There is a problem in that the change was not at my suggestion but was directed by motion of the City Council at the time of adoption. At that time it seemed that it should have gone back for a first reading as amended. However, the motion was made to adopt with the deletion of 169 and the new wording added. The City Clerk's Office is not able to certify this ordinance without written authorization from the City Attorney allowing the wording to remain and discounting the motion made by City Council. I remember at the meeting it was suggested that adoption be delayed until the wording could be clarified but as this was not done the City Clerk's Office cannot certify an ordinance that does not conform with a Council adopted motion. Even though it might be very clear that the original wording is correct. That fact needs to be in written form for the City Clerk's records. AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE, SECTION 9300(d)-SEACLIFF SPECIFIC PLAN (CODE AMENDMENT NO. 91-7) WHEREAS, after notice duly given pursuant to Government Code Section 65500, the Planning Commission and City Council of the City of Huntington Beach have held separate public hearings on Code Amendment No . 91-7 (Seacliff Specific Plan) and Negative Declaration No . 90-28; and Amendment of the Seacliff Specific Plan, located southeasterly of current terminus of Seapoint Avenue, attached hereto and incorporated herein as Exhibit A, is the most desirable method of providing regulated development of the area included within the Specific Plan and is in accord with the objectives set out in such Specific Plan; and On 1992, after duly given notice, a hearing was held before this Council on Code Amendment No . 91-7 (Seacliff Specific Plan) and Negative Declaration No . 90-28, and the Council finds that incorporation of Tentative Tract Map No. 14277 into the Specific Plan is necessary for the orderly, regulated development of real property included within the immediate area, and finds that the policies and procedures set out in the Specific Plan._are satisfactory and in agreement with the general concept as set out in the City' s General Plan, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. Section 9300(d) of the Huntington Beach Ordinance Code is hereby amended to read as follows : Section 9300(d) . Seacliff Specific Plan SECTION 2. Section C (14) Recreation Open Space Replacement of the Seacliff Specific Plan is repealed. SECTION 3 . Statement Requirements — A detailed statement shall also be included containing the following information: (a) Distance from the property to any known geological hazard; (b) Gross area within the blue line border (area boundary) of the tentative map; (c) Net lot area (i.e., gross area minus all public and private streets); (d) Number and type of units and number of bedrooms; (e) Total number of units and bedrooms per gross acre; (f) Floor area of each unit; (g) Percentage of site coverage of all buildings; (h) Number and type of covered parking spaces; (1) Amount of usable common open and recreational space provided; (j) Types of recreation facilities proposed; and (k) Schedule and sequence of development if proposed in phases. 7. Approval Period — Notwithstanding the provisions of Article 984, Conditional Use Permits, each Conditional Use Permit authorized under this Article shall become null and void within two (2) years, unless a final tract map has been recorded with the County Recorder's Office on any portion of the approved plans within such two (2) year period. Extensions of time may be granted pursuant to the provisions for extending approval of the tentative tract map. 4 Appendix Appendix A 9110--9110.1 Article 911 LOW-DENSITY RESIDENTIAL DISTRICT (Rl) Sections: 9110 General provisions. 9110.1 Permitted uses. 9110.2 Minimum parcel size/frontage. 9110.3 Maximum density/intensity. 9110.4 Maximum building height. 9110.5 Maximum site coverage. 9110.6 Setback (front yard) . 9110.7 Setback (side yard) . 9110.8 Setback (rear yard) . 9110.9 Open space. 9110.10 Parking . 9110.11 Miscellaneous requirements. 9110 General provisions. The low density residential district R1 is intended to be the most restrictive resi- dential zone in terms of population density and in the re- quirements for light, air, ventilation, and open space for each individual lot. (Ord. 2837, 16 Jul 86) 9110.1 Permitted uses. The following subsections list permitted uses and the approval process for each one: (a) Building permit. Single family dwellings and acces- sory buildings which are permanently located on a parcel shall be subject to the issuance of a building permit. Tents, trailers, vehicles, or temporary structures shall not be used for dwelling purposes. (b) Plan review. Zero side or rear yard setbacks shall be subject to plan review approval by the director pursuant to section 9110.8(a) . (c) Conditional use 2ermit. The following uses may be permitted subject to the approval of a conditional use permit by the planning commission: ( 1) Planned residential developments pursuant to Article 915. 8/87 i 9110.2 ( 2) Building heights between twenty-five ( 25) and thirty ( 30) feet, and/or third stories pursuant to section 9110.4( a) . ( 3) Unclassified uses pursuant to Article 963. ( 4) Second unit additions pursuant to section 9110. 3. (Ord. 2837, 16 Jul 86) 9110.2 Minimum parcel size/frontage. A licensed land surveyor or civil engineer shall submit calculations showing lot width, depth, and area for any new parcel. ( a) The minimum lot size shall be six thousand ( 61000) square feet. (b) The minimum lot frontage shall be sixty (60) feet; however, the minimum required for cul-de-sac and knuckle lots shall be forty-five (45) feet. Lot frontage shall be calcu- lated as outlined in the Definitions section. (c) Exception for averaging. The minimum lot size may be reduced to five thousand ( 51000) square feet and/or the minimum lot frontage may be reduced to fifty (50) feet if the lot is part of up to six ( 6) contiguous lots under the same ownership at the time of subdivision which, when averaged, meet the mini- mum lot size and frontage requirements. Provided further that none of the lots in the group shall be used to compute the average for any other group of lots. (d) Exceptions for lots created prior to code. (1) An individual lot which does not conform to the minimum lot area or frontage requirement shall be con- sidered a legal building site if it was legally created , prior to the effective date of Ordinance 495 (June 5, 1946) and which since that date has not been held in common ownership with any -other lot with which it could have been merged. ( 2) A parcel of 'Land under one ownership consisting of two ( 2) or more lots with less than five thousand ( 5,000) square feet each, if legally created prior to the effective date of Ordinance 495 (June 5, 1946) shall be considered a legal building site if the total square footage of the