Hopkins, PE, Director of Public Works SUBJECT: Adopt Resolution No. 2011-43 ordering the Summary Vacation of a Water Line Easement at 19131 Beach Boulevard Statement of Issue: The Public Works Department requests that the City adopt a Resolution to summarily vacate a Water Line Easement at 19131 Beach Boulevard pursuant to Division 9, Part 3, Chapter 4 of the California Streets and Highways Code commencing with Section 8334(a). Public notice is not required for a summary vacation of a public service easement. Financial Impact: Not Applicable. Recommended Action: Motion to: A) Adopt Resolution No. 2011-43, "A Resolution of the City Council of the City of Huntington Beach Ordering the Summary Vacation of the Water Line Easement on Property Located at 19131 Beach Boulevard;" and, B) Instruct the City Clerk to record the said Resolution and attached exhibits with the Orange ^vucty Rec.,de . Alternative Action`s): Deny the recommended ach-inn. 11B -43- Item 4. - I REQUEST FOR COUNCIL ACTION MEETING DATE: 7/5/2011 DEPARTMENT ID NUMBER: PW 11-037 Analysis: The property at 19131 Beach Boulevard (existing Norm Reeves Honda) has.an existing public Water Line Easement over a portion of the site that was dedicated to the City of Huntington Beach by a Corporation Easement Deed Recorded February 25, 1987, as Instrument 87-102730, Official Records of Orange County. The Water Line Easement was used for a public water line and fire hydrant assembly that f:;erved the Norm Reeves Honda facilities. With the re-development of the Norm Reeves Honda site, the water line has been abandoned and the existing fire hydrant has been relocated into the Beach Boulevard right-of-way on the westerly side of Beach Boulevard. ""he existing Water Line Easement does not serve any further public use and Norm Reeves Honda has requested that the City vacate the easement. 1..1pon vacation of this Water Line Easement, the rights to the underlying land would revert back to the fee owner of the property. The vacation of the Water Line Easement (public service easement) does not require a Planning Commission Approval for General Plan (conformance under Government Code Section No. 65402. Unlike the general street vacation process, the summary vacation of a public service easement does not have public noticing requirements, nor does it require a separate public hearing prior to the City Council taking action. Public Works Commission Action: Not Required.
