RECOMMENDATION: The Planning Commission and Planning Staff recommends that the City Council approve Code Amendment No. 78-8 and adopt the attached ordinance. ANALYSIS: Applicant: '_-.'_Initiated by -.the Planning Commission Location: Non applicable Request: To amend a number of provisions in Division 9 in order to alleviate minor problems that have arisen over the past few years. PLANNING COMMISSION ACTION ON NOVEMBER 21 1978: ON MOTION BY HIGGINS AND SECOND BY PAONE, CODE AMENDMENT NO. 78-8 WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley, Cohen, Paone NOES: None ABSENT: Bazil ABSTAIN: None Pio sns Page Two DISCUSSION: Code Amendment No. 78-8, Miscellaneous Code Revisions will amend a number of minor problems that have arisen in Division 9 over the past few years. Included in this amendment is the addition of definitions for the planned residential development ordinances , the elimination of out-of-date density requirements in -the. R-2, R-3, and R-4 districts regarding the` townlot area, clarification of outside storage activities and parking requirements for service stations, a provision to allow extensions of time for use permits, a provision to allow for lot line adjustments, clarification of setbacks and corrections in legal description for the townlot specific plan and clarification of setbacks for the oldtown specific plan and a clarification of density standards for the R-2 R-3, and R-4 districts. The provisions of Code Amendment No. 78-8 were pursued in light of the Division 9 rewrite based on the necessiity to eliminate the minor problems that .are present with the daily use of this code. ENVIRONMENTAL STATUS: Code Amendment No. 78-8 is exempt from the provisions of the California Environmental Quality Act. A Notice of Exemption has been attached. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: The City Council may consider alternative action to Code Amendment No. 78-8- by not approving said code amendment and requiring these alterations be included in the division rewrite.
