SUMMARY ANALYSIS: Presently, the ordinance code states that mandatory processing dates for applications will commence after "final environmental evaluation." Prior to recent revisions in state and local laws, final environmental evaluation took place at staff level. The law now states that the discretionary body, i.e., City Council, Planning Commission, or the Board of Zoning Adjustments, is now required to make the final determination on environmental documents. Therefore, processing deadlines which were designed to complete development review within reasonable time periods cannot be ensured unless an ordinance revision clarifying these deadlines is carried out. This code amendment would define final environmental evaluation and amend portions of the ordinance code to reestablish processing deadlines in order to assure completion of an application in a timely manner.
