SUMMARY ANALYSIS: This Code Amendment would allow for the installation of overhead cable television lines where overhead transmission facilities exist in developed residential areas. The amendment was initiated in order to remove an unreasonable restriction to undergrounding cable television within existing residential areas . At such time as existing overhead lines were required to be undergrounded, C.A.T.V. lines as well would be required to be placed underground. ENVIRONMENTAL STATUS: The subject proposal is categorically exempted from the requirements of the California Environmental Quality Act pursuant to the environ- mental guidelines commencing with Section 15101. The proposed Code Amendment was issued as a Class I exemption pertaining to existing facilities for the minor alteration of existing public and private structures. 0 C2). A copy of the notice of exemption is attached for the Commission' s review (see Attachment 1) . 4. 0 BACKGROUND INFORMATION: The subject Code Amendment is being proposed to equitably allow cable TV lines to be installed overhead where overhead utilities exist in older residential areas. It is not feasible at this time to require that cable TV lines must be installed underground in these areas as the cost would be prohibitive. The department is suggesting that such facilities would remain a part of the overhead network until such time as all of the facilities have been planned to be undergrounded. The subject Code Amendment has been set for public hearing without proceeding with review of its contents by the Planning Commission at a study session. This is consistent with Planning Commission Policy No., 77-1, which states " . . .department initiated planning proposals shall be scheduled .as a discussion item before setting for public hearing, except matters which would not result in significant new standards or concepts . . . .." . The staff believes this particular Code Amendment is in that category. Approval of this Code Amendment would not be inconsistent with the franchise agreement for cable TV installation between the public cable television authority (the Cities of Westminster, Fountain Valley, Page 2 and Huntington Beach) and Dickinson Communications, Ltd. , the company which would provide cable television service. 3 . 0 FISCAL IMPACT OF PROPOSED ORDINANCE : Approval of this ordinance or subsequent actions through its use is not anticipated to pose a .fiscal impact upon the City. 4. 0 SUGGESTED ACTION : Approve Code Amendment No. 77-8 .
