[ ] Yes [ ] New Policy or Exceptj� //,e A a Statement of Issue, Recommendation,Analysis, Funding Source, Alternative Actions,Attachments: STATEMENT OF ISSUE: Zone Change No. 84-3-B was continued from the Au-gust 19 , 1985 City Council meeting in order to provide staff sufficient time to conclude its work with the POD Planning Group on their Land Use and Circulation study of the Oakview area. Because an in-depth analysis of the area is being conducted, additional time is necessary prior to making a recommendation regarding this zone change. RECOMMENDATION: Close..hearina and defer consideration of Zone Case No. 84-3B until the Oakview Planning Study has been completed, at which time a new public hearing will be scheduled. ATTACHMENT: 1 . EXCLUDING THEREFROM that certain property con- sisting of approximately 4.06 acres, identified as Lots 3 through 10, and 36 through 43 of Tract Map 4301, recorded in Book 51, page 13, Miscellaneous Maps in the office of the County Recorder of Orange County, California. SECTION 2. Section 9061 of the Huntington Beach Ordinance Code, District Map 31 (Sectional District Map 26-5-11 ) is hereby amended to reflect the change contained in this ordi- nance and on the map attached hereto. The Director of Development Services is hereby directed to prepare and file an amended map. A copy of said district map, as amended, shall be available for inspection in the office of the City Clerk. Commission action was to rezone to R3-16 with a density bonus. Olinger , 15581 Oaks re Lane When the Planning Commission appro ed the above request o,n July 10 , 1984 , there were concerns raised eqarding the height of the block wall which surrounds the proper Staff made an on-site inspection . which confirmed that the wall, consistent with code requirements for a ` day care use , is indeed six et high. The amendment was intended to bring the General Plan . designation into consistency with the existing R3 zoning and to permit the development of the proposed Koledo Lane Improvement Project within the Oakview Redevelopment Area. The Council was concerned, however , that the amendment would permit higher densities to occur in the Oakview Area -than presently exist. Because of this concern, LUE 83-3 was approved on the condition that a zone change limiting Densities to 20 units per acre (R3-20) be initiated for the Oakview Area. Zone Change No. 84-3A was prepared in response to that direction. R3 zoning , when utilized in conjunction with a General Plan designation of Medium High Density Residential, will permit a density of 25 units per acre. The Oakview Area, which has both R3 zoning and a General Plan designation of Medium High Density Residential, is presently developed to an overall density of 18 units per acre. The proposed Koledo Lane project is proposing additional units and rehabilitation of existing units and will have a density of 20 units per acre. The proposed zone change to R3-20 would have permitted the Koledo Lane project to be completed and would have limited densities in the remainder -of the Oakview Area to 20 units per acre. . The Planning Commission, however , in its review of the zone change request was concerned about permitting the density that R3-20 zoning would allow. The Commission felt that densities of 25 units per acre could result if density bonuses were requested. The Planning Commission therefore recommended that the zone change ordinance be amended to specify R3-16 zoning with a maximum allowance of up to 20 units per acre with a density bonus. The City .Council , at its regular meeting on June 18, 1984 , -expressed a great deal of concern on Zone Change No. 84-3A. There appeared to be some confusion regarding the Planning Commission' s recommendation calling for R3-16 with a maximum allowance o� up to 20 units per acre with a density bonus. Staff recommended that the Council approve R3-20. A-FM-238 41 The City Council voted to deny the R3-20 by a 4 to 3 vote . A second motion followed which recommended that Koledo Lane be separated from the rest of the properties in the subject area *and sent back to the Planning Commission for a report. This motion passed 5 to 2. Later in the meeting , Council voted to reconsider this item and voted to .approve the `R3-20 designation on Lots 3-10 and 36-43 of Bract Map 4301. No zone change was approved for the other properties in the subject area. Council has. requested that the Planning Commission report back to- the City Council with a recommendation on the remaining properties within the boundaries of this zone change . Given this opportunity, the Planning Commission may wish to reiterate its support .of R3-16 zoning for the remaining properties. Conversely, the Planning Commission may reconsider its original recommendation and support R3-20 zoning for the remaining properties. Because the average existing density in the Oakview Area (18 units per acre) already exceeds 16 units per acre, staff recommends the latter. A zone change will be initiated for either option. A revised schedule for completion of the project is in the process of being prepared. The property is located within the Oakview Development Area , north of Slater Avenue and west of Beach Boulevard, excluding an island area along Koledo Lane (Lots 3-10 and 36-43 of Tract Map #4301 ) . Zone Change No. 84-3-A, a request to rezone the Koledo Lane portion (4 . 