific Plan, District 1 LAND USE: Motel PROJECT PROPOSAL: General Plan Amendment No. 94-1 is a request to amend the Land Use and Coastal Elements of the General Plan as follows: 1. Amend Land Use Map of the Land Use Element by redesignating 20 parcels, encompassing an approximate 2.5 gross acre area, bounded by Sixth Street, Pacific Coast Highway, Eighth Street and the first public alley paralleling Pacific Coast Highway, from Residential High Density to Commercial Visitor Serving. 2. Amend Figure 9.2, Land Use Plan Overlay, Existing Mobilehome Parks, of the Coastal Element by deleting overlay areas where mobilehome uses or parks no longer exist. 3. Amend Figure 9.6, Land Use Acreage Summary, Goldenwest to Beach, of the Coastal Element to reflect the land use amendment from Residential High Density to Commercial Visitor Serving. 4. Amend Figure 9.8, Coastal Land Use Plan, Goldenwest to Beach of the Coastal Element to reflect the Land Use Amendment from Residential High Density to Commercial Visitor Serving. 5. Amend Figure 9.9, Maximum Floor Area Ratios, of the Coastal Element by reducing the floor area ratios on commercial, residential and mixed use properties, and deleting the floor area ratio requirements on multi-family residential developments. The land use redesignation request originally resulted from an inquiry by a property owner who expressed interest in developing a gas station at the corner of 7th and P.C.H. During the revision of the Downtown Specific Plan, staff analyzed the request, which was eventually brought before the Planning Commission and City Council. The Planning Commission has evaluated the proposed zone change and approved it; the revision is now being considered at the City Council level. Staff Report-8/23/94 3 (pcst078) The amendment to the Mobile Home Overlay Map reflects the Downtown Specific Plan (DTSP) changes, as well as the closure of a park (Huntington Shores). The proposed DTSP deletes mobile home uses once designated in a portion of District 8. Figure 9.6 Land Use Acreage Summary Goldenwest to Beach will be amended to reflect the 2.5 acre land use amendment from Residential High Density to Commercial Visitor Serving. The Coastal Land Use Plan (C-LUP) will also be amended to reflect the land use amendment. Lastly, the Floor Area Ratio (FAR) map will be amended to correspond with the proposed changes to the Downtown Specific Plan. Most of the FAR's have been reduced with the exception to District 7, which has maintained a 3.0 maximum FAR. In addition, the FAR's for multi-family residential buildings in Districts 2 and 8 have been deleted. Zoning Compliance This subject properties are currently zoned Downtown Specific Plan, District 2 which allow multiple family residential uses. However, a change to the Downtown Specific Plan is pending City Council action which would rezone the properties to Downtown Specific Plan, District 1 permitting visitor serving commercial uses. This would be consistent with the proposed land use amendment. The existing uses on site consist of either commercial or oil related uses, which are consistent with the proposed zoning and land use amendments. ISSUES: General Plan Conformance: The proposed general plan amendment is consistent with policies of other elements of the General Plan including the Coastal and Housing Elements. The proposed visitor serving commercial designation is consistent with the policies contained in the Coastal Element by allowing for additional support facilities to accommodate the large numbers of visitors to Huntington Beach. Policy 3.6.2.2 Visitor Serving Facilities No. 1 states that the City should "Protect, encourage, and where feasible provide visitor serving facilities in the coastal zone which are varied in type and price." Although the land use amendment proposes a change from residential to commercial, residential units will remain a permitted use. For example, mixed use developments could consist of residential units over commercial suites on the ground floor. Hotels and motels could also be constructed within this area. The proposed redesignation is consistent with the Housing Element by allowing for residential development while providing visitor serving uses. Policy 3.3.3.1 Housing Element states, "To ensure adequate provision of housing for all economic segments of the community, the City of Huntington Beach shall facilitate the development of mixed-use projects containing residential and non- residential uses which can take advantage of shared land costs to reduce the costs of land for residential uses through General Plan designation and the Specific Plan process." Staff Report-8/23/94 4 (pcsr078) N M Environmental Status: Pursuant to the environmental regulations in effect at this time, the Department of Community Development advertised draft Negative Declaration No. 94-7 for thirty (30) days, and one comment was received by staff. The response is included and attached in Attachment No. 6. The staff, in its initial study of the project, has recommended that a negative declaration be issued. Prior to any action on General Plan Amendment No. 94-1, it is necessary for the Planning Commission to review and act on Negative Declaration No. 94-7. Coastal Status: Because the subject property is located within the Coastal Zone and the amendment entails changes to the City's Local Coastal Program - Land Use Plan (C-LUP), final review and approval by the California Coastal Commission is required. If the City Council approves the General Plan Amendment, then it will be forwarded to the California Coastal Commission concurrently with the DTSP changes. Redevelopment.Status: The project site is located within the Main-Pier Redevelopment project area. The Economic Development Department has reviewed the General Plan Amendment request and has no objections to the proposed redesignation. Desi.en Review Board: Not applicable. Subdivision Committee: Not applicable. Other Departments Concerns: The Departments of Public Works, Fire, Economic Development, Police, and