lots is a minimum of five thousand ( 5,000) square feet and the parcel abuts a dedicated street or vehicular easement. (Ord. 2837, 16 Jul 86) 8/87 f• I9110.3 h 9110.3 Maximum density/intensity. The maximum density shall not exceed one M dwellingunit per lot. Exception: a second unit may be added to an existing single family residence upon approval of a conditional use permit subject to the following standards: (a) The applicant shall be an owner occupant. (b) The minimum lot size shall be six thousand (6,000) square feet. (c) The second unit shall be attached to the main dwelling in such a manner as to create an architecturally unified whole, not resulting in any change to the visible character of the street. The entrance to the second unit shall not be visible from the street in front of the residence. (d) The maximum square footage of the second unit shall be six hundred fifty ( 650) square feet nor shall it exceed one ( 1) bedroom. (e) The second unit shall not be sold separately from the main dwelling. (f) Four ( 4) total on-site parking spaces (nine (9) by nineteen ( 19) feet in size) shall be provided, two ( 2) of which may be unenclosed, uncovered and arranged in tandem with the existing spaces. Unenclosed spaces shall be located on the driveway apron or on a paved area between the driveway and the nearest side property line. Recreational vehicle storage shall not be permitted within any required parking space. (g) The second unit shall comply with all applicable land use regulations of the Huntington Beach Ordinance Code except as specified herein. (h) The park and recreation fee shall be assessed at twenty-five ( 25) percent of the fee for a single family residence as set by resolution of the city council. ( i) No separate utility meters shall be permitted for the second unit. ( j) The following safety and conservation measures for the new unit shall be implemented: 8/87 d 9110.4--9110.5 ( 1) Insulation of accessible attic areas to R-19. ( 2) Weatherstripping of doors and windows. ( 3) Installation of low flow shower heads and faucets certified by the California energy commission. ( 4) Installation of approved smoke detectors. (Ord. 2837, 16 Jul 86) 9110.4 Maximum building height. Maximum building height shall be as follows: Main dwelling Twenty-five (25) feet and maximum two ( 2) stories Accessory building Fifteen (15) feet (a) Exception by conditional use permit. A maximum building height of thirtyfeet and/or three ( 3) stories may be permitted subject to the approval of a conditional use permit. The planning commission shall consider the following guidelines in its decision on such a request : ( 1) The proposed building shall not have a detrimental effect on the general health, safety, welfare or privacy of surrounding residents, or on surrounding property values. ( 2) The location, site plan and building design shall be harmonious and compatible with the streets, driveways, property lines, and surrounding neighborhood. ( 3) The age and anticipated permanence of buildings on adjacent properties shall be considered.* ( 4) The commission shall consider any other criteria it. deems necessary to preserve the health, safety, welfare and convenience of the neighborhood. (Ord. 2837, 16 Jul 86) 9110. 5 Maximum site coverage. Maximum site coverage shall be fifty 50 percent. Site coverage shall be as outlined in the definitions article. Exception: the maximum site coverage shall be fifty-five ( 55) percent for all lots abutting a park, recreation area, 8/87 9110.6--9110. 7 school, public waterway, or flood control or public utility right-of-way which is a minimum of one hundred ( 100) feet in clear width. (Ord. 2837, 16 Jul 86) 9110. 6 Setback (frontyard) . The minimum setback from the front property lines for all structures exceeding forty-two ( 42) inches in height shall be as follows: Dwelling Fifteen ( 15) feet Front entry garage Twenty-two (22) feet or carport Side entry garage Ten ( 10) feet Eaves, fireplaces, Eleven ( 11) feet open, unroofed stair- ways and balconies Accessory Buildings Fifty (50) feet or located within rear one-half of lot Detached garages may be located in front one-half of a lot which does not exceed one hundred fifty (150) feet in length (Ord. 2837, 16 Jul 86) 9110.7 Setback (side ard) . A plan review applica- tion may a approved by the aIrector to permit either a zero side yard setback or a zero rear yard setback (only one zero setback per lot shall be permitted) . The director shall con- sider the overall site plan, building materials, and the finish of the wall constructed on the zero setback property line in reviewing such requests, as well as the following requirements: ( 1) The lot adjacent tb the zero setback side or rear yard shall be held under the same ownership at the time of application and the setback for the adjacent lot shall be either zero or a minimum of ten (10) feet. ( 2) No portion of the dwelling or any architectural features shall project over the property line. ( 3) The zero setback shall not be adjacent to a public or private right-of-way. ( 4) Exposure protection between structures shall be provided as specified by the fire department and building division. (5) The wall located at the zero setback property line shall be constructed of maintenance-free, solid dec- orative masonry for the first floor of the dwelling and of maintenance-free, decorative masonry or masonry veneer with a minimum thickness of two (2) inches for the second story. Decorative construction need not be used on that portion of the wall obscured from view of the adjacent lot by another structure or wall . For a zero side yard set- back, the wall shall intersect the rear property line. For a zero rear yard setback, it shall intersect the side prop- erty lines. ( 6) For parcels designed with one zero side yard setback, the opposite side yard shall be ten (10) feet wide and shall be perpetually maintained free and clear of 8/87 9110. 