1 acres ) from R3 to R3-20, was approved by the City Council in July, 1984. At that time, the City Council referred rezoning the remaining 33.5 acres to R3-20 to the Planning Commission for reconsideration. This request is a result of their reconsideration. RECOMMENDATIONS: PLANNING COMMISSION ACTION ON FEBRUARY 7 , 1984 : ON MOTION BY LIVENGOOD AND SECOND BY SCHUMACHER, ZONE CHANGE NO. 84-3 WAS APPROVED WITH R3-16, MAXIMUM ALLOWANCE OF UP TO 20 UNITS PER ACRE WITH DENSITY BONUS, AND RECOMMENDED TO THE CITY COUNCIL FOR ADOPTION BY THE FOLLOWING VOTE: AYES: Winchell , Livengood, Porter , Schumacher , Mirjahangir NOE: None ABSENT: Higgins , Erskine ABSTAIN: None Finding for Approval : 1 . PLANNING COMMISSION ACTION ON JULY 24, 1984: As an item, not for public hearing, Chairman Porter said he would draft a response for the City Council explaining their decision . 10009 .4 P10 4/84 PLANNING COMMISSION RECOMMENDATION: After reconsideration by the Planning Commission at their September 5, 1984 meeting, the Planning Commission reiterates its recommendation that the City Council approve Zone Change No. 84-3-B with an amendment to the attached ordinance to specify R3-16 zoning with a maximum allowance of up to 20 units per acre with a density bonus. STAFF RECOMMENDATION: Staff recommends that the City Council approve Zone Change No. 84-3-B, from R3 to R3-20, and adopt the attached ordinance. ANALYSIS: Applicant: City of Huntington Beach Location: That area north of Slater Avenue, east of Nichols Street and Oakview School , south of a parallel line 145 feet north of Mandrell Drive, and west of a parallel line 130 feet west of Beach Boulevard. (Oakview Redevelopment Area ) excepting therefrom a portion along Koledo Lane known as Lots 3-10 and 36-43 of Tract Map No. 4301. Request : To permit a change of zone from R3 (Medium High Density Residential ) to R3-20 (Medium High Density Residential , 20 units per acre ) . DISCUSSION: Zone Change No. 84-3A was submitted to the City Council on June 18, 1984 . The ordinance at that time was for a change of zone from R3 to R3-20 on 37. 6 acres of property in the Oakview Redevelopment Area. The Planning Commission 's recommendation at the time was that the ordinance be amended to reflect R3-16 with provisions for a density bonus to allow up to 20 units per acre. The Commission was concerned that excessive densities in the area could occur if R3-20 zoning were adopted and then subjected to density bonuses. After considerable discussion , the City Council concurred with the Planning Commission 's concerns about density. As a result , the Council voted to deny the R3-20 by a 4 to 3 vote. A second motion followed which recommended that Koledo Lane be separated from the rest of the properties in the subject area and sent back to the Planning Commission for a report. This motion passed by a 5 to 2 vote. Later in the meeting, Council voted to reconsider this item and voted to approve the R3-20 designation on Lots 3-10 and 36-43 of Tract Map 4301 . No zone change was approved for the other properties in the subject area. On July 2, 1984, the City Council adopted Zone Change No. 84-3-A to rezone Koledo Lane from R3 to RCA - June 7, 1985 -2- (2620d ) R3-20. Rezoning the remaining portion of the Oakview Redevelopment Area is being referred to as Zone Change No. 84-3-B in order to eliminate any confusion over the two areas. On September 5, 1984, the Planning Commission reviewed Zone Change No. 84-3-B to rezone the remaining portion of the Oakview Redevelopment Area from R3 to R3-20. The Commission agreed the R3-16 recommendation is necessary in order to assure that future development be consistent with present development. The R3-16 zoning classification along with a density bonus (total 20 units per acre ) would be consistent with the existing developed density of 18 units per acre. An R3-20 designation along with a density bonus would allow intense development (total 24 units per acre) unconducive to the area . A higher density would not reduce the problems associated with the area and could result in compounding those problems. Attached is a memo from the Planning Commission indicating their position and recommendation. ENVIRONMENTAL STATUS: Zone Change No. 84-3A & B were originally assessed through Environmental Impact Report No. 83-2, which was adopted by the City Council on November 28, 1983. Further environmental analysis is not required under the provisions of the California Environmental Quality Act. