Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2011-28 authorizing submittal of an application for Proposition 84 Funding (Urban Greening) for the East Garden Grove Wintersburg Channel Urban Runoff Diversion Project, Phase I Statement of Issue: The City of Huntington Beach is looking to apply for funds under the Urban Greening Grant Program. The grant program is part of the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84). The proposed grant application is for the East Garden Grove Wintersburg Channel Urban Runoff Diversion Project Phase I (Talbert Lake Project Phase 1) that will divert and treat urban runoff into Talbert Lake. A resolution authorizing the City to file the grant application and execute a grant agreement is required. Financial Impact: If awarded, the City of Huntington Beach would receive up to $2 million in grant funds for the Talbert Lake Project Phase I from the State of California. No grant match amount is required. Recommended Action: Motion to: Adopt Resolution No. 2011-28, "A Resolution of the City Council of the City of Huntington Beach Approving the Application for Grant Funds for the Urban Greening Grant Program Under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84)." Alternative Action(s): Do not approve resolution and deny submittal of grant application. 1-113-7- Item 5.-1 REQUEST FOR COUNCIL ACTION MEETING DATE: 5/2/2011 DEPARTMENT ID NUMBER: PW 11-023 Analysis: The East Garden Grove Wintersburg Channel Urban Runoff Diversion Project Phase I (Talbert Lake Project - Phase 1) will divert up to 1 million gallons per day (mgd) of urban runoff from the East Garden Grove Wintersburg Channel, through pre-treatment devices, into a 15-acre area in Central Park for treatment to remove numerous pollutants. The project will protect the beneficial uses of our coastal waters and provide multiple benefits to the region, including enhancement of habitat value, educational opportunities, increased park attendance and recreational opportunities, groundwater recharge and seawater intrusion barrier enhancements. The Urban Greening Program provides funds to preserve, enhance, increase or establish community green areas. The goal for these greening projects is to incrementally create more viable and sustainable communities throughout the State. Although the Urban Greening grant is not expected to fully fund the project, staff and their project consultant are working with the State regarding the possibility of constructing the project in additional phases within available budget. The total construction cost estimate for the project is currently $5,200,000. The Urban Greening grant would cover any necessary design modifications and construction of the wetland treatment trains of the project, which are estimated at approximately $2 million. Applications are due to the State on. May 13, 2011. Award of funding is expected to be announced in early 2012. Resolution No. 2011-28, "A Resolution of the City Council of the City of Huntington Beach Approving the Application for Grant Funds for the Urban Greening Grant Program Under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 Proposition 84 " Item 5. - 2 HB, - - ATTACHMENT #1 RESOLUTION NO. 2011-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and The Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and Said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the applicant's governing board before submission of said application(s) to the State; and The applicant, if selected, will enter into an agreement with the State of California to carry out the Project. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve as follows: Approves the filing of an application for the East Garden Grove Wintersburg Urban Runoff Diversion Project, Phase I; and 2. Certifies that applicant understands the assurances and certification in the application, and 3. Certifies that applicant or title holder will have sufficient funds to operate and maintain the project consistent with the land tenure requirements; or will secure the resources to do so, and 4. Certifies that it will comply with the provisions of Section 1771.8 of the State Labor Code regarding payment of prevailing wages on Projects awarded Proposition 84 Funds, and 5. If applicable, certifies that the project will comply with any laws and regulations including, but not limited to, legal requirements for building codes, health and safety codes, disabled access laws, environmental laws and, that prior to commencement of construction, all applicable permits will have been obtain, and 11-2866/62112 Resolution No. 2011-28 6. Certifies that applicant will work towards the Governor's State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1, and 7. Appoints the Director of Public Works, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project.
