Mayor Moulton-Patterson called the adjourned regular meetings of the City Council and the Redevelopment Agency of the City of Huntington Beach to order at 5:55 p.m. PRESENT: Bauer, Moulton-Patterson, Winchell, Sullivan, Silva (arrived 8:10 p.m.) ABSENT: Robitaille, Leipzig (City Council) PUBLIC HEARING - INTRODUCTION APPROVED - ORDINANCE NO. 3244 AS AMENDED - CODE AMENDMENT NO. 93-10 - TO PERMIT MINIMUM OF THREE FOOT SETBACKS FOR FIREPLACES AND ARCHITECTURAL FEATURES INTO SIDEYARD AREAS - SEACLIFF PARTNERS - HOLLY SEACLIFF SPECIFIC PLAN (640.10) The Mayor announced that this was the day and hour set for a public hearing to consider the following: APPLICATION NUMBER: Code Amendment No. 93-10 APPLICANT: Seacliff Partners LOCATION: Applies to all residential planning areas in the Holly Seacliff Specific Plan. ZONE: Holly Seacliff Specific Plan/Recreational Open Space/High Density Residential REQUEST: To amend the Holly Seacliff Specific Plan to allow a minimum three foot sideyard setbacks for fireplaces, unroofed balconies, open stairways and architectural features. The current requirement is five feet. ENVIRONMENTAL STATUS: Categorically exempt pursuant to City Council Resolution No. 4501, Class 20 which supplements California Environmental Quality Act. COASTAL STATUS: This project will result in an amendment to the City's Certified Local Coastal Program which is subject to the approval by the California Coastal Commission. The City Clerk presented Amended Ordinance No. 3244 from the Community Development Department The Community Development Director presented a staff report. r ' 1) Interior Side Yard Dwellings, garages and accessory buildings: Minimum of three (3) feet. Eaves: Eighteen(18) inches. Fireplaces: Thirty(30) inches.. Bay windows, unroofed balconies, open stairways and other architectural features: Three (3) feet. 2) Exterior Side Yard Dwellings and accessory buildings: Minimum of six (6) feet. Side entry garages or carports: Six (6) feet. Eaves: Eighteen(18) inches. Fireplaces: Three and one-half(3.5) feet. Bay windows, unroofed balconies, open stairways and other architectural features: Four(4) feet. 3) Exception for Zero Lot Line A zero side yard setback or a zero rear yard setback shall be permitted as long as the following requirements are met: • The lot adjacent to the zero setback side or rear yard shall be held under the same ownership at the time of application and the setback for the adjacent lot shall be either zero or a minimum of six (6) feet. • No portion of the dwelling or any architectural features shall project over the property line, except rooftop eaves no greater than 24-inches. • The zero setback shall not be adjacent to a public or private right-of-way. • Exposure protection between structures shall be provided as specified by the Fire Department and the Community Development Department. 4 4\s\Ord:Holly-S.S.P.93-10\07/19/94 SECTION 4. The Holly-Seacliff Specific Plan is hereby amended by amending Section III(D)(4)(g)thereof relating to Medium Density Residential (RM)Development Standards, to read as follows: g. Setback (Side Yard) The minimum setback from the side property lines shall be as follows: 1) Interior Side Yard Dwellings, garages and accessory buildings: Minimum of five (5) feet. Also, fifteen(15) foot minimum building structure separation for one (1) and two (2) story buildings on the same lot. Twenty (20) foot minimum building structure separation for three (3) story buildings on the same lot. Eaves: Eighteen (18) inches. Fireplaces: Thirty (30) inches. The Holly-Seacliff Specific Plan is hereby amended by amending Section III (D)(5)(g) thereof relating to Medium-High Residential (RMH) Development Standards, to read as follows: g. The motion carried by the following roll call vote: AYES: Silva, Bauer, Moulton-Patterson, Winchell, Sullivan NOES; None ABSENT: Robitaille, Leipzig FINDINGS FOR APPROVAL - CODE AMENDMENT NO. 93-10 1. Code Amendment No. 93-10, a request to amend the Holly-Seacliff Specific Plan to reduce minimum interior and exterior sideyard setbacks for fireplaces, bay windows, unroofed balconies, open stairways, architectural frontyard and clarify the minimum building separation between structures on the same lot, will maintain access for emergency exiting. 2. Code Amendment No. 93-10 to amend the Holly-Seacliff Specific Plan to reduce minimum interior and exterior sideyard setbacks for fireplaces, bay windows, unroofed balconies, open stairways, architectural frontyard and clarify the minimum building separation between structures on the same lot, is consistent with existing city-wide residential development standards which permit a minimum 30 inch setback for fireplaces, bay windows, unroofed balconies, open stairways and architectural features in sideyard areas. 