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: The City Council may consider denying Zone Change No. 84-3B and retaining the existing R3 zoning with no additional limitation. PUBLIC HEARING - ZONE CHANGE 84-3-B - CONTINUED'OPEN TO 10/21/85 The Mayor announced that this was the day and hour set for a public hearing continued open from June 17, 1985 for the purpose of considering Zone Change No. 84-3-B, a request by the City of Huntington Beach to change the zoning designation from R3, (Medium High Density Residential) to R3-20 (Medium High Density Residential, 20 units per acre) on approximately 31.6 acres bounded by Slater Avenue to the south, Nichols Street and Oakview School to the west, a parallel line 145 feet north of Mandrell Drive to the north and a parallel line 300 feet west of Beach Blvd. to the east, excepting approximately 4.1 Page 2 - Council Minutes - 8l1 V85 acres identified as Lots 3 through 10 and 36 through 43 of Tract Map 4301 recorded in Book 51, Page 13 of Miscellaneous Maps in the Off z of the County Recorder of Orange County. The motion carried by the following roll call vote: AYES: Kelly, MacAllister, Mandic, Bailey, Finley, Green, Thomas NOES: None ABSENT: None PUBLIC HEARING - RESOLUTION NO 5553 - ADOPTED - HUNTINGTON SHORES MOBILEHOME PARK - DECLARATION OF CHANGE OF USE TO VACANT LAND - ND - 1 - APPROVED The Mayor announced that this was the day and hour set for a public hearing to consider a Declaration of Change of Use to Vacant Land on the Huntington Shores Mobilehome Park located at the northwest corner of Huntington Street and Pacific Coast Highway. The applicant is the Huntington Beach Company. The City Council will also consider an Agreement between the City of Hunting- ton Beach and the Huntington Beach Company regarding closure of Huntington Shores Mobilehome Park, contribution of funds to the City for development of a Mobilehome Relocation Park, and relocation assistance to be rendered to the residents of Huntington Shores Mobilehome Park. Council will also consider Negative Declaration 85-51. The public hearing is pursuant to Section 9270.4 of the Huntington Beach Ordinance Code. The City Clerk announced that all legal requirements for notification, publi- cation and posting had been met, and that she had received no communications or written protests to the matter. The Development Services Director stated that the hearing was being held at the request of the huntington Beach Company. The Mayor declared the hearing open. There being no one present to speak on the matter and there being no protests filed, either oral or written, the hearing was closed by the Mayor. The City Clerk presented Resolution No. 5553 for Council consideratiou - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING A CHANGE OF USE TO VACANT LAND ON HUNTINGTON SHORES MOBILEHOME PARK." A motion was made by Kelly , seconded by MacAllister, to approve and authorize execution of an agreement between the City and the Huntington Beach Company, to approve Negative Declaration #85-51 and to adopt Resolution No. 5553 The motion carried by the following roll call vote: ti TO: !i,,NORABLE MAYOR AND CITY COUNCIL DATE: OCTOBER 16,1984 FROM: PLANNI14G COMMISSION SUBJECT: ZONE CHANGE 84-3 On February 7, 1984, the Planning Commission voted 5-0 (2 absent) to approve a zone of R3-16 in the Oakwood area. It was agreed by the Commission that the limitation was applied for two reasons: 1)The density bonus , when applied to the R3-16 zoning would obligate the City to 20 units per acre as opposed to 24 units per acre on the R3-20 proposal . It would also keep the zoning within the range of the existing 18 units per acre and, con- sequently, consistent with present development---since housing in this area is assuredly for low-to-moderate income families and the density bonus would be applied under renovation or new development. 2)It is . important to recall the problems the Oakview area has experienced and the hundreds of thousands of dollars the City and other governmental agencies have "pumped" into this com' munity in order to alleviate the situation. Much of the prob- lem can be traced to the density of development and its extent there. It is not felt that either the City's nor Oakview's best interests are served by compounding those problems through yet more' dense development---in this case a 33 and 1/3 percent increase over the existing density. Consequently, the Commission feels the R3-16 zoning for the subject area is appropriate and recommends the Council approve the zone change- as forwarded. Marcus M. Porter Chairman ORDINANCE NO. This zone change request was heard by the City Council on June 18, 1984 and amended by the Council as attached. RECOMMENDATION: Staff Recommendation: Staff recommends that the City Council introduce Zone Change No. 84-3A, changing the zoning on the subject lots from R3 to R3-20, by adoption of the attached ordinance. Planning Commission Recommendation: At its June 19, 1984 meeting, the Planning Commission was informed of the City Council ' s amendment to Zone Change No. 84-3A and deferred discussion until the July 10, 1984 meeting. ANALYSIS: Applicant: City of Huntington Beach Location: Koledo Lane (Lots 3-10 and 36-43 of - Tract Map 4301) Request: To permit a change of zone from R3 to R3-20 Discussion: - Zone Change No. 84-3A was submitted to the City Council on June 18 , 1984 . The ordinance at that time was for a change of zone from R3 to R3-20 on 37 . 