9 i obstructions other than those specified below: eave encroachment of three ( 3) feet, swimming pools, normal landscaping, removable patio covers which maintain a mini- mum setback of five ( 5) feet from the side property line and/or garden walls and fences which cross said setback provided they are equipped with a gate and are equal in height to the first floor double plate, but not exceeding nine ( 9) feet. (Ord. 2837, 16 Jul 86) 9110.9 open s ace. Open space shall be required in accordance with the following provisions except that lots with a minimum forty ( 40) feet ' of water frontage shall be exempt from any open space requirement. Open space shall be as outlined in the definitions section. ( a) Lots created after March 1969. Any lot recorded after the effective ate of Or nance 1469 (March 19, 1969) shall provide behind the front yard setback a minimum open space area of twelve hundred ( 11200) square feet with no dimension less than twenty-five ( 25) feet. Required open space may be allocated in conformance with one of the following alternatives when a building, struc- ture or fence over forty-two ( 42) inches in height provides a physical separation between the front yard setback and the remainder of the lot: ( 1) One ( 1) area of nine hundred (900) square feet, with no dimension less than twenty-five (25) feet, and an additional three hundred (300) square feet in up to two areas with no dimension less than fifteen (15) feet. ( 2) Two ( 2) areas of six hundred twenty-five ( 625) square feet, with no dimension less than twenty-five ( 25) feet) . (b) Lots created before March 1969. Any lot recorded after the effective date of Ordinance 495 (June 5, 1946) and prior to the effective date of Ordinance 1469 (March 19, 1969) shall provide within the rear two-thirds of the lot a minimum open space area of nine hundred ( 900) square feet with no di- mension less than twenty (20) feet. Required open space may be divided into two .areas of four hundred fifty ( 450) square feet; minimum dimensions remain the same. (c) Lots created before June 1946. Any lot recorded prior to the effective date of Ordinance 495 (June 5, 1946) shall 8/87 i 9110. 10--9110. 11 provide within the rear two-thirds of the lot a minimum open space area of ninety ( 90) square feet for each five (5) feet of lot frontage, not to exceed nine hundred (900) square feet. The required open space may be divided into two areas with no dimension less than fifteen ( 15) feet, plus one ( 1) foot for each five (5) feet of lot frontage over twenty-five ( 25) feet, not to exceed twenty ( 20) feet . (Ord. 2837, 16 Jul 86) 9110. 10 Parking . Parking shall comply with the stand- ards outline outlinqd in Article 960. The parking of motor vehicles, trailers, campers and boats shall be prohibited on all land- scaped areas within the front one-half of the lot. ( a) Oversized vehicles may be parked on private property in all yard areas except in the required front yard setback and in any exterior side yard setback. ( b) Semitrailers, trailers or campers may be parked on the driveway apron or on a paved area between the driveway and the nearest side property line provided that they do not project over any property line and that the area is kept free of trash, debris and parts. (c) Commercial oversized vehicles or special purpose ma- chines shall be prohibited in any yard area. (Ord. 2837, 16 Jul 86) 9110. 11 Miscellaneous requirements. ( a) Accessory buildings. Accessory buildings may be permitted on a lot with a permitted main building. The minimum distance between an accessory building and any other building on the same lot shall be ten ( 10) feet. Setback requirements are as specified in this article. (b) Architectural features. Architectural features, in- cluding eaves, fireplaces, and open, unroofed stairways and balconies shall maintain a minimum distance of five (5) feet from* any portion of any other building on the same lot. Set- back requirements are as specified in this article. (c) Fencing . Fencing shall comply with the standards outlined in t s code. ( d) Projecting decks. Decks on waterfront lots may pro- ject five ( 5) feet beyond the bulkhead or bulkhead line ex- tended provided that side yard setbacks as required for the main dwelling are maintained, and subject to the following re- 8/87 l 9110. 11 quirements and Chapter 17.24 of the Huntington Beach Municipal Code. ( 1) Covers and windscreens. Covers for projecting decks and win screens may be permitted if constructed of light weight materials such as plastic, canvas, fiberglass, tempered glass or metal, except for necessary bracing and framing . The maximum height for windscreens shall be nine ( 9) feet above the finished surface of the deck at the bulkhead line, but not exceeding the height of the second story finished floor. A minimum eighty ( 80) percent of one side of such windscreen shall be open. ( 2) Removal . Decks and windscreens projecting over city property which do not comply with the above provisions may be removed by the city upon thirty ( 30) days written notice. Such projections are declared to be a privilege which can be revoked for noncompliance and not a vested right. (e) Minimum dwelling size. ( 1) The minimum residential floor area shall be one thousand ( 1,000) square feet. ( 2) The minimum width of a residential structure shall be twenty ( 20) feet. The director may approve a re- duction in this requirement for a portion of or addition to the main dwelling. The 2 .4 gross acre parcel is located on the southwest side of Tract 13527, approximately 100 ' south of Doral Drive. The vacant oil island property is zoned R4-01. Robert Franklin, Staff Planner, presented the tract and reported that the project was previously reviewed by the Subdivision Committee at their meeting of Wednesday, September 11, 1991. At the original time of hearing, the project was continued to allow the applicant sufficient time to revise the map based on Subdivision Committee findings and recommendations . Staff stated that the map was revised and meets the recommendations of the Committee and Departments of Fire, Public Works and Community Development. Discussion about the map' s modifications ensued. Fire Department The items below indicate the requirements of the Fire Department, which are a Condition of Approval for development and MUST be complied with prior to issuance of building permits . 1. Specifically, the notices stated that challenges in court will be confined to issues raised at the Planning Commission, whereas the notices should have stated that judicial challenges will be confined to issues raised at the City Council hearing. You have asked whether the numerous public hearings which are affected by this error should be removed from the agenda and renoticed. It is my opinion that the mistake may be corrected by correcting the agenda before you post it and by announcing, at the Council meeting, prior to the public hearings, that future challenges in court, if any, may be limited to the issues presented before the City Council. I will caution you that this is only my opinion and a future court might well disagree with it. Absolute certainty that the effects of the defective notice will be corrected can only be attained by renoticing all of the hearings involved. Should you decide not to renotice and reschedule the hearings in question, the consequences could be that an aggrieved party who later might sue the City would not be limited to raising just those issues raised at the public hearing, but could base the action on any issue legally possible. On balance, I feel that the risk to the City is not as substantial as would be the expense and inconvenience to the public which renoticing would entail. The Commission also recommended approval of Zone Change No. 90-14, a concurrent request to rezone 1.96 acres from R4-01 (High Density Residential-Oil production) to Seacliff