Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2011-29 declaring the disposition of surplus property and approve Quitclaim Deed to release City's interest in said property adjacent to 7742 Glencoe Avenue Statement of Issue: Resolution No. 2011-29 and Quitclaim Deed for a five foot wide (639 square feet) strip of public right-of-way on the east side of Silver Lane is being submitted for City Council adoption and approval. City staff has determined that City does not have use or need for this property and, therefore, recommends that it is in the public's best interest to quitclaim this portion of the public right-of-way to the adjacent owner located at 7742 Glencoe Avenue. Financial Impact: No funds required for this action. Recommended Action: Motion to: A) Adopt Resolution No. 2011-29, "A Resolution of the City Council of the City of Huntington Beach Declaring the Disposition of Certain Surplus Property," and authorize the Mayor and City Clerk to execute; and, B) Approve the subject Quitclaim Deed, and authorize the Mayor and City Clerk to execute' on behalf of the City of Huntington Beach. The right-of-way was dedicated to the County in 1932, for roadway purposes, by the adjacent property owner at the time. The land was subsequently transferred through annexation 'of County land to the City in' 1951. Public Works and other City department staff have confirmed that the City does not have any use or need for the property and, therefore, recommend that it is in the public's best interest to quitclaim this portion of the public right-of-way to the adjacent owner located at 7742 Glencoe Avenue. Pursuant to Government Code 54221, the land is exempt from any surplus land requirements and, therefore, it is not necessary to notify other public agencies. The action would relieve the City of any future maintenance costs, since the adjacent property owner, (Comer Family Trust) would assume all future liability and maintenance expenses for the property. Staff has reviewed the parcel and determined that because of its location and size, the parcel cannot be developed; thus, the cost to appraise the property does not justify the expense of the appraisal. Additionally, Chapter 3.06 of the Huntington Beach Municipal Code allows the City Council to determine that disposition of surplus real property to the adjacent owners is in the public's interest. Staff recommends that the City Council adopt a resolution declaring the property surplus and approve the transfer of said property via a quitclaim deed to the adjacent property owner, Comer Family Trust. Public Works Commission Action: Not required. Environmental Status: The recommended action is a ministerial act, and is exempt from the requirements of the California Environmental Quality Act, pursuant to State CEQA Guidelines, California Administrative Code, Title 14, Chapter 3, Section 15268(b). NNIFER MCGRAT , City Attorney /K Attachment as above c: Joan Flynn, City Clerk Fred Wilson, City Manager COMMUNICATION MeeUng Gate Agenda Item Igo. _ (Q 63507 RESOLUTION NO. 2011-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING THE DISPOSITION OF CERTAIN SURPLUS PROPERTY WHEREAS, the City of Huntington Beach is the owne of certain real property more particularly set forth in Exhibit A which is attached heret and incorporated by this reference and consists of Assessor's Parcel Number 142-102-0 ; and The City Manager has recommended to this Council that said property be declared Surplus Property("the Surplus Property"); and The City acquired the property as a result, f annexation to the City from the County of Orange; and / Hu ntington Beach Municipal Code Section 3.06.010(b) authorizes the City to dispose of Surplus Property, and sets out the procedures therefore, NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: y 1. That the real property described above is surplus and the public interest and necessity require the disposition thereof. 2. Staff has reviewed the parcel and determined that because of its location and size, the parcel cami be developed and therefore the cost to appraise the property does not justify the expense of the appraisal. e 3. The Surplus Property is to be first offered for sale to the adjacent property owner; if there exists no interest, it then will be made available to the general public through a highest sealed bid process subject to a declared reserve. 5.