Community Services, and Building and Housing Divisions have reviewed the proposed land use change and have no objection to the amendment. ANALYSIS: Land Use Compatibility The City's General Plan designates the property east and west of the subject area as Commercial Visitor Serving, with Residential High Density across the alley to the northeast, and Open Space Recreation across Pacific Coast Highway. A motel is located northwesterly of the subject property, with apartments to the northeast, retail commercial to the southeast and a 106 unit condominium project across Pacific Coast Highway. Staff Report-8/23/94 5 (pcsr078) The proposed land use designation will result in a continuous strip of visitor serving commercial property fronting Pacific Coast Highway, from Huntington Street to Ninth Street. The two (2)blocks currently designated for residential use will become more compatible with the adjacent properties as commercial property as the adjacent properties fronting Pacific Coast Highway are also commercial. Also, the subject properties are separated from the residential properties by a public alley, similar to other blocks in the immediate vicinity. Furthermore, all of the present uses on site are commercial type uses which are consistent with the proposed amendment. Public Services and Utilities Sewers The subject property is within the Orange County Sanitation District (OCSD) No. 11. The City's Department of Public Works has indicated that there is adequate capacity in district lines to serve the project site. Sewage generated from this site drains toward an Orange County sewer trunk line at Walnut Avenue. Wastewater generated within the District's service is processed at treatment plants located in Fountain Valley and Huntington Beach. Water The City of Huntington Beach Water Division is able to furnish the level of water supply necessary to serve the project's fire and domestic needs. When a specific development plan is proposed, methods to reduce water impacts and other environmental impacts will be evaluated. Storm Drains The City's Department of Public Works has indicated that the existing storm drain system accommodates all runoff from the project site. Police and Fire Protection Police service for the project area is provided by the City of Huntington Beach which operates from a central facility located at Main Street and Yorktown Avenue. The Huntington Beach Police Department also has a downtown substation at Fifth Street and Walnut Avenue. The redesignation will not require additional manpower or other resources. Response time for emergency calls to this area is under five (5) minutes, which is recommended under Fire Department policy. Fire protection for the project site is provided by the City of Huntington Beach from the Lake Street Fire Station. The area of concern is within the Fire Department's recommended five (5) minute response area of a fire station. Parks The subject property is located directly across the street from the beach. Other recreational opportunities include the City's Gym and Pool and 17th Street and Palm Avenue, and the Central Park. Staff Report-8/23/94 6 (pcsr078) M N Schools The subject property is located within the Huntington Beach City School District and is served by Smith Elementary School, Dwyer Middle School, and Huntington Beach High School. In the event residential units are constructed on the site, the number of students generated from the Visitor Serving Commercial land use alternative would be minimal and could be accommodated by the school district. Gas Natural Gas is provided by the Southern California Gas Company. The gas company has indicated that the proposed project could be adequately served by existing gas lines. It should be noted that since the gas company is a public utility and is under the jurisdiction of federal and state regulatory agencies, gas supply may be affected by the overall availability of natural gas and by federal and state regulatory policies. Electric The Southern California Edison Company has indicated that the subject property is located within the company's service area. According to the Edison Company, the electric loads of the proposed land use are within the parameters of the overall projected load growth. Solid Waste Disposal The Rainbow Disposal Company provides solid waste collection to the City of Huntington Beach. No local service constraints are expected to occur as a result of the proposed land use amendment. Key Environmental Issues The proposed land use amendment does not constitute any development at this time. However, it will allow for future construction of uses permitted under the Visitor Serving Commercial land use designation and the Downtown Specific Plan, District 1. No development is proposed at this time. Air Quality Future development of the project site may indirectly generate automotive and off-site energy generation emissions in the Huntington Beach region due to the new commercial uses on vacant sites, and on previous residential sites. These emissions may incrementally contribute to the degradation of local air quality. However, the project's contribution is not anticipated to be significant. Seismic, Soils and Geology In compliance with the Alquist-Priolo Geologic Hazards Zones Act of 1972, a Special Studies Zone has been established in Huntington Beach that includes the most hazardous earthquake faults. the project area does not all into this special studies zone, thus development need not be subject to the zones requirements. Staff Report-8/23/94 7 (pcsr078) The subject property is located on a portion of the Huntington Beach Mesa which is considered to be regionally subsiding. All subsidence and seismic issues will be addressed through standard conditions of approval which require compliance with state and local regulations which include submittal of soils and seismic studies and implementation of all recommendations contained therein. Light and Glare Any future development on the subject site would result in new light sources on the