Specific Plan; 0.39 acres from ROS-0 (Recreation Open Space-Oil production) to Seacliff Specific Plan; and 0.94 acres from Seacliff Specific Plan to ROS-0 (see attachment no. 7) . The proposals have gone through extensive review by the Planning Commission, Subdivision Committee, neighborhood association, and City staff, in terms of development feasibility, subdivision layout, environmental analysis and potential for additional parks and/or greenbelts . Negative Declaration No. 90-28, approved by the City Council on May 16, 1991, involved a comprehensive environmental analysis for the twelve (12) tracts including Tract No. 14277. The approval of the General Plan Amendment, Zone Change and Code Amendment requests would allow development of up to eleven (11) single family residences on the abandoned oil facility (Island N) . The development proposal was conditionally approved by the Planning Commission on January 28, 1992 with the approval of Tentative Tract Map No. 14277, Conditional Use Permit No. 91-46 and Conditional Exception No. 91-36 . Conditional Use Permit No. 91-46 and a Conditional Exception No. 91-36 (variance) were requests to permit an eleven (11) lot subdivision with a variance to exceed maximum cul-de-sac length. The proposed development would be compatible with the recently constructed Seacliff Estate homes by complying with the adopted Seacliff Specific Plan development standards . Open Space Replacement: The general plan amendment and zone change request involves the redesignation of land currently designated and zoned Recreation Open Space to residential . Due to the loss of property designated Recreation Open Space, staff requested a report be submitted by the applicant identifying areas where the open space would be replaced. The report depicts areas in which land will be rezoned from residential to recreation open space on a one to one (1: 1) ratio. RCA -2- (3055d) Staff has reviewed the report and has concluded that the proposed areas for change in zoning reflect the required acreage necessary for an even replacement. West of Lawn Haven R4-0 1.42 Island Q (portion) R4-01-CZ 0 . 60 4 . 60 RCA -3- (3055d) Land Use Compatibility: The City' s General Plan designates the property north of the subject area as Planned Community with Recreation Open Space surrounding the development. The Planned Community, commonly referred to as Seacliff Estates, is virtually surrounded by the Seacliff Golf Course. The subject property, an abandoned oil island, is currently occupied with the Seacliff Golf Course maintenance facility. The applicant has received Planning Commission approval to relocate the maintenance facility onto another parcel (Island Q) closer to the clubhouse. As illustrated in Attachment No. 1, the subject property has two (2) zoning designations (R4-01 and ROS) . Zoning for property located to the north is Seacliff Specific Plan, while the oil island has a zoning designation of R4-01 (High Density Residential with oil production) . The property surrounding the oil island is zoned (ROS) Recreational Open Space. The applicant ' s request includes the rezoning of the existing access road and oil island to Seacliff Specific Plan, which would be compatible with the existing development to the north. The use of the existing road for access to the proposed tract requires the approval of a conditional exception for cul-de-sac length. Section 9960.2 of the Huntington Beach Ordinance Code permits a cul-de-sac to be a maximum length of 550 feet . The existing road would exceed the limit by 250 feet (800 feet) . The Fire and Police Departments have reviewed the proposal and have concluded that the impacts to fire access and response time can be mitigated by imposing strict conditions on the project . Public Hearing: There were several people who testified at the Planning Commission public hearing on January 28, 1992. The applicant, and representatives from the neighborhood association indicated that all of their concerns had been addressed, and supported the proposal as presented. The representatives of the homeowners association requested added conditions that the new subdivision be completely secured, and that the new property owners pay a supplemental association fee for Tract No. 14277 improvements in addition to the standard association fee. The developer concurred with the added conditions and the Planning Commission imposed them as conditions of approval . RCA -4- (3055d) Environmental Status : This project is covered by Negative Declaration No. 90-28 which was approved by the City Council on May 16, 1991. Negative Declaration No. 90-28 included a comprehensive environmental review on all twelve (12) tracts and addressed all potential impacts on the surrounding community. The issues included emergency response times, completion of Seapointe Avenue, greenbelt areas in upper and lower Seacliff and no net loss of open space (see attachment no. 9) . As a result of the environmental assessment, mitigation measures were approved which will be incorporated into the proposed project . Project Description The applicant requests that a 2.357 acre site located approximately 100 feet south of the intersection of Doral Drive and Morningside Drive be redesignated from an Open Space-Recreation land use designation to a Planned Community land use designation. In addition, the appalicant has requested that a . 936 acre site located northeast and adjacent to Lots 4 through 11, of Tract No. 13821 be redesignated from Planned Community to Open Space-Recreation (see Attachment No. 1-3) . Staff Report - 1/28/92 -3- (2084d) The 2 .357 acre site consists of four (4) sub-areas exhibited on Attachment No. 2. Parcels A and D, on Attachment No. 2, are proposed to be rezoned from Recreation Open Space to Seacliff Specific Plan. Parcel B is proposed to be rezoned from R4-01 to Seacliff Specific Plan, while Parcel C is proposed to be rezoned from R4-01 to Recreation Open Space. The . 936 acre site is proposed to be rezoned from Seacliff Specific Plan to Recreation Open Space. The concurrent development request includes the subdivision of the 2.357 acre area into eleven (11) single family residential lots with access from Doral Drive. The subdivision includes a variance request for cul-de-sac length (800 feet in lieu of 550 feet) . B. Oven Space Replacement The general plan amendment and zone change request involves the redesignation of land currently designated and zoned Recreation Open Space to residential . Due to the loss of property designated Recreation Open Space, staff requested a report be submitted by the applicant identifying areas where the open space would be replaced. The report depicts areas in which land will be rezoned from residential to recreation open space on a one to one (1: 1) ratio. Staff has reviewed the report and has concluded that the proposed areas for change in zoning reflect the required acreage necessary for an even replacement. The requested zone change will result in a net gain of 0.28 acres of open space beyond existing. Staff Report - 1/28/92 -4- (2084d) In addition, the applicant is required to replace 4 . 