To continue to participate in this reimbursable program, each participating city must adopt a resolution. In addition, this year's funds must be appropriated. Funding Source: The total program cost for fiscal year 2001/02 is $200,650. Of this amount, $120,650 already exists in the SAAV revenue account 87500875. The $80,000 balance to be appropriated from the unreserved, undesignated General Fund Balance will be reimbursed by the OCTA. Recommended Action: 1. Adopt Resolution,,?-o6.?-r a resolution of the City Council of the City of Huntington Beach to continue participation in the Orange County Service Authority for Abandoned Vehicles, and 2. Authorize the appropriation of $120,650 from the SAAV revenue account 87500875 and $80,000 from the unreserved, undesignated General Fund for a total appropriation of$200,650 to the SAAV Program Fund, 87570209, and RCA-SAAV funds increase and resolution.DOT 6/20/2002 5:30 PM /) Res. No. 2002-65 vehicles and assist law enforcement and code enforcement personnel in abatement of abandoned vehicles throughout Orange County; and The Huntington Beach City Council desires to continue participation in the SAAV program so that the City can receive its proportional share of the California vehicle registration fee for the purpose of abating and removing abandoned vehicles within its jurisdiction. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows: SECTION 1. The City is hereby authorized to continue participation in the Orange County Service Authority for Abandoned Vehicles established pursuant to California Vehicle Code Section 22710. SECTION 2. The City Council hereby approves the 10-year continuation of the abandoned vehicle abatement program and plan adopted and implemented by the Orange County Service Authority for Abandoned Vehicles and authorizes the continued imposition of an annual $1.00 vehicle registration fee to be used exclusively for the abatement, removal, and disposal as public nuisances of any abandoned, wrecked, dismantled, or inoperative vehicles, or parts thereof, from private or public property. SECTION 3. The City Clerk shall certify as to the adoption of this Resolution and file a certified copy with the Orange County Transportation Authority. RETURNED FORWARDED _ _ Administrative Staff Assistant City Administrator Initial City Administrator Initial [City Clerk _ .EXPLANATION-FOR RETURN OF ITEM: (Below • , For Only) RCA Author: Shawna Krone-Schmidt RESOLUTION NO. 6321 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, APPROVING THE ESTABLISHMENT OF THE ORANGE COUNTY SERVICE AUTHORITY FOR ABANDONED VEHICLE ABATEMENT AND THE VEHICLE ABATEMENT PLAN WHEREAS, Section 9250 .7 of the California Vehicle Code was amended in 1990 to provide for the establishment of a Service Authority for Abandoned Vehicle Abatement (AVA) if the Board of Supervisors of the county and a majority of the cities within the county having a majority of the population adopt resolutions providing for the establishment of the authority; and, WHEREAS, the Huntington Beach City Council finds that ! abandoned, inoperable, wrecked, dismantled vehicles or parts thereof pose a health and safety hazard and are found to be public nuisances; and, The Huntington Beach City Council finds that an abandoned vehicle abatement program is needed to provide for the proper removal and disposal of abandoned vehicles and assist law enforcement and code enforcement personnel in abatement of abandoned vehicles; and, The Orange County AVA Service Authority will have responsibility for implementing an abandoned vehicle removal program in Orange County region; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach requests that a Service Authority for - 1 - Abandoned Vehicle Abatement be established in Orange County pursuant to the provision of Section 22710 of the California Vehicle Code; BE IT FURTHER RESOLVED, that the members of the Orange County Transportation Authority shall serve as the Service Authority for Abandoned Vehicles in the City of Huntington Beach. BE IT FURTHER RESOLVED, that the City Council of the City of Huntington Beach approves the vehicle abatement program and plan of the AVA Service Authority of the County of Orange and approves the imposition by them of a one dollar ($1) vehicle registration fee. The fee imposed by the Service Authority shall remain in effect only for a period of five years . Authorize the expenditure of the funds for police program related equipment. Alternative Action(s): Do not adopt the resolution and do not increase the appropriation and direct staff accordingly. Analysis: In July 1996, Sections 22710 and 9250.7 were incorporated into the California Vehicle Code. These sections established the service authority for abandoned vehicles. A service authority assists in establishing procedures for the abatement, removal, and disposal, of any abandoned, wrecked, dismantled, inoperative vehicles, or parts thereof, as public nuisances from private or public property. The program also provides reimbursement for the removal and disposal of these vehicles, including administrative costs. The program is funded through a $1 surcharge per registered vehicle in.California. In 1991, the Orange County Service Authority for Abandoned Vehicles (SAAV) was established under the Orange County Transportation Authority (OCTA). Initially the State of California's SAAV program had a 10 year authorization, which would have expired in April 2002. The State of California has recently extended the sunset date of the SAAV to April 2012. The Police Department currently participates in the SAAV Program. SAAV funds are restricted in that they may only be expended on items or personnel related to the removal of abandoned vehicles. Through this program, the City is reimbursed for abandoned vehicles that are investigated and towed. The SAAV fund pays for each of the four steps in the investigation of abated vehicles. The rate of reimbursement for each step ranges from $40.89 to $56.43. If a vehicle reached the fourth step and is towed, SAAV pays a total of $191.80 per vehicle. On the average, the Police Department investigates approximately 145 vehicles and tows approximately 30 vehicles per month. The City bills the SAAV program on a quarterly basis for the number of vehicles investigated and towed. The funds are then disbursed through the OCTA. Previously SAAV funds have been used to fund the purchase of parking and traffic related equipment, new helicopters, and other necessary police items. For example, in this fiscal year, the SAAV has partially funded the purchase of the newest NOTAR helicopter, Sentinel. In order to continue to receive reimbursements through the SAAV funds, it is necessary to adopt a resolution supporting the SAAV program. Since the purchase of the helicopter, the SAAV cash balance has increased to $120,650. Before the end of the fiscal year an additional $80,000 should be received from the OCTA. Due to these disbursements, it is necessary to increase the SAAV appropriation by $200,650, so that these funds can be expended. The funding will be used to reorganize the Traffic Unit and purchase equipment for field personnel, such as radios, supplies for citation machines, and other equipment. A billing for the quarter ending in June will be sent in July 2002, which is estimated to be an additional $40,000. POLICY REGARDING REQUESTS FOR AN APPROPRIATION OF GENERAL FUNDS: As adopted by the City Council in March 1998, all requests for appropriation of General Funds must meet one of the following criteria; 1) The request is for an unanticipated emergency, 2) the request is required to implement labor negotiations, or 3) The request will be offset by related new revenues. The $80,000 General Fund appropriation being requested for this program meets criterion #3 as the appropriation will be fully offset by the associated OCTA funds.
