Statement of Issue:
Should the City of Huntington Beach update the various citywide fee schedules to reflect
changes in costs to provide city services?
Funding Source:
No funding is required. Adjustments to General Fund revenue for FY 2007/08 and beyond
are possible and are discussed in the Analysis section.
Recommended Action: Motion to:
1. Conduct a public hearing.
2. Adopt Resolution Number 2007- 58 , "A Resolution of the City Council of the City
of Huntington Beach establishing a citywide user fees schedule and repealing
Resolution No. 2005-74 and all supplemental resolutions thereto."
3. Adopt Resolution Number 2007- 59 , "A Resolution of the City Council of the City
of Huntington Beach establishing a citywide development fees schedule and repealing
Resolution No. 2005-75 and all supplemental resolutions thereto."
4. Adopt Resolution Number 2007- 60 , "A Resolution of the City Council of the City
of Huntington Beach establishing a citywide schedule for charges for facility rentals and
recreation services and repealing Resolution No. 2005-76 and all supplemental
resolutions thereto."

Analysis:
During FY 2004/05, the city contracted with Public Resource Management Group (PRM) to
perform a citywide Cost Recovery Study. On November 21, 2005, City Council reviewed and
approved adjustments to the citywide fee schedule based on the PRM Cost Recovery Study
Findings. Minor adjustments to certain City Clerk and Public Works fees were done
subsequent to this per Council action on August 7, 2006 (Resolution Nos. 2006-46 and
2006-47).
The Finance Department has determined that, since November 2005, the costs involved to
provide various services to residents have increased. In-lieu of a full fee study at this time, a
reasonable index by which to measure the increased cost of services was chosen for setting
proposed fee amounts. The Consumer Price Index (Los Angeles-Riverside-Orange County
All Urban Consumers Index (CPI-U)) represents a widely accepted measure of the average
change in prices over time. The CPI for the period since November 2005 is 5.96%.
Therefore, this is the amount Departments were instructed to use for proposing
recommended fees for FY 2007/08. It should be noted that the Finance Department has
requested in the proposed FY 2007/08 budget to carry out a citywide fee study.
Furthermore, at the August 20, 2007 Council meeting, Council voted to direct staff to modify
the fee schedule to provide a permit fee waiver program for a period of three months that
targets older homes.
The various types of fees are described below as well as in the referenced attachments:
User Fees (Attachment# 1):
Historically, User Fees have been used by the city to recover costs for services directly
benefiting the individual or entity requesting the service. Any costs not recovered through
user fees are paid (subsidized) with proceeds of taxes (e.g., General Fund revenue). Staff
has reviewed the various user fees and has developed recommendations to the City Council
which are summarized in the attached resolution. Upon approval by the City Council, these
fees will be effective September 5, 2007.
Development Fees (Attachment# 2):
Development Fees represent charges to recover costs of city services pertaining to
development. Staff has reviewed these fees and has made recommendations in the
attached resolution. As in the case with user fees, in no situation can these fees exceed the
actual cost of providing them. Further, Council directed staff to modify the fee schedule to
waive permit fees for additions and remodels of homes built prior to 1987, for a three month
period. The specific qualifying language has been added to the appropriate fee schedule.
Upon approval by the City Council, these fees will be in effect November 5, 2007, sixty (60)
days from Council action.
It should be noted that development activity has decreased from prior years' levels.
Therefore, even with the application of a 5.96% increase to many fees, Building and Safety is

projecting no net increase in revenue for FY 2007/08. In addition, the fee waiver program is
estimated to reduce projected revenue by $119,611. The Planning Department will be
presenting their analysis of fees at a subsequent Council study session. Therefore, the
attached Planning Department fee schedule reflects no proposed adjustment in fees at this
time.
Charges for Service (Attachment# 3):
Charges for Service pertain to rates charged for room rentals, recreation classes, and other
charges for service where the city may charge market rates in excess of costs to provide the
service. Staff has developed recommendations to adjust certain charges for service as
reflected in the attached fee schedule. The City Attorney has concluded that these types of
charges are not subject to the same restrictions concerning cost recovery. Upon approval by
the City Council, these fees will be effective September 5, 2007.
Revenue Enhancement:
It is estimated that adoption of the recommended fees could increase revenue to the City by
approximately $354,389. The following table outlines, by department, the estimate of
additional revenue generated through the recommended fees:

