Currently, the requirement applies to rental properties of three or more units, and the proposal would merely extend that requirement to properties having one or two units. The members of the DRA believe that many of the code enforcement problems in the downtown area are created by the large number of rental units. The members feel that the relatively small fee ($39.00 per year for a single unit and $46 .00 for two units) is justified by the increased burden that rentals place on the understaffed code enforcement department. However, we condition our support of the proposed change on a pledge by the City Council that the increased revenue will be used to hire additional code enforcement officers. The DRA takes no position on the other proposed revision to the City' s business license tax pertaining to independent contractors. We urge the City Council to pass the revision and use the revenue to hire code enforcement officers. We also urge all DRA members and others who support this proposal to show their support by .appearing at the City- Council meeting on November 1, 1993, to voice their opinion. A Public Hearing is required prior to final consideration of the amendments, which would generate new revenue of $155,000 as part of the solution to this year's $6.6 million General Fund budget shortfall. ANALYSIS: At the City Council's regular meeting of June 21, 1993, several new revenues were conceptually approved as part of the budget balancing actions. As indicated in Attachment 1, the total General Fund budget shortfall for 1993/94 was $6.6 million. 85% of that shortfall has been eliminated by expense reductions, transfers from other funds and from the net revenue generated from implementation of the new ambulance service. The balance of the shortfall (15%) was eliminated with new and/or increased revenues. I.� REQUcST FOR CITY COUNCIL ACTION This Public Hearing is for consideration of three revenues that are conservatively estimated to generate $155,000 in new General Fund revenue in 1993/94. This represents 2.3% of the total General Fund budget shortfall for 1993/94. This Request for City Council Action and attachments describe the following three new revenues which were conceptually approved at your June 21, 1993 meeting: 1. Oil Barrel Tax increase of 20, and 2. Business License requirement for single family and duplex rental properties, and 3. Business License requirement for independent contractors. OOII BARREL TAX - The existing ordinance regulating the oil barrel tax established that the tax would be increased (or decreased) in accordance with the change in the consumer price index each year. The new ordinance would keep all aspects of the original ordinance in tact with the exception of a one time 2¢ per barrel increase. Currently the per barrel tax for oil is $22.03 cents per barrel. The existing oil barrel tax will generate an estimated $700,000 General Fund revenue for the City for Fiscal Year 1993/94. If the City Council elects to adopt this increase, oil barrel tax revenue is anticipated to increase by $30,000 in Fiscal Year 1993/94 (this represents 50% of the potential new annual revenue). Attached is a survey of the barrel tax in several Southern California Cities that have substantial oil production. BUSINESS LICENSE - SINGLE FAMILY AND DUPLEX RENTAL PROPERTIES - Presently, residential rental property consisting of three or more units are required to obtain a' business license. The attached ordinance would require all rented residences, including single family and duplex rentals, to obtain a business license. The result of the ordinance would be a new business license fee of $39 per year for single family homes used as rental property and $46 per year for duplexes. As indicated in the attached survey, several Orange County cities require a Business License for all rental properties. License fees in those cities, for a single family unit, range from $22.50 to $95.00 per year. There are about 10,000 single family or duplex residential properties within the City for which the County of Orange sends a property tax bill to an address other than the residential property address. These properties are potential rental properties for which a business license will be required. If half of these addresses are rental properties, approximately $200,000 of additional business license revenue should be generated each year. If half of this estimated new revenue is collected in 1993/94, $100,000 of increased revenue will be received. Our prior budget estimate of new revenue from this category was $30,000 for 1993/94. -2- RE UAT FOR CITY COUNCIL ACTION BUSIN SS LICENSE -'INDEPENDENT CONTRACTORS -.Currently the-Business License Code does not have a specific category for independent contractors. Some individuals who work for companies as independent contractors are paying a $75 a year business license fee. Others, such as real estate agents, insurance agents, dental hygienists, and tax preparers are not obtaining a business license from the City. Real estate agents are the largest single category of individuals identified who are not required, under the current Code, to obtain a separate business license. Other cities have implemented ordinances that avoid the interpretation question of whether real estate agents are independent contractors or employees of a real estate broker by specifically requiring a business license for all real estate. and insurance agents. The attached ordinance uses this same approach. It is difficult to get accurate estimates of the new revenue that would be generated from the implementation of this new requirement because some existing license holders would have a reduction in annual fee from $75 to $25. It is clear that many more current independent contractors, real estate agents and, life insurance agents, would be required `to obtain a new $25 per year license. We estimate a net increase in revenue of$50,000 per year of which $25,000 would be generated in 1993/94. Staffing Requirements - We presently administer 16,000 licenses with a staff of three full-time employees in the City Treasurer's Department. The new licenses could add an estimated 12,000 to 15,000 new business licenses to be processed annually by these employees. The City Treasurer has identified the need for one full-time position, $30,000 for temporary help in 1993/94, and $15,000 in start-up costs for furniture, equipment, files and space modifications. The temporary help will be utilized to determine the full impact on workload due to the new changes. Then a permanent recommendation can be made to the City Council regarding staffing needs. FUNDING SOURCE: The adoption of the ordinances would increase General Fund revenue for 1993/94 by an estimated $155,000. ALTERNATIVE ACTION: 1. The City has modified the 1993/94 Budget to address a total shortfall of over$6.6 million. As indicated above, $5.6 million, or 85% of the shortfall, has been eliminated through expense reductions, transfers from other funds (and reduction of current or future expenses. in those other funds), and implementation of the new ambulance service. $1.0 million, or 15% of the shortfall,will be eliminated through new revenues. Plan A was adopted June 21, 1993 after the normal public hearings and an extensive series of budget study sessions conducted from January through June of this year.Plan B was adopted August 16, 1993 to balance the Budget after the State took over$3 million of our property tax revenue. The$3 million loss is a permanent loss of annual General Fund Property Tax revenue. A portion of the$3 million loss in 1993/94 will be offset by or State revenue to the City and the proposed extension of the 1/2 cent sales tax for Police/Fire services. The 1/2 cent Sales Tax extension for Police/Fire services, if approved by the voters on November 2,would offset an estimated $500,000 of the$3 million City loss in 1993/94, and $1 million per year thereafter. If not approved,the$6.6 million Shortfall would grow to $7.1 million and further budget amendments will be required. The following New Revenues have been conceptually approved as part of the Budget processes.
