AkU a4e.1 STATEMENT OF ISSUE The city has received a proposal from the Huntington Harbour Yacht Club (Club) to amend its agreement to allow for twelve boat slips to be built on city property. RECOMMENDATION Approve in concept the modification of the Huntington Harbour Yacht Club agreement to allow for the Club's development of twelve boat slips, conditioned on the Club's ability to obtain environmental, land and water quality approval for the project. ANALYSIS The city owns the facilities, public launch ramp and public docks located at the Huntington Harbour Yacht Club (Club) adjacent to the Warner Fire Station. The Club has an agreement with the city for the operation and maintenance of the facility and public dock space. While most of the Club members have residential boat slips, there are a number who do not. The Club has indicated a need for boat slips that can accommodate large vessels up to 65 feet. Adjacent marinas, including Weatherly and Davenport, are small boat marinas, i.e., up to 40 feet. The Club proposes to build twelve slips, approximately half of which would be rented on a monthly basis to owners of vessels over 55 feet. The remaining slips would be used as visitor docks for other yacht clubs members sailing into the harbor for activities. Under the terms of the proposal, the Club would operate and maintain the dock space. It would also continue to maintain the public dock space and launch facilities. The Club would also begin maintaining the pump out facility which is currently serviced by the city. If you need clarification on the need for a Public Hearing include a request for advice in your Request for Legal Serivice (RLS) . �uJ s /,-rl'✓ri2<j ORDINANCE/RESOLUTION To add to or amend the City Code, departments must submit a RLS describing the desired revision so that it can be put in proper ordinance or resolution forM and reviewed for any legal concerns. An ordinance or resolution is also needed to establish a new fee or revise an existing fee. An RLS should be submitted to the City Attorney for these as well. CONTRACT/AGREEMENT All contracts/agreements must be submitted to the City Attorney Office for review and approval. With few exceptions, the City Attorney requires two signature$by the contractor before final approval can be given. NEGATIVE DEC./EIR All projects within the City require either a Negative Declaration or an Environmental Impact Report(EIR) . Community Development staff should be consulted as to which is needed. INSURANCE Proof of insurance is usually required of contractors with the city as well as companies doing work in a city right- of-way. Seek advice via your RLS if you are unsure. BONDS Are required of contractors with the City and developers. Again, as part of your RLS you can seek advice on the need for bonds. MAPS Maps should be attached to identify the location of all projects or tracts. REQUEST FOR COUNCIL ACTION November 16, 1992 Page two The revenue derived from the dock rental would be split between the Club and the city at a percentage to be determined through negotiations. The Club would also be responsible for monitoring activity on the docks as to noise, curfew, use, trash, etc. The Club has prepared preliminary plans to submit to the Community Development Department. Proceeding with such a project would require the city to be co-applicant through the environmental, land and water quality approval process. Staff has had meetings with both Club representatives and adjacent marina operators. The Club believes that its proposal is an extension of its existing relationship with the city for the operation of Club facilities and that it should be the developer and operator of the rental docks. Adjacent marina operators would like the chance to bid for the development and operation of this dock space. The dock rental program at the yacht club is a proposal presented to the city by the Club and, therefore, staff feels the city's position should be to either approve the Club's proposal or disallow a project of this nature. FUNDING SOURCE Huntington Harbour Yacht Club would pay all associated costs. This project would produce revenue to the city. ALTERNATIVE ACTIONS O Approve the concept of dock rental space at the Huntington Harbour Yacht Club and direct staff to solicit bids for a concessionaire, which may or may not be the Club, for the development and operation. © Approve the concept of city development and operation of dock rental space at the Huntington Harbour Yacht Club. This alternative would require city expenditures for plans, approval process, development, operation and maintenance. © Deny conceptual approval of the development and operation of dock rental space at the Huntington Harbour Yacht Club.