60 acres of open space previously required in the Seacliff Spacific Plan, as a result of Zone Change No. 88-9 (see Attachment No. 8) . The applicant has proposed to satisfy the requirement by rezoning four (4) areas depicted on Attachment No. 4 and listed below to Recreation Open Sapce: LOCATION EXISTING ZONE ACREAGE North/adjacent to Seacliff Specific Plan 0.94 Seacliff Specific Plan (Attachment No. 3) Palm Ave./west of R2-PD-0-CZ 1. 64 Seacliff C.C. West of Lawn Haven R4-0 1.42 Island Q (portion) R4-01-CZ 0. 60 4 . 60 C. Land Use Compatibility The City' s General Plan designates the property north of the subject area as Planned Community with Recreation Open Space surrounding the development . The Planned Community, commonly referred to as Seacliff Estates, is virtually surrounded by the Seacliff Golf Course. The subject property, an abandoned oil island, is currently occupied with the Seacliff Golf Course maintenance facility. The applicant has received Planning Commission approval to relocate the maintenance facility onto another parcel (Island Q) closer to the clubhouse. As illustrated in Attachment No. 1, the subject property has two (2) zoning designations (R4-01 and ROS) . Zoning for property located to the north is Seacliff Specific Plan, while the oil island has a zoning designation of R4-01 (High Density Residential with oil production) . The property surrounding the oil island is zoned (ROS) Recreational Open Space. The applicant ' s request includes the rezoning of the existing access road and oil island to Seacliff Specific Plan, which would be compatible with the existing development to the north. The use of the existing road for access to the proposed tract requires the approval of a conditional exception for cul-de-sac length. Section 9960.2 of the Huntington Beach Ordinance Code permits a cul-de-sac to be a maximum length of 550 feet. The existing road would exceed the limit by 250 feet (800 feet) . The Fire and Police Departments have reviewed the proposal and have concluded that the impacts of fire access and response time can be mitigated by imposing strict conditions on the project. Staff Report - 1/28/92 -5- (2084d) D. PUBLIC SERVICES AND UTILITIES Sewers The subject property is within Orange County Sanitation District (OCSD) No. 11. Previous planning by the OCSD is constent with the proposed use. Adequate capacity is available in district lines to serve the project. According to the OCSD, the sewage generated from this site drains toward the 54-inch Coast Trunk Sewer facility at the intersection of Goldenwest and Orange. Wastewater generated within the Districts service is processed at treatment plants located in Fountain Valley and Huntington Beach. Water The City of Huntington Beach Water Division is only able to furnish the minimum level of water supply to serve the proposed development ' s fire and domestic needs. The Developer will be responsible for payment of fees adopted in the upcoming Water Division Financial Master Plan, if adopted prior to recordation. Storm Drains The City' s Deparment of Public Works has indicated that the existing storm drain system at Doral Drive can adequately accomodate runoff from the proposed land use. Any proposed runoff onto the golf course shall require the approval of the Seacliff Country Club. Police and Fire Protection: Police service for the area of concern is provided by the City of Huntington Beach which operates from a central facility located at Main Street and Yorktown Avenue. The proposal will not require additional manpower or other resources. Response time for emergency calls to this area is under five (5) minutes . Fire protection for the subject area can be provided by the City of Huntington Beach from either the Lake or Gothard Fire Stations. The area of concern lies outside the five minute response area of the stations . Therefore, the Fire Department has requested conditions be imposed to aide in fire protection. These measures may include comprehensive built-in fire protection and alarm systems, including a sprinkler system in all structures, contribution to the Opticom traffic control system, and the requirement that the connection between Seapoint Avenue and Garfield Avenue occur prior to issuance of any permits . The connection of Seapoint Avenue to Garfield Avenue is anticipated to occur by May of 1992 based on the approved Holly-Seacliff Development Agreement, Phase I Street Improvements. Staff Report - 1/28/92 -6- (2084d) Parks The subject property is located within the service area of the proposed Bolsa Chica Linear Park, a 108 acre regional park located west of Seapoint Avenue, ranging from Central park to Pacific Coast Highway. Currently, the recreation facilities available to all of Seacliff are on the east side of Goldenwest, at the City Gym and Pool . Schools The subject property is located within the Huntington Beach City School District and is served by Smith Elementary School, Dwyer Middle School, and Huntington Beach High School. The number of students generated from a Planned Community land use alternative (approximately 7 units/acre) would be minimal and could be accommodated by the school district. Gas Natural gas service is provided by the Southern California Gas Company. The gas company has indicated that the proposed project could be adequately served by existing gas lines. It should be noted that since the gas company is a public utility and is under the jurisdiction of federal and state regulatory agencies, gas supply may be affected by the overall availability of natural gas and by federal and state regulatory policies. Electric The Southern California Edison company has indicated that the subject property is located within the company' s service area. According to the Edison Company, the electric loads of the proposed land use are within the parameters of the overall projected load growth. Solid Waste Disposal The Rainbow Disposal Company provides solid waste collection to the City of Huntington Beach. No local service constraints are expected to occur with the proposed development. E. KEY ENVIRONMENTAL ISSUES i Negative Declaration No. 90-28 was approved for this project, as well as the other Seacliff Tracts on May 16, 1991. The following issues were analyzed by the Negative Declaration in regard to this project. Staff Report - 1/28/92 -7- (2084d) Air Ouality Development of the proposed project may indirectly generate automotive and off-site energy generation emissions in the Huntington Beach region by establishing a use on a vacant site. These emissions may incrementally contribute to the degradation of local air quality. However, the project' s contribution is not anticipated to be significant. Seismic. Soils