6 acres of property in the Oakview Redevelopment Area PI O 4/81 6C 84-3A June 22 , 198.4 Page 2 The Planning Commission' s recommendation at the time was that the ordinance be amended to reflect R3-16 with provisions for a density bonus to allow up to 20 units per acre. The Commission was con- cerned that-excessive densities in the area could occur- if R3-20 zoning were adopted and then subjected to density bonuses. After considerable discussion, the City Council concurred with the Planning- Commission' s concerns about density. As a result, the Pouncil voted* to deny the R3-20 by a 4 to 3 vote. A second motion followed which recommended that Koledo Lane be separated from the rest of the properties in the subject area and sent back to the Planning Commission for a report. This motion passed by a 5 to 2 vote. Later in the meeting, Council voted to reconsider this item and voted to approve the R3-20 designation on Lots 3-10 and 36-43 of Tract Map 4301. No zone change was approved for the other properties in the subject area. The attached zone change ordinance reflects the revised legal description as approved by Council at thee= June : 18 , 1984 meeting. At its June 19, 1984 meeting, the Planning Commission was informed of the City Council ' s action on the zone change request; however, because of the lateness of the hour discussion on the item was deferred to the meeting of July 10 , 1984 . ENVIRONMENTAL STATUS: Zone Change No. 84-3A was originally assessed through Environmental Im- pact Report No. 83-2, which was adopted by the City Council on November 28 , 1983. Further environmental analysis is not required under the provisions of the California Environmental Quality Act. ALTERNATIVE ACTION: The City Council may consider denying Zone Change No. 84-3A and retain- ing the existing R3 zoning with no additional limitation. Rezoning of the property from R3 to R3-20 is' consistent with the City' s adopted Land Use Element of the General Plan which designates the area as Medium High Density Residential. Discussion: On November 28 , 1983 , the City Council approved a General Plan Land Use Element Amendment changing the land use designation in the Oakview Area from Medium Density Residential to Medium High Density Residential. The amendment was intended to bring the General Plan designation into consistency with the existing R3 zoning and to permit the development of the proposed Koledo Lane Improvement Project within the Oakview Redevelopment Area. The Council was concerned, however, that the amendment would permit higher densities to occur in the Oakview Area than presently exist. Because of this concern, LUE 83-3 was approved on the condition that a zone change limiting densities to 20 units per acre (R3-20) be initiated for the Oakview Area. Zone Change No. 84-3A has been prepared in response to that direction. R3 zoning , when utilized in conjunction with a General Plan designation of Medium High Density Residential, will permit a density of 25 units per acre. The Oakview Area, which has both R3 zoning and a General Plan designation of Medium High Density Residential, is presently developed to an overall density of 18 units per acre. The proposed Koledo Lane project is proposing additional units and rehabilitation of existing units and will have a density of 20 units per acre. The proposed zone change= to R3-20 will permit the Koledo Lane project to be completed and will limit densities in the remainder of the Oakview Area to 20 units per acre. The Planning Commission, however, in its review of the zone change request was concerned about permittinq the density that R3-20 zoning would allow. They felt that densities of 25 units per acre -2- 6-6-84 - RCA • ��-lam could result if density bonuses were requested. The Planning' Commission therefore recommended that the zone change ordinance be amended to specify R3-16 zoning with a maximum allowance of up to 20 units per acre with a density bonus. Staff dries not concur with the Planning Commission.'_ . recommendation. The existing overall density in the Oakview Area, at 18 units per .acre , already exceeds . the Planning Commission' s proposed R3-16 zoning. Further, the City has not solicited or received affordability commitments from the Koledo Lane property owners for the improvement project which will be developed at 20 units per acre. The 20 unit per acre density incentive is to encourage upgrading of the neighborhood rather than ensured affordability. As such, R3-20 zoning is the minimum zoning necessary for the project to continue. Some discussion took place regarding the design and financing of the Y.oledo Lane Project, currently underway in the Oakview area. Secretary Palin . stated that the proposed zone change would bring the area into consistency. The public hearing was opener] . Seeing there was no one who wished to address this item, the public hearing was closed . Lengthy diSCuSSion took: place regarding the possibility .of developers, requesting density bonuses in this area . Secretary' Pal-in stated that there was noshing in the proposed ordinance to prevent that , however , he explained that the Commission did not have to grant these. requests that deviate from the code . Commissioner Schumacher suggested that wording to the effect of including density bonus for housing , shall not exceed 20 units per acre" . She suggested R3-1G , instead of � R3-20 .