site. If effect, increased general nighttime illumination would be generated in the area. The initial study conducted by staff indicated that due to existing ambient light levels in the area, the slight increase in light and glare is not anticipated to be significant. Furthermore, implementation of standard conditions of approval requiring directing of lighting away from adjacent properties will mitigate any adverse impacts. Water Once developed, slight increases in surface runoff will occur due to the overcovering of the site with impervious surfaces. However, through the implementation of standard conditions of approval which require submittal and approval of grading plans and hydrology studies, impacts are not anticipated to be significant. Human Health Several lots within the project area consist of oil wells and related uses. The abandonment of oil wells and efforts to clean up the site shall be in accordance with state and city regulations. In addition, the site is located within the methane district. With implementation of standard conditions of approval which require sampling and monitoring for methane, no significant impacts are anticipated. SUMMARY: The proposed General Plan Amendment (Coastal and Land Use Elements) from Residential High Density to Commercial Visitor Serving will be more compatible with the adjacent commercial and residential uses by providing new visitor serving commercial uses along Pacific Coast Highway, while providing an adequate buffer(alley) from residential properties. The redesignation will not create any negative environmental impacts and will not adversely effect the City's public services and utilities. Therefore, staff supports the proposed amendment finding consistency with the proposed zoning, and with other elements in the General Plan. ALTERNATIVE ACTION: The Planning Commission may approve Negative Declaration No. 94-7 and deny General Plan Amendment No. 94-1 by adopting Planning Commission Resolution No. and forwarding it to the City Council. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT NO. 94-1 WHEREAS, General Plan Amendment No. 94-1 has been prepared and analyzed in the Planning Commission Staff Report dated August 23, 1994; and General Plan Amendment No. 94-1 is a request to amend the Coastal Element and Land Use Element of the City's General Plan to incorporate a redesignation of approximately 2.5 gross acres of property generally bounded by Sixth Street, Pacific Coast Highway, Eighth Street and the first public alley paralleling Pacific Coast Highway from Residential - High Density to Visitor Serving Commercial, and to revise pertinent maps (Attached Exhibits A through E) in the Coastal Element; and The Planning Commission held a public hearing pursuant to Government Code Section 65353 on August 23, 1994 to consider said General Plan Amendment; and The Planning Commission is required to make a recommendation to the City Council on the amendment to the General Plan pursuant to Government Code Section 65354. SECTION 4: The Planning Commission finds that the land use designation of Visitor Serving Commercial will be consistent with the proposed zoning on the property and will be compatible with surrounding land uses. All proposed uses will be required to comply with noise standards specified in the Huntington Beach Municipal Code. No significant noise impacts to new or existing residences are anticipated. 7. However, all standard conditions of approval on all new development require that lighting be directed in a manner to prevent "spillage" onto adjacent properties. X Discussion: The proposed general plan amendment will allow for visitor-serving commercial- development along Pacific Coast Highway, between Sixth and Eighth Streets. The proposed amendment is . consistent with the proposed Downtown Specific Plan District I (Visitor-Serving Commercial) zoning classification. Final approval of the proposed amendment will be required of-the California Coastal Commission since the subject property is located within the coastal zone. Currently, there are several commercial uses within the project area including a liquor store/market, motel, coffee shop and donut shop approximately 30 feet from existing residential.units. In addition, there are oil facilities on several lots within the project area. This document contains all information available in the public record related to the Negative Declaration as of Tuesday, July 5, 1994 and responds to comments in accordance with Section 15088 of the California Environmental Quality Act (CEQA) Guidelines. This document contains five sections. In addition to this Introduction, these sections are Public Participation and Review, Comments, Responses to Comments, and Appendix. The Public Participation section outlines the methods the City of Huntington Beach has used to provide public review and solicit input on the Negative Declaration. The Comments section contains those written comments received from agencies, groups, organizations, and individuals as of Tuesday, July 5, 1994. PUBLIC PARTICIPATION AND REVIEW The City of Huntington Beach notified all responsible and interested agencies and interested groups, organizations, and individuals that a Negative Declaration had been prepared for the proposed project. The City also used several methods to solicit input during the review period for the preparation of the Negative Declaration. The following is a list of actions taken during the preparation, distribution, and review of the Negative Declaration. 1. A cover letter and copies of the Negative Declaration were filed with the State Clearinghouse on June 1, 1994. The State Clearinghouse assigned Clearinghouse Number 94061004 to the proposed project. A copy of the cover letter and the State Clearinghouse distribution list is available for review and inspection at the City of Huntington Beach, Planning Department, 2000 Main Street, Huntington Beach, California 92648. 