and Geology In compliance with Alquist-Priolo Geologic Hazards Zones Act of 1972, a Special Studies Zone has been established in Huntington Beach that includes the most hazardous earthquake faults. The project area does not fall into this special studies zone, thus development need not be subject to the zones requirements . The subject property is located on a portion of the Huntington Beach Mesa which is considered to be regionally subsiding. All subsidence and seismic issues will be addressed through standard conditions of approval which require compliance with state and local regulations which include submittal of soils and seismic studies and implementation of all recommendations contained therein. Light and Glare Any development on the subject property would result in new light sources on the site. In effect, increased general nighttime illumination would be generated in the area. The initial study conducted by staff indicated that due to existing ambient light levels in the area, the slight increase in light and glare is not anticipated to be significant; furthermore, implementation of standard conditions of approval requiring directing of lighting away from adjacent properties will mitigate any adverse impacts . Water Slight increases in surface runoff will occur due to the ' overcovering of the site with impervious surfaces . However, through the implementation of standard conditions of approval which require submittal and approval of grading plans and hydrology studies, impacts are not anticipated to be significant. Human Health The project site has had a great deal of oil development, however, the abandonment of oil wells and efforts to clean up the site shall be in accordance with state and city regulations . In addition, the site is located within the methane district. With implementation of standard conditions of approval which require sampling and monitoring for methane, no signifcant impacts are anticipated. Staff Report - 1/28/92 -8- (2084d) 10. 0 RECOMMENDATION: Staff recommends that the Planning Commission approve General Plan Amendment No. 90-7 by adopting Planning Commission Resolution No. 1461 and forward it to the City Council for adoption and approve Zone Change No. 90-14, Code Amendment No. 91-7, Tentative Tract Map No. 14277, Conditional Use Permit No. 91-46 and Conditional Exception (Variance) No. 91-36 with the following findings and suggested conditions of approval: FINDINGS FOR APPROVAL - ZONE CHANGE NO, 90-14 : 1. The proposed zone change from R4-01, and ROS-0 to Seacliff Specific Plan is consistent with the goals and policies of the General Plan and consistent with General Plan Amendment No. 90-7. 2 . Zone change no. 90-14 from R4-01 and ROS-0 to Seacliff Specific Plan is consistent with the goals and policies within the Housing Element. 3 . The proposed zone change with mitigation measures would facilitate designs aesthetically compatible with the surrounding residential area located to the north. FINDINGS FOR APPROVAL - CODE AMENDMENT NO. 91-7: 1. Code Amendment No. 91-7 to incorporate Tentative Tract Map No. 14277 into the Seacliff Specific Plan is consistent with the goals and policies of the General Plan because it proposes similar product types as surrounding area. 2 . Code Amendment No. 91-7 to incorporate Tentative Tract Map No. 14277 into the Seacliff Specific Plan will provide regulated development compatible with existing development in the immediate vicinity. FINDINGS FOR APPROVAL - TENTATIVE TRACT MAP NO. 14277: 1. The size, depth, frontage, street width, and other design features of the proposed subdivision for Tentative Tract Map No. 14277 are in compliance with the standard plans and specifications on file with the city as well as in compliance with the State Subdivision Map Act and the supplemental City Subdivision Ordinance. 2 . The site is relatively flat and physically suitable for the proposed density of 4 . 6 units per gross acre. 3 . Tentative Tract Map No. 14277 for an 11 lot subdivision is consistent with the goals and policies of the Huntington Beach General Plan. Staff Report - 1/28/92 -9- (2084d) � I FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 91-46 : 1. The location, site layout, and design of the proposed 11 lot subdivision does properly adapt the proposed structures and uses in a harmonious manner. The access to the project site and the building height and bulk are compatible with the adjacent structures . 2. The proposed 11 lot subdivision is compatible with surrounding properties in terms of architecture and orientation. 3 . The access to and parking for the proposed 11 lot subdivision does not create an undue traffic problem. The access point for the subdivision and the minimum code required parking provides improved on-site and off-site circulation and adequate parking. 4 . Conditional Use Permit No. 91-46 for a 11 lot subdivision is consistent with the goals and objectives of the City' s General Plan and land use map designation. The intent of the land use designation and zoning (Seacliff Specific Plan) is to provide a better living environment and promote aesthetically pleasing development. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 91-36 : 1. The granting of Conditional Exception (Variance) No. 91-36 to exceed maximum cul-de-sac length by 250 feet (800 feet in lieu of 550 feet) will not be materially detrimental to the public safety and welfare as access to the project site is only available from Doral Drive. 2 . The granting of Conditional Exception (Variance) No. 91-36 to exceed maximum cul-de-sac length by 250 feet will not adversely affect the General Plan of the City of Huntington Beach. CONDITIONS OF APPROVAL - TENTATIVE TRACT MAP NO. 14277: ''• 1. The tentative tract map received and dated January 23, 1992, shall be the approved layout. 2 . No permits shall be issued until the connection of Seapoint Avenue and Garfield Avenue is completed and open for traffic. 3 . The sewer, storm drain and water system, and appurtenances, shall be dedicated to the City of Huntington Beach. 4 . Installation of fire hydrants shall be required prior to combustible construction. 5 . Oil wells and facilities shall be abandoned pursuant to Huntington Beach Fire Codes and City Specifications No. 422 and 431. Staff Report - 1/28/92 -10- (2084d) i 1 6 . Methane barriers and protection shall be installed pursuant to Huntington Beach Fire Department City Specification No. 429 . ; 7. The developer shall submit water improvement plans on a separate utility plan showing service connections to all lots, fire hydrants and other appurtenances in accordance with applicable U.P.C. Sections, ordinances had Public Works Standards. These plans shall be approved by the Public Works Water Division. 8 . The developer will be responsible for the payment of the Traffic Impact Fees at the time of final inspection. 