*Development activity is anticipated to decrease in FY 2007108, leading to no net gain. In
addition, the three-month fee waiver program discussed at the August 20, 2007 Council
meeting could potentially lead to the loss in revenue indicated.
**When fees were reviewed and adjusted on November 21, 2005, the Fiscal Services
division of the Finance Department was part of the City Treasurer's Office. Fiscal Services
has responsibility for business license and municipal services (i.e., water) among other user
fees. Therefore, the updated citywide fee schedule will reflect this organizational change.
***The Planning Department is currently reviewing their user and development fees.
Separate Staff research on fees will be brought forth for Council review at a later date.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE
USER FEES SCHEDULE AND REPEALING RESOLUTION NO. 2005-74
AND ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, in 2005 the City Council commissioned Public Resource Management
Group, LLC ("PRM") to identify the cost of fee-related services to assure the City was charging
the proper amount of fee for the service. The PRM study determined that labor cost was an
appropriate component of fees based on a fair distribution of all Citywide and departmental
overhead costs as described in the 2005 study across all activities; and
The City Council approved the PRM study in 2005, finding that fees for any service
should include a cost component that can be directly or indirectly associated with the service;
and
City Council now desires to update the current fee schedule until such time as the City
undertakes an analysis similar to the 2005 PRM; and
City Staff has determined that the Consumer Price Index ("CPI") is a well established
statistical estimate of the level of prices of goods and services bought for consumption for
purposes by households. The change in the CPI is a measure of inflation and can be used as a
reasonable indexation or evaluation of the cost of goods and services; and
City Staff has further determined that the CPI Index, for the period of November 2005 to
April 2007 has increased by 5.96%, which is a reasonable calculation of the increase of the
City's overhead costs to provide City services; and
The City Council desires to update existing fees charged to the public and to increase fees
consistent with City Staff s analysis, and impose fees that do not exceed the estimated reasonable
cost of providing the service for which the fees are imposed,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach as follows:
1. The fees set forth in Exhibit "A" and adopted by this Resolution shall be effective
immediately following the adoption of this Resolution, and continue thereafter.
2. The City Council hereby determines that the CPI for the period since November,
2005 is 5.96% and is an accurate reflection of the increased departmental overhead costs
incurred by the City to provide the City services included in Exhibit A.

RESOLUTION NO. 2007-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE
DEVELOPMENT FEES SCHEDULE AND REPEALING
RESOLUTION NO. 2005-75 AND ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, in 2005 the City Council commissioned Public Resource Management
Group, LLC ("PRM") to identify the cost of fee-related services to assure the City was charging
the proper amount of fee for the service. The PRM study determined that labor cost was an
appropriate component of fees based on a fair distribution of all Citywide and departmental
overhead costs as described in the 2005 study across all activities; and
The City Council approved the PRM study in 2005, finding that fees for any service
should include a cost component that can be directly or indirectly associated with the service;
and
City Council now desires to update the current fee schedule until such time as the City
undertakes an analysis similar to the 2005 PRM; and
City Staff has determined that the Consumer Price Index ("CPI") is a well established
statistical estimate of the level of prices of goods and services bought for consumption for
purposes by households. The change in the CPI is a measure of inflation and can be used as a
reasonable indexation or evaluation of the cost of goods and services; and
City Staff has further determined that the CPI Index, for the period of November 2005 to
April 2007 has increased by 5.96%, which is a reasonable calculation of the increase of the
City's overhead costs to provide City services; and
The City Council desires to update existing fees charged to the public and to increase fees
consistent with City Staff's analysis, and impose fees that do not exceed the estimated reasonable
cost of providing the service for which the fees are imposed,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach as follows:
l. The fees set forth in Exhibit "A" and adopted by this Resolution shall be effective
sixty(60) days following the adoption of this Resolution, and continue thereafter.
2. The City Council hereby determines that the CPI for the period since November,
2005 is 5.96% and is an accurate reflection of the increased departmental overhead costs
incurred by the City to provide the City services included in Exhibit A.

Resolution No. 2005-75 is hereby repealed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING A CITYWIDE
SCHEDULE FOR CHARGES FOR FACILITY RENTALS AND
RECREATION SERVICES AND REPEALING RESOLUTION 2005-76
AND ALL SUPPLEMENTAL RESOLUTIONS THERETO
WHEREAS, the City imposes a charge on public access and use of certain City property for
the purpose of raising revenue; and
The City Council desires to state new charges and update the existing amounts currently
charged to the public for access and use of City property,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington
Beach that the fees set forth in Exhibit"A" and adopted by this Resolution shall become effective
on the date this Resolution is adopted, and continue thereafter.
BE IT FURTHER RESOLVED that Resolution No. 2005-76 and all supplemental
resolutions thereto are hereby repealed.

1. Open the Public Hearing on the proposed fiscal year 2007/2008 City Budget appropriation
of$330,280,906 as outlined in the proposed budget document and all revisions contained in
the Exhibits of the Budget Resolution, including the sewer service user charge which shall be
adjusted to reflect the annual percentage adjustment.

2. Adopt Resolution No. 2007-55, "A Resolution of the City Council of the City of
Huntington Beach Adopting a Budget for the City for Fiscal Year 200712008."

3. Authorize the Professional Services Listing included in Fiscal Year 2007/2008 Budget to
be representative of services projected to be utilized by departments in 2007/2008.

include an increase of 10% to the Council/Mayor's travel fund line item for the
Mayor's expected travel. Councilmember Green announced, for the record, her

be held by the City Council of the City of
Huntington Beach, in the Council Chambers of the
Civic Center, Huntington,Beach located at 2000
Main Street, at the houd of 6:00 PM, or as soon
as possible thereafter on Tuesday, the 4th of
September, 2007, for the purpose of considering I
the Adoption of Resolutions Amending the
Comprehensive Fee Schedule including City User
Fees,Rates/Charges,and Development Fees.
The revisions to be considered are for cost recovery
purposes and to se Y charges for public access and
use of certain City property for the purpose of
raising revenue and tali',under the responsibility
