"REVISION TO MISCELLANEOUS PROVISIONS"
PLANNING COMMISSION ACTION:
On motion by Shea and second by Boyle Code Amendment No. 77-4 was approved
by the following vote:
AYES : Parkinson, Finley, Gibson, Shea, Newman
NOES: None
ABSENT: Slates
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission recommends approval of Code Amendment No . 77-4 .
SUMMARY ANALYSIS:
Code Amendment No. 77-4 will clarify application requirements for
structures that are proposed to be located more than 150 feet from a
public street.
Presently, development of such structures under the R2 and R3 residential
zoning provisions are subject to a Use Permit, whereas, an Administrative
Review application is stated to be required for such structures under
Article 973 "Miscellaneous Provisions . "
To resolve this conflict, Code Amendment No. 77-4 proposes to repeal
those sections of the R2 and R3 zoning provisions where reference is made
to the Use Permit requirement and amend Section 9730 .20 of Article 973
to read as indicated on the attached Code Amendment.
It is intended that the Code Amendment will remedy this conflict and
eliminate an unnecessary duplication of the same provision.
ENVIRONMENTAL STATUS:
The Department of Environmental Resources has reviewed this Code Amend-
ment and has issued a categorical exemption on the project.

FISCAL IMPACT OF THE PROPOSED LEGISLATION:
No negative fiscal impact is anticipated to be generated from the pro-
posed code amendment.