9 . The water system shall be installed per the Public Works Department ' s standards, ordinances and policies . 10 . The water main shall be looped with two (2) connections. 11. Waterline easements shall be required for any portion of watermain outside of the tract boundary. 1 12. A sewer study shall be submitted for Public Works approval. The developer shall design and construct the on-site and off-site sewer system required to serve the development. 13 . Golf Course approval shall be required for drainage purposes . 14 . The transition street shall be a minimum twenty-four (24) feet in width, and designated as a fire lane with signage and red curbs . 15 . Street width shall be forty feet (40 ' ) curb to curb. 16 . Cul-de-sac width shall be a minimum eighty feet (80 ' ) curb to curb. 17. Prior to issuance of building permits, the final tract map shall be accepted by the City Council, recorded with Orange County Recorder and a copy filed with the Department of Community Development. 18 . The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 19 . All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off-site facility equipped to handle them. i 20 . Comply with the mitigation measures contained in Negative Declaration No. 90-28 . Staff Report - 1/28/92 -11- (2084d) 21. During construction, the applicant shall : a. Use low sulfur fuel for construction equipment; b. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts) ; and c. Discontinue construction during second staff smog alerts. 22 . Construction shall be limited to Monday - Saturday 7: 00 AM to 8 : 00 PM. Construction shall be prohibited Sundays and Federal holidays . 23 . Tentative Tract Map No. 14277 shall not become effective until General Plan Amendment No. 90-7, Zone Change No. 90-14 and Code Amendment No. 91-7 have been approved by the City Council and in effect . 11. 0 ALTERNATIVE ACTION: 1. The Planning Commission may recommend to City Council denial of General Plan Amendment No. 90-7, Zone Change No. 90-14 , Tentative Tract Map No. 14277, Code Amendment No. 91-7, Conditional Use Permit No. 91-46, and Conditional Exception (Variance) No. 91-36 with findings. 2 . The Planning Commission may approve General Plan Amendment No. 90-7, Zone Change No. 90-14, Code Amendment 91-7 and modify Tentative Tract Map No. 14277 with findings. Terms not described der this section shall be subject to the definitions contained in Article �j the Huntington Beach Municipal Code. 1. Gramme diacent Ground Elevation) - is the lowest point of elevation of the finished surface of the ground, paving or sidewalk within the area between the building and the property line or, when the property line is more than five (5) feet from the building, between the building and a line five (5) feet from the building. 2. Height of Building - is the vertical distance above a reference datum measured to the highest point of the average height of the highest gable of a pitched or hipped roof. The reference datum shall be selected by the elevation of the highest adjoining sidewalk or ground surface within a 5-foot horizontal distance of the exterior wall of the building. 3. Building Setback - shall be that dimension as measured from a specific object to an adjoining or referenced property line. 4. Property Line - Not to be confused with easement or setback lines, it is that line referenced in the grant deed as the fee boundary. I . General Provisions C. GENERAL PROVISIONS 1. Access/Circulation - Ingress and egress to and from the site shall be provided at the locations shown on Exhibit C. All internal streets and drives shall be privately owned and maintained. The standards for such streets and drives, including width and construction, shall comply with City standards, and conform to the requirements of this Article. Street layout shall conform with Exhibit C. 2. Traffic Control - The Planning Commission shall determine the need for traffic control devices (i.e. traffic signals). Such determination shall include the appropriate time of installation. The developer shall pay the entire cost of installing traffic control devices. The developer shall provide for the future installation of any such improvements prior to Issuance of building permits. 3. Fire Protection - All fire protection, appliances, appurtenances, emergency access and other applicable requirements pursuant to Chapter 17.56 of the Huntington Beach Municipal Code shall meet the standard plans and specifications on file with the Fire Department. A fire hydrant system shall be Installed to provide adequate fire flow. The adequacy of such system shall be approved by the fire marshal after review of plans and engineering calculations have been submitted. Plans shall be submitted and approved prior to the issuance of building permits, and the fire hydrant system shall be in operation prior to the time of construction with any combustible materials. 4. Street lights - The developer shall install lighting on all vehicular access ways. A street lighting plan shall be submitted for approval to the Director of Development Services and Public Works Department prior to issuance of building permits. Such lighting shall be energy efficient. 5. Cable T.V. - No exterior television antenna shall be permitted. A common antenna with underground cable service to all dwelling units shall be provided. 6. Sewer and Water Systems - Sewer and water systems shall be designed to City standards. Such systems shall be located within streets, alleys or drives. Sewer facilities shall be privately maintained. 7. Drainage System - Drainage system shall be designed to City standards. Drainage shall be privately maintained. 8 8. Geologv/Soils - Submittal of a soils study detailing grading and site preparation recommendations is required. This study shall be subject to the approval of the Departments of Public works and Development Services. Grading and site preparation shall be accomplished in accordance with recommendations presented in the soils study. 9. Street Trees - Street trees along SeaPoint Avenue shall be provided pursuant to City standards. The landscaping shall be continued on SeaPoint Avenue as previously approved and maintained by the homeowners association. 10. Common Omen SQace - Common open space is not a requirement of this Specific Plan. If the developer chooses to provide common open space, then the site plan must designate the area of such open space. A landscape plan must be submitted and approved by the Director of Development Services prior to approval of the final map. If common open space is provided, it shall be guaranteed by a restrictive covenant describing the open space and its maintenance and improvement, running with the land for the benefit of residents of the development. The developer shall file with the Department of Development Services for recordation with the final subdivision map, legal documents wh1ch will provide for restricting the use of common spaces for the designated purpose, as approved on the final development plan. All lands to be conveyed to the homeowner's association shall be subject to the right of the grantee or grantees to enforce maintenance and Improvements of the common space. 