2. An official thirty(30) day public review period for the Negative Declaration was established by the State Clearinghouse. It began on Wednesday, June 1, 1994 and ended on Friday, July 1, 1994. Public comment letters were accepted by the City of Huntington Beach through Tuesday, July 5, 1993. 3. Notice of the Negative Declaration was published in the Huntington Beach Independent on Thursday, June 2, 1994. Upon request, copies of the document were distributed to agencies, groups, organizations, and individuals. III. COMMENTS Copies of all written comments received as of Tuesday, July 5, 1994 are contained in Appendix A of this document. All comments have been numbered and are listed on the following pages. All comments from letters received have been retyped verbatim in a comment-response format for clarity. Responses to Comments for each comment which raised an environmental issue are contained in this document. IV. RESPONSE TO COMMENTS The Negative Declaration No. 94-7 was distributed to responsible agencies, interested groups, organizations, and individuals. The report was made available for public review and comment for a period of thirty (30) days. The public review period for the Negative Declaration established by the City commenced on June 1, 1994. Copies of all documents received as of July 5, 1994 are contained in Appendix A of this report. Comments have been numbered with responses correspondingly numbered. Responses are presented for each comment which raised a significant environmental issue. Several comments to not address the completeness or adequacy of the Negative Declaration, do not raise significant environmental issues, or request additional information. A substantive response to such comments is not appropriate within the context of the California Environmental Quality Act (CEQA). Such comments are responded to with a "comment acknowledged" reference. This indicates that the comment will be forwarded to all appropriate decision makers for their review and consideration. NEGATIVE DECLARATION NO. 94-7 APPENDIX A RESPONSE TO COMMENTS NEGATIVE DECLARATION NO. 94-7 DOC-1: Comment: The Department of Conservation's Division of Oil, Gas,and Geothermal Resources(Division)has reviewed the Negative Declaration for the proposed project and submits the following comments for your consideration. Response: Comment states receipt and review of Negative Declaration, and does not require any substantive response. DOC-2: Comment: The project is located in the Huntington Beach oil field. Our records show several active and abandoned oil wells within and in close proximity to the proposed site. To ensure proper review of building projects within the subject area,the Division has available an informational packet entitled,"Construction Project Site Review and Well Abandonment Procedure." The packet outlines the information that a project developer must submit to the Division for review. Developers should contact the local building department for a copy of the site review packet. Response: Comment describes oil wells within the project site,and information available regarding construction and well abandonment procedures. Comment acknowledged and will be forwarded to decision makers for consideration prior to action on the project. DOC-3: Comment: If any structure is to be located over or in the proximity of a previously plugged and abandoned well,there is the possibility that the well may need to be plugged and abandoned to current Division specifications. Section 3208.1 of the Public Resources Code authorizes the State Oil and Gas Supervisor to order the plugging and reabandonment of any previously plugged and abandoned well when construction of any structure over or in the proximity of the well could result in a hazard. The cost of plugging and reabandonment operation is the responsibility of the owner of the property upon which the structure will be located. If a well requiring plugging and reabandonment is on an adjacent property and near the common property line, the Division recommends that the structure be set back sufficiently to allow future access to the well. Response: Statement explains the potential for plugging or reabandoning previously abandoned/capped wells at the discretion of the State Oil and Gas Supervisor. Comment acknowledged and will be forwarded to decision makers for consideration prior to action on the project. DOC-4: Comment: Furthermore, if any plugged and abandoned or unrecorded wells are damaged or uncovered during excavation or grading, remedial plugging operations may be required. If such damage or discovery occurs,the Division's district office in Long Beach must be contacted to obtain information on the requirements for and approval to perform remedial operations. Response: Statement describes the proper procedure for notifying the Long Beach District office if any plugged,abandoned or unrecorded wells are damaged or uncovered during excavation or grading. Comment acknowledged and will be forwarded to decision makers for consideration prior to action on the project. DOC-5: Comment: Although the possibility for future problems from oil and gas wells that have been plugged and abandoned or reabandoned to the Division's current specifications are remote,we, nevertheless, suggest that a diligent effort be made to avoid building over any plugged and abandoned well. If construction over an abandoned well is unavoidable,we suggest that an adequate gas venting system be placed over the well. DOC-6: Comment: Prior to commencing operations,the project applicant should consult with the Long Beach Division office for information on the wells located in the project area. DOC-7: Comment: Methane gas can accumulate beneath developed areas where concrete and asphalt surfaces prevent the natural migration of the methane gas to the atmosphere. If this occurs,and a crack develops in the concrete or asphalt at some later time,the gas could migrate into the interior of the overlying structure and create the potential for an explosion or fire. Therefore,gas detectors,gas migration barriers,or venting systems should also be considered.
