ON MOTION BY SHEA AND SECOND BY NEWMAN CODE AMENDMENT NO. 77-7 WAS
APPROVED BY THE FOLLOWING VOTE:

PLANNING COMMISSION AND STAFF RECOMMENDATION:
Approve Code Amendment NO. 77-7.
SUMMARY ANALYSIS:
The attached code amendment has been prepared to execute the recent
change in duties and responsibilities between the Planning and
Building Departments. The greater part of the ordinance is devoted
to transferring citations of authority from the Building Department
to the Planning Department in view of the recent changeover of the
land use function (land use plan check and field enforcement) to the
Planning Department.
This code amendment would also modify the staff representation on }
the Environmental Review Committee. The amendment would remove the
obligation of having a Building Department representative on the
committee at all times. The proposed amendment would establish the
Environmental Review Committee composed of two representatives from
the Planning Department and one representative selected from another
appropriate City department, provided that the Director of Planning
and the department head of such department mutually consent to
committee representation. At this point in time, the Department of
Public Works would maintain a representative on the committee.
The intent of removing the Building Department' s representation from
permanent status on the committee is in recognition of currently
available manpower as a result of reorganization of that department.

attached.

ENVIRONMENTAL STATUS:
Proposed Code Amendment No. 77-7 is categorically exempt from the
provisions of the California Environmental Quality Act (see Notice
of Exemption No. 77-11 attached) .
FISCAL IMPACT OF PROPOSED LEGISLATION:
The proposed code amendment would not pose a fiscal impact as a
result of its adoption.

RECOMMENDED ACTION:
Approve Code Amendment No. 77-7
1.0 BACKGROUND INFORMATION:
The attached code amendment has been prepared to execute the recent
change in duties and responsibilities between the Planning and
Building Departments.' The amendment is lengthy only because of the
numerous citations of authority which must be altered to effect this
change. In substance, however, the amendment centers on carrying
out two significant changes in jurisdiction between the two departments"
that of transferring the land use functioh, (land use plan check and
field .enforcement) from the Building Department to the Planning
Department and modifying staff representation on the Environmental
Review Committee.
The proposed code amendment would entail revisions to both Division 9
of the Huntington Beach Ordinance Code (involving primarily changes in
responsibility for reviewing such physical improvements as landscaping, `-
lighting, signs, displays and other related matters) and the Huntington "
Beach Municipal Code, revising the duties of the Planning Director
and Building Director.
As the code is presently structured, the Environmental Review Committee .;
consists of one representative from the Planning, Building, and Public
Works Departments. This amendment would remove the obligation of
having a Building Department representative on the board at all times . s
The proposed amendment would establish the Environmental Review Com-
mittee composed of two representatives from the Planning Department '
and one representative selected from another appropriate City .depart-
ment provided that' the Director of 'Planning and the department head
