STATEMENT OF ISSUE:
It is recommended that an underground utility district be formed along Beach Boulevard between
Edinger Avenue and the 405 Freeway.
RECOMMENDED ACTION::
Approve the attached Resolution; thereby establishing an underground utility district along Beach
Boulevard between Edinger Avenue and the 405 Freeway.
ANALYSIS:
On November 16, 1992, Council approved Resolution 6445 thereby calling for a public hearing to
determine whether public necessity, health, safety, or welfare require the formation of an
underground utility district along Beach Boulevard between Edinger Avenue and the I-405
Freeway. Pursuant to this action, and in accordance with the attached engineer's report, staff
recommends that Council approve the attached resolution; therby establishing an underground
utility district along Beach Boulevard between Edinger Avenue and the 405 Freeway.
FUNDING SOURCE:
The cost of undergrounding the utilities will be borne by Southern California Edison Company,
General Telephone Company and one property owner. Therefore, the formation and completion
of this district will not fiscally impact the City or any private citizens.

FUNDING SOURCE:
The California Public Utilities Commission requires that
public utilities set aside funding for underground utility
districts . Pursuant to this requirement , Southern California
Edison has. established the following funding program for current
and future Underground Utility Districts within the City:

(1 . ) On May 4 , 1992 Council approved Resolution 6379, thereby
establishing an underground utility district along Golden West .
Street , between Ellis and Slater Avenues . This district will
be completed in late 1993 .
( 2 . ) Southern California Edison allows cities to "mortgage ahead"
to complete districts . Our annual allocation is $500 ,000 .
The City will not have a positive balance until we receive our
1997 allocation.
( 3 . ) The City' s Underground Utilities Coordinating Committee has
established the goal of undergrounding all utilities along
Beach Boulevard, from Pacific Coast Highway. to the 405
Freeway . The establishment of a district along Beach

Boulevard, between Warner and Heil Avenues , will be the third
in a series of districts required to achieve our goal . - Staff
will be submitting a Resolution, for the establishment of this
district , to Council on December 21 , 1992 .
Finally , there will be no costs to the City, associated with
the formation of these districts . Affected property owners will be -
held responsible for the cost of undergrounding utility service on
their property (Section 17 . 64 . 200 ) .
AFFECTED PROPERTY OWNERS:
The formation and completion of this district will affect
Gannett Outdoor , the owner of two advertising signs on the adjacent
property . Gannett Outdoor will be notified of their responsibility
to underground the utility service to their signs and of the
deadline for the completion of the work, per Section 17 . 64 . 180 .
SUMMARY / STAFF RECOMMENDATION:
Staff recommends that Council :
1 . Call a public hearing to ascertain whether the public
necessity, health, safety or welfare requires the removal of
these poles and the associated overhead structures .
2 . . Adopt by affirmative vote of at least five members of the
Council a Resolution declaring this portion of Beach Boulevard
an Underground Utility District and order the removal of
overhead facilities .

WHEREAS, Huntington Beach Municipal Code Chapter.17.64 establishes
a procedure for the creation of underground utility districts and requires, as
the Initial step, the holding of public hearing to ascertain whether public ne-
cessity, health, safety or welfare requires the removal of poles, overhead
wires and associated overhead structures and the underground Installation of
wires and facilities for supplying electric communication, or similar or assocl.

SECTION 1. NOTICE IS HEREBY GIVEN that.a public hearing will be held
by the City Council of the City of Huntington Beach on December 7, 1992, al
the hour of 7:00 p.m. in the Council Chamber of the Civic.Center, or as scor
thereafter as the matter may be heard,to ascertain whether the public neces•
sity, health, safety or.welfare requires the removal of poles, overhead wires
and associated overhead structures and the underground installation of wires
and facilities for supplying electric, communication, or similar associated ser•
vice in the districts hereinabove described.
SECTION 2: At such hearing-all persons Interested sha11 be given an op
portuntty to be heard: Said hearing may be continued from time to time as
may be determined by the City Council.
SECTION 3. The City Clerk shall notify all affected property owners as
shown on,the last equalized assessment roll and utilities concemed of the
time and place of such hearing by mailing a copy of this resolution to suet
properly owners and utilities concemed at least ten (10) days prior to the
date thereof.
SECTION 4. The areas proposed to be Included In the district are showr
on those certain maps untitled 'Beach Boulevard Underground Utility District'
which Is on file In the Department of Public Works of the City of Huntingtor
Beach.

Beach Boulevard Underground Utility District
Edinger Avenue to I-405 Freeway
ESTABLISHING DISTRICTS:
In 1977 the City Council adopted Chapter 17 . 64 of the
Municipal Code. This chapter set forth guidelines and procedures
for the establishment of Underground Utility Districts . An
Underground Utility District is defined by this chapter as :
. . . that area in the city within which poles , overhead wires,
and associated overhead structures are prohibited . . .
(Section 17 . 64 . O10b)
Specifically, once a district is established by City Council all
overhead wires and associated utility poles , within the Public
Right of Way , must be converted to underground facilities .
COORDINATING COMMITTEE:
Section 17 . 64.020 of the Municipal Code requires the formation
of a Underground Utilities Coordinating Committee. The duty of the
committee is to determine the location and priority of conversion
work and advise the City Council on all technical aspects of
undergrounding public utilities . Specifically, the committee
shall :
(a) Determine the location and priority of conversion work
within the city;
(b) Recommend specific projects and methods of financing;
( c) Recommend time limitation for completion of projects and
extensions of time;
(d) Develop a long-range plan for establishing underground
utilities districts;
(e) Perform such other duties as may be assigned to it by the
City Council .

