City Administrator's Comments Approve as recommended Statement of Issue, Recommendation, Analysis, Funding Source, Alternative Actions: 1 N 1 STATEMENT OF ISSUE: Transmitted for consideration is Code Amendment No. 78-7, a reduction in the required outdoor play area for day care centers and nurseries from 175 square feet per child to 75 square feet per child with a 500 square foot minimum area. RECOMMENDATION: The Planning Commission and the Planning Staff recommends that the City Council approve Code Amendment No. 78-ff-7 ANALYSIS: APPLICANT: Initiated by the Planning Commission LOCATION: Citywide REQUEST: Reduction in the required outdoor play area for day care centers and nurseries from 175 square feet to 75 square feet per child. PLANNING COMMISSION ACTION OF AUGUST 1. 1978: ON MOTION BY HIGGINS AND SECOND BY BAZIL RESOLUTION NO. 1233, A RESO- LUTION OF THE PLANNING COMMISSION OF THE CITY OF HUNTINGTON BEACH RECOMMENDING ADOPTION OF CODE AMENDMENT NO. 78-7, REDUCTION OF OUTDOOR PLAY AREA, TO INCLUDE A MINIMUM OF 500 SQUARE FEET OF OUTDOOR PLAY AREA AS REQUIREMENT, WAS APPROVED BY THE FOLLOWING VOTE: AYES: Higgins, Russell, Stern, Finley,. Cohen, Bazil, Paone NOES: None ABSENT: None Plo 3/78 Page Two DISCUSSION: This code amendment was prepared on direction of the Planning Commission after reviewing a conditional use permit and conditional exception requesting an expansion of an existing day care center and the reduction of the outdoor play area. Based on a survey of many Orange County cities and.the requirement of the State, 75 square feet of outdoor play area per child is the norm for day care and .nursery facilities. The Planning Commission' - expanded this amendment at the time of approval by requiring that each facility have at least one area.having a mininum of 500 square feet. This 500 square foot minimum area is to be planted with grass and enclosed by a six (6) foot high fence. ENVIRONMENTAL STATUS: The Environmental Resources Section of the Planning Department has reviewed this code amendment pursuant to the provisions of the California Environmental Quality Act of 1970, the staff has determined' that there is no environmental assessment required for Code Amendment No. 78-7. FUNDING SOURCE: Not applicable. ALTERNATIVE ACTION: The Council may consider a higher square footage requirement for out- door play area, however, the proposed 75 square foot per child is in keeping with the State's requirement and with most surrounding cities. This 75 square foot requirement will encourage additional day care facilities to locate in the City without creating any undue hardships on them. SURROUNDING INFORMATION: 1.
