STATEMENT OF ISSUE:
The Redevelopment Agency purchased land in December 1987 from the Southern Pacific
Transportation Company for the construction of a road, the Gothard-Hoover Extension.
A portion of the land that was purchased is within the city boundary of the City of
Westminster. Since the land is within the City of Westminster, we are required to pay
property taxes of approximately $6,845 per year. By deeding the property to the City of
Westminster for. road purposes, property taxes would not have to be funded by the
Redevelopment Agency and the City of Westminster would be exempt from property tax
payments.
RECOMMENDATION:
1) Authorization to deed, after final map is recorded, parcel 142-311-34 to the City
of Westminster for road purposes and with the restriction that if the road is deemed
no longer feasible by the City of Huntington Beach that the ownership would
automatically revert back to the Redevelopment Agency of the City of Huntington
Beach.
2) Request the City of Westminster to accept this parcel of land with the restrictions
as approved by the Redevelopment Agency. -
ANALYSIS:
The Redevelopment Agency owns a parcel of land that is 1.17 acres which is designated
as parcel number 142-311-34 by the Orange County Assessor. The land was purchased
for the proposed Gothard-Hoover Extension, which is a joint project of the City of
Huntington Beach and the City of Westminster. Because the land is within the City of
Westminster and owned by the Huntington Beach Redevelopment Agency property taxes
must be paid as required by state law.
Property taxes would not be required by deeding the parcel of land 142-311-34 to the
City of Westminster for road purposes. The deed would also require that if the road
project is determined not to be feasible by the City of Huntington Beach the parcel of
land would automatically be deeded back to the City of Huntington Beach
Redevelopment Agency and could be sold.

The City Attorney has reviewed this matter, and has provided the attached
memorandum regarding payment of property taxes. Southern Pacific Railroad, the
previous owner, indicated that, to the best of their knowledge, the property sold to us
was assessed for property taxes and taxes were paid. Also, this information was
presented to the Joint City Committee regarding the Gothard—Hoover Extension on June
6, 1991.
If action is taken prior to July 1, 1991 to deed the land to Westminster there will not be
a tax obligation to the Redevelopment Agency for parcel 142-311-34.
FUNDING SOURCE:
No funding source is required for this action.
ALTERNATIVE ACTION:
Do not deed the property in question to the City of Westminster, and continue to pay
property taxes.

In response to your question of 3/25/91, Article 13, Section 11
of the California Constitution provides that lands owned by
local government and located outside its boundaries are taxable
if they were taxable when acquired by the local government.
Accordingly, please determine whether the land in question was
taxable when we acquired it. If it was, then we are required
to pay taxes thereon and the proposed Request for
Council/Agency Action would s-eem prudent so long as all usual.