DISTRICT FORMATION:
On October 8 , 1991, the Underground Utility Committee met to
determine the location and priority of conversion work within the
city and to establish immediate and long range districts . Twenty-
one ( 21) potential districts were reviewed and discussed. Beach
Boulevard is the second district to be established. At this time
plans are underway to relandscape the intersection of Beach
Boulevard and the I-405 Freeway in order to enhance the entrance to
the Huntington Beach Mall . The removal of six ( 6) existing
Southern California Edison power poles and associated overhead
wires, along the east side of Beach Boulevard, south of the
Freeway, will further enhance the appearance of this intersection.
The formation of this district will only affect Gannet Outdoor , the
owner of two outdoor advertising signs on the adjoining property .
The power service to these signs will need to be placed underground
at the owner' s expense .

city and to establish immediate and long .range districts . Twenty-
one ( 21) potential districts were reviewed and discussed. Beach
Boulevard is the second district to be established. At this time
plans are underway to relandscape the intersection of Beach
Boulevard and the I-405 Freeway in order to enhance the entrance to
the Huntington Beach Mall . The removal of six ( 6) existing
Southern California Edison power poles and associated overhead
wires, along the east side of Beach 'Boulevard, south of the
Freeway, will further enhance the appearance of -this intersection.
The formation of this district will only affect Gannet Outdoor, the
owner of two outdoor advertising signs on the adjoining property.
The power service to these signs will need to be placed underground
at the owner' s expense.

AFFECTED PROPERTY OWNERS:
The formation and completion of this district will affect
Gannett Outdoor,' the owner of two advertising signs on the adjacent
property. Gannett Outdoor will be notified of their responsibility
to underground the utility service to their signs and of the
deadline for the completion of the work, per Section 17 . 64 . 180 . -
SUMMARY / STAFF RECOMMENDATION:
Staff recommends that Council :
1 . Call a public hearing to ascertain whether the public
necessity, health, safety or welfare requires the removal of
these poles and the associated overhead structures .
2 . Adopt by affirmative vote of at least five members of the
Council a Resolution declaring this portion of Beach Boulevard
an Underground Utility District and order the removal of

WHEREAS, Huntington Beach Municipal Code Chapter 17. 64
establishes a procedure for the creation of underground utility
districts and requires, as the initial step, the holding of
public hearing to ascertain whether public necessity, health,
safety or welfare requires the removal of poles, overhead wires
and associated overhead structures and the underground
installation of wires and facilities for supplying electric
communication, or similar or associated service in any such
district; and
It has been recommended that such an underground utility
district be formed to include property within the public
right-of-way on Beach Boulevard between Edinger Avenue and the
I-405 Freeway,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does resolve as follows :

STATEMENT OF ISSUE:
It is recommended that an Underground Utility District be formed along the east side of
Beach Boulevard between Edinger Avenue and the 4.05 Freeway.
RECOMMENDED ACTION:
Approve the attached Resolution; thereby calling for a public hearing to determine
whether public necessity, health, safety, or welfare require the formation of an
underground utility district along the specified portion of Beach Boulevard.
ANALYSIS:
A number of older major highways within the City are lined with electrical and/or
telephone poles. These poles, and the associated overhead structures, are unattractive and
could become a safety hazard as the volume of traffic on these highways continues to
increase.
In December of 1977, Council adopted Chapter 17.64 of the Municipal Code. This Chapter
authorizes Council to establish Underground Utility Districts. An underground utility
district is defined as the removal of all electrical and/or telephone poles and associated
overhead structures along a street or a portion thereof. Pursuant to Section 17.64.100 of
this Code, Council can establish a district if public necessity, health, safety, or welfare
requires the removal of poles.
Section 17.64.020 of the Municipal Code requires the establishment of an Underground
Utilities Coordinating Committee.. This committee is to establish a list of potential
districts. On October 8, 1991, the City's Underground Utility Coordinating Committee
comprised of representatives from: Southern California Edison, General Telephone,
Paragon Cable Television, and City staff from Administration, Redevelopment, Planning,
and Public Works, met and established a list of twenty-one potential streets where
existing electrical and or telephone poles should be removed because the facilities are
unattractive and could become a safety hazard. These potential districts were then
prioritized by cost and significance to upcoming street improvement projects designed to
accommodate increased volumes of traffic.

In creating the Huntington Beach Redevelopment Agency, the City Council declared its desire
to improve, upgrade, and revitalize areas of the City which have become blighted. As a part of
the City's ongoing redevelopment efforts, the Huntington Beach Redevelopment Agency
prepared and approved a plan to improve the Huntington Center Commercial District. Pursuant
to this plan, existing Southern California Edison high voltage transmission lines are to be
undergrounded. The high voltage Edison lines, directly adjacent the district, along the east side
of Beach Boulevard (between Edinger Avenue and the 405 Freeway) are an unsightly safety
hazard.
Pursuant to Section 17.64.090 of the Municipal Code, Council may call public hearings to
ascertain whether the public necessity, health, safety, or welfare requires the removal of poles,
overhead wires, and associated overhead structures within designated areas of the City and the
underground installation of wires and facilities for supplying electric, telephone, or similar
associated services. Prior to holding such public hearing, the City Engineer shall prepare a
report for submission at such hearing. The report shall contain the extent of public utility
participation, estimates of total costs to the City, and affected property owners. This report,
see attached, has been prepared and therefore, it is recommended that the attached Resolution
be approved, thereby calling for a public hearing to determine whether public necessity, health,
safety, or welfare require the formation of an underground utility district along the east side of
Beach Boulevard between Edinger Avenue and the 405 Freeway.