3. Code Amendment No. 93-10 is consistent with the goals and policies of the City's General Plan, the Holly-Seacliff Master Plan and the City's Coastal Element. The Code amendment is consistent with existing City's Zoning, Building and Fire Codes. The request is consistent with existing City- wide development standards for residential.areas. Staff supports the request because it is consistent with existing City development standards, it will provide flexibility for interior design and utilization of outdoor areas. The Building Division and the Fire Department have reviewed the request and have indicated that maintaining the minimum two and one-half(2.5) foot interior setback for fireplaces and minimum three (3) foot interior setback for bay windows, unroofed balconies, open stairways and architectural features will comply with the requirements of the Uniform Building Code and the Fire Code. Since the minimum clearance of two and one-half(2.5) feet will be maintained for the entire length of the side building elevation, access for emergency exiting will be maintained. Also, the request is consistent with existing City-wide residential development standards contained in the Huntington Beach Ordinance code which permit a minimum two and one-half(2.5) foot feet for fireplaces and a three (3) foot sideyard setback for bay windows, unroofed balconies, open stairways and architectural features. Staff supports the request because the minimum two and one-half(2.5) foot setback for emergency access will be maintained, the request is consistent with City-wide regulations (Division 9) and the amendment will greatly benefit the ultimate floor plan layout for future dwellings in the Holly-Seacliff Specific Plan. The two and one-half(2.5) foot sideyard setback for fireplaces will permit the fireplace to be recessed from the interior floor plan which creates the opportunity for better interior design. The minimum three (3) foot setback for bay windows, unroofed balconies, open stairways and architectural features will allow flexibility in the utilization of outdoor areas. The projection of architectural features allow variety in exterior building walls which enhances design diversity. In addition to the sideyard setback amendment, language regarding clarification of building separation is being proposed. Presently, the Why,-Seacliff Specific Plan requires minimum five (5) feet interior sideyard setbacks and a ten ( *)',toot exterior sideyard setback for these types of structures and architectural features. The request for RL-3 is for a two and one-half(2.5) interior sideyard setback for fireplaces and a three (3) foot interior sideyard setback for bay windows; and a three and on-half(3.5) foot exterior sideyard setback for fireplaces and a four(4) foot exterior setback for bay windows. (See Attachment No. 2 for a code amendment matrix .) This code amendment also clarifies building seperation on the same lot. Following the Planning Commission's action, the code amendment will be forwarded to the City Council for final action. Staff Report-3/15/94 1 (pcsr026) 3.0 ENVIRONMENTAL STATUS: Categorically exempt pursuant to City Council Resolution No. 4501, Class 20 which supplements the California environmental Quality Act. 4.0 COASTAL STATUS: Code Amendment No. 93-10 will result in an amendment to the city's certified Local Coastal Program because a portion of the Holly-Seacliff Specific Plan is located in the Coastal Zone. Any change in the development standards or land use designation of the Holly-Seacliff Specific Plan is subject to final approval by the California Coastal Commission prior to implementation. 5.0 REDEVELOPMENT STATUS: Not applicable. 6.0 SPECIFIC PLAN: Code Amendment No. 93-10 represents a minor land use modification to the setback regulations of the Holly-Seacliff Specific Plan. 7.0 SUBDIVISION COMMITTEE: Not applicable. 8.0 ISSUES AND ANALYSIS: The Building Division and the Fire Department have reviewed the request and have indicated that maintaining the minimum two and one-half(2.5) foot interior setback for fireplaces and minimum three (3) foot interior setback for bay windows, unroofed balconies, open stairways and architectural features will comply with the requirements of the Uniform Building Code and the Fire Code. Since the minimum clearance of two and one-half(2.5) feet will be maintained for the entire length of the side building elevation, access for emergency exiting will be maintained. Also,the request is consistent with existing City-wide residential development standards contained in the Huntington Beach Ordinance code which permit a minimum two and one-half(2.5) foot feet for fireplaces and a three (3) foot sideyard setback for bay windows, unroofed balconies, open stairways and architectural features. Staff supports the request because the minimum two and one-half(2.5) foot setback for emergency access will be maintained, the request is consistent with City-wide regulations (Division 9) and the amendment will greatly benefit the ultimate floor plan layout for future dwellings in the Holly-Seacliff Specific Plan. The two and one-half(2.5) foot sideyard setback for fireplaces will permit the fireplace to be recessed from the interior floor plan which creates the opportunity for better interior design. The minimum three (3) foot setback for bay windows, unroofed balconies. open stairways and architectural features will allow flexibility in the utilization of outdoor areas. The projection of architectural features allow variety in exterior building walls which enhances design diversity.
