Small, Chief of Police SUBJECT: Accept and approve expenditure of the County Supplemental Law Enforcement Services (SLESF) Grant in the amount of $200,000 for Fiscal Year 2012-2013 Statement of Issue: The City Council is requested to conduct a public hearing and approve acceptance of the Supplemental Law Enforcement Services Fund (SLESF) Grant. This grant will provide funding for the new Motorola Astro Digital XTS 5000 700/8001MHz radios purchase. Financial Impact: Grant funds estimated to be $200,000 will be fully reimbursed by the grant from the State of California, Citizens Option for Public Safety (COPS) funding program. No other matching or in-kind city funds are required for this grant. A new fund will be established for this funding. Recommended Action: Motion to: A) Conduct a public hearing; and, B) Approve the acceptance of SLESF grant for funding fiscal year 2012-13; and, C) Authorize the Chief of Police to expend $200,000, plus any accrued interest; and, D) Appropriate $200,000 plus any accrued interest to purchase the new Motorola Astro Digital XTS 5000 700/800MHz radios. Alternative Action(s): Not to accept and approve expenditure of the County Supplemental Law Enforcement Services (SLESF) Grant in the amount of $200,000 for Fiscal Year 2012- 2013. xB -735- Item 24. - I REQUEST FOR COUNCIL ACTION MEETING DATE: 8/20/2012 DEPARTMENT ID NUMBER: PD 12-011 Analysis: In 1996, State Assembly Bill AB 3229 was signed into law. This bill created the Citizens Option for Public Safety Program (COPS), which provided $100 million statewide to be used exclusively for front line law enforcement services. This program has been ongoing, but required a budget appropriation each fiscal year for continued funding. Each California law enforcement agency is guaranteed $100,000 minimum. The total allocation to an agency is determined by a formula derived from the base amount and population figures provided by the Department of Finance. Based on City of Huntington Beach population, we received an award of $200,000 for fiscal year 2012-2013. This funding is provided in four installment payments. The grant requires that the funds be spent on front-line police services. The SLESF Oversight Committee, which is comprised of members of Orange County Sheriff's Department and involved citizens throughout Orange County, has requested that we define the intended use for the funds before acceptance of this grant. At this time, the intended project for this grant is to fund front line patrol equipment as follows: For FY2012-13 funding, the Huntington Beach Police Department proposes to purchase the new Motorola Astro Digital XTS 5000 700/800MHz radios. These radios are superior to our existing radios used by police officers in the field because of their ability to access radio frequencies in the 700 MHz bandwidth. The additional access is critical in providing interoperable communication with federal agencies in the event of a major emergency. These 700MHz radios provide an interoperable, Project 25, mission critical network that meet requirements for voice and data emergency response. This allows for efficient and reliable inter-agency communications helping first responders to communicate, coordinate and interoperate together as one, something that is not possible with our current 800 MHz radios. These funds are allocated to local law enforcement agencies for front line law enforcement services and must be used to supplement existing funding. Cities and Counties are required to create a separate SLESF account in order to keep these funds separate from other monies. The Orange County Supplemental Law Enforcement Oversight Committee(SLEOC)is responsible for meeting annually to review and approve actual and proposed future SLESF expenditures by all Orange County recipients and to facilitate required state reports regarding all expended funds. The Orange County SLEOC includes the Sheriff(Chair), County Executive Officer, District Attorney, Police Chief, and City Manager. The SLEOC will convene in late September, 2012 to approve the SLESF expenditures for FYI 1/12, complete and submit the standardized reporting form to the State Controller's Office, and approve the proposed SLESF expenditures for FYI 2/13 to authorize the release of funds by the county Auditor-Controller to each city agency. To satisfy the SLESF reporting requirements, your city will need to complete the attached forms and submit them to the county SLEOC. Please read the attached letter from the State Controller's Office and Government Code Section 30061-30065, addressing SLESF requirements.
