Small, Chief of Police SUBJECT: Adopt Resolution No. 2011-09 to increase fees for City Jail Pay-to- Stay Commitment Program Statement of Issue: The City of Huntington Beach Police Department Jail established a Pay-to-Stay Court Commitment Program in 1991 per Council Resolution No. 6257. The daily fee is currently $100 per day and has remained unchanged since the programs inception. The Police Department is requesting Council approval to add a new one-time $50.00 fee to cover the administrative cost of processing applicants for consideration to participate in the program. Additionally, the Police Department is requesting to add a new $10.00 fee to fund the use of a Global Positioning System (GPS) inmate tracking device which will be utilized to monitor the location of those inmates authorized for work release. Financial Impact: Recover cost of application process and GPS equipment rental, approximately $35,000.00 annually Recommended Action: Motion to: Adopt Resolution No. 2011-09, "A Resolution of the City of Huntington Beach Establishing an Applicant Processing Fee and a GPS Inmate Tracking Fee Schedule for the Huntington Beach Police Department Jail Court Commitment Program." Alternative Action(s): Do not approve motion and direct staff accordingly. NOW, THEREFORE, BE IT RESOLVED by the City Council of the I City of Huntington Beach that a fee be established of $100 per 24-hour period for persons serving a short-term sentence in the city jail in lieu of the .county jail. The program is designed to allow sentenced offenders an opportunity to apply, and if accepted, to serve their sentence in the Huntington Beach City Jail in lieu of serving their sentence in the Orange County Jail. The program also allows those offenders approved by the sentencing court, and our Jail Detention Administrator, to maintain their employment while serving their sentence in the work release program. Generally speaking, sentenced inmates spend their weekends and evenings in custody in the Huntington Beach City Jail, and are released during their work hours so they may report to their place of employment. The Police Department currently charges sentenced inmates a $100.00 per day fee that was established in 1991 per Resolution 6257. The Huntington Beach Police Department Jail Staff spends a considerable amount of time processing an applicant for consideration for acceptance into the Pay to Stay Program. In addition to conducting a background check, finger prints must be processed and checked against state and federal data bases. Time is also spent discussing the details of the Pay to Stay program with the applicant, the applicant's attorney, and the sentencing Court. The Police Department is requesting approval to add a one-time administrative fee of $50.00 to cover the cost of the background check and the processing of the application for all prisoners approved to participate in the program. Additionally, the Orange County Grand Jury has recommended any city jail operating a work release program implement the use of a GPS inmate tracking system. This system will be used to monitor the movement of a sentenced inmate while they are out of custody. To cover the cost of renting a GPS device to comply with the Grand Jury's recommendation, an additional charge of$10.00 per day would be added to the daily cost of participation in the Pay-to-Stay Program for any inmate also participating in work release. Over the last five years, the Pay to Stay Court Commitment Program has generated an average of $185,000 per year in revenue. The new fee schedule is anticipated to recover an additional $35,000 per year while keeping the program competitive with similar programs in Orange and Los Angeles Counties (Refer to Attachment 1). If adopted, the new fee schedule would be applied to all new applicants accepted to the program. A one-time administrative fee of$50.00 be established to cover the reasonable costs of processing an applicant for consideration in the jail court commitment program. 2. A fee of$10.00 per 24-hour period be established to cover the reasonable cost of renting a GPS inmate tracking device and administration of a GPS inmate tracking system for persons accepted to participate in a work release program as part of the jail court commitment program.