11. Project Signs - All signz,in t:n1e development shall conform to applicable provisions of Artigleee 96$ of the Huntington Beach Ordinance Code. The developer shall i tsCall on-site street name signs at the intersections of access ways, as approved by the Director of Public Works. Homeowner's Association - Approval of all development proposals shall be subject to,submission of a legal instrument or instruments setting forth a plan or manner of permanent care and maintenance of open spaces, recreational areas. and community facilities. No such instrument shall be acceptable until approved by the City Attorney as to legal form and effect, and by the Director of Development Services as to suitability for the proposed use of the open space areas. If the common open spaces are to be conveyed to a homeowners' association, the developer shall file a Declaration of Covenants to be submitted with the application for approval, that will govern the association. (a) The homeowners' association shall be established prior to the sale of the last dwelling unit. (b) Membership shall be mandatory for each buyer and any successive buyer. (c) The open space restrictions shall be permanent. (d) Provisions to prohibit parking upon other than approved and developed parking spaces shall be written into the covenants, conditions, and restrictions for each project. (e) If the development is constructed in increments or phases which require one or more final maps, reciprocal covenants, conditions, and restrictions and reciprocal management and maintenance agreements shall be established which will cause a merging of increments as they are completed, and embody one homeowners' association with common areas for the total development. 13. Standards Entitlements Required . I1 D. RESIDENTIAL DEVELOPMENT STANDARDS 1. Permitted Uses - The following represent the permitted uses within the Specific Plan area: (a) Single family detached dwelling units, maximum one (1) dwelling unit per lot. (b) Maximum number of units permissible shall be 164 detached units. 2. Minimum Lot Size/Frontage - (a) Minimum lot size shall be 5,000 square feet. (b) Minimum lot frontage shall be 50 feet except for cul-de-sac and knuckle lots, which have minimum lot frontages of 35 feet. 3. Density Requirements - (a) Maximum one (1) dwelling unit per lot. 4. Maximum Building Height - The main dwelling building height shall be: Main dwelling - Twenty-five (26) feet and two-story maximum. Accessory building - Eight (8) feet. 5. Front Yard Setback - For all structures exceeding 42 inches in height, the minimum setback from the front property line shall be as follows: (a) Main dwelling - 20 feet (b) Architectural features such as archways, roof projections, decks, balconies, lattice type patio covers and walls exceeding 42" in height - 15 feet. (c) Front entry garage - 20 feet. Garages shall be provided with a roll-up type garage door. (d) Side entry garage - 10 feet (e) Accessory buildings - 50 feet or rear one-half of lot, whichever is greater. 6. Side Yard Setback - (a) Interior side yard - The minimum setback from Interior side yard property lines for dwelling, garage and accessory buildings is 5 feet. Setback for fireplaces is 30 inches. (b) Exterior side yard - The minimum setback from exterior side yard property lines for dwelling, garage (except front entry garages) and accessory buildings is 10 feet. Front entry garages shall be provided with minimum 20 foot setback and with roll-up garage doors. Setback for fireplaces is 7 feet. 12 7. Rear Yard Setback - The minimum setback from the rear property line for structures,in excess of 42 inches in height shall be as follows: (a) Main dwelling - 15 feet. (b) Architectural features such as archways, roof projections, decks, balconies, lattice type patio covers - 10 feet. (c) Accessory buildings - 10 feet. 8. Private Open Space - Any lot shall provide a minimum open space of 1,000 square feet. Said areas to be behind a 15 foot front yard setback line with no dimension less than 15 feet. Patios with a minimum 5046 open lattice type cover may be Included as open space. 9. Parking - A minimum two-car garage shall be provided per dwelling unit. 10. Accessory BulldinZs - Accessory buildings may be placed on any lot with a permitted main building. The minimum distance between an accessory building and any other building on the same lot shall be ten (10) feet. Accessory buildings shall not be located closer than 5 feet to any property line. 11. Building BuIXl§jreet Scenes - The following design standards are recommended for controlling building bulk and street scene: (a) Building exteriors shall be provided with offsets in the building line to provide variation; and (b) Building rooflines shall be designed so as to provide variation; and (c) Configuration of front court walls shall be varied from unit to unit; and (d) Garages shall be set back at varying distances from the right-of- way when possible; and 12. Appearance Standards - The following standards shall be considered by the Planning Commission when reviewing a development proposal: (a) Architectural features and general appearance of the proposed development shall enhance the orderly and harmonious development of the area or the community as a whole. (b) Architectural features and complementary colors shall be incorporated into the design of all vertical exterior surfaces of the buildings in order to create an aesthetically pleasing project. 13 E. ENTITLEMENTS REQUIRED 1. Application Procedure — Any request for a development proposal shall be accompanied by an application for a Conditional Use Permit. Any request for subdivision or resubdivision of any parcel shall also be accompanied by a Tentative Tract Map. Such applications shall include preliminary site plans, floor and elevation plans, and a statement of statistics. All plans shall be submitted concurrently and shall meet the following requirements. 2. Conditional Use Permit — Any proposed development within the Specific Plan area shall be subject to the approval of a conditional use permit as provided in Article 984 of the Huntington Beach Ordinance Code. 3. Site Plan — Site plans shall include the following: (a) Location of all proposed structures; (b) Location of pedestrian walkways; (c) Circulation pattern of vehicular traffic; (d) Structural street sections of all access ways; (e) Use of common open space areas. 4. Floor and Elevation Plan Requirements — Floor and elevation plans shall Indicate the following: (a) Proposed exterior materials to be used on all structures; (b) Colors of all exterior materials; (c) Height of all buildings; and (d) Energy sources proposed for heating and cooling of all buildings. 5.
