On motion by Bartlett, Council waived. further reading of Ordinance
No. 1664 by the following vote:
AYES: Councilmen: Shipley, Bartlett, Green, Matney, Coen, McCracken
NOES: Councilmen: None

NEWLAND NO. 5 ANNEXATION -REFERRED TO CITY CLERK
The Clerk presented a communication from Corine, Julien and Donna
Lecrivain, legal owners of the parcel of land located on the north-
west corner of Talbert Avenue and. Newland. Street, requesting that
the city proceed. with the annexation of same, said. annexation to
be designated. as Newland #5 Annexation.
The City Clerk further informed. Council that the property owners
have waived. any right to hearing before the City Council.
Following discussion, on motion by Green, Council deferred action
on this matter, and directed. the City Clerk to present a report
on the possibility of enlarging the annexation to include the
entire parcel. The motion was passed by the following vote:
AYES: Councilmen: Shipley, Bartlett, Green, Matney, Coen, McCntci,:en
NOES: Councilmen: None

By unanimous vote, the. Planning Commission approved Code
Amendment No 71-3 on February 17 , 1971, and recommends
adoption by your Honorable Body.
The State Planning Act requires a public hearing be held
after which the Code Amendment may be adopted by Ordinance.

RE: CODE AMENDMENT NO. 71-3
The above referenced code amendment proposes Eb. amend
Section 9251 of the R5 Office Professional District
to require -approval of an Administrative Review appli-
cation before the Board of Zoning Adjustments for all
uses.
This matter was discussed at the Planning Commission
at a previous Study Session at which time it was pointed
out that the R5 zone was the only district in the code
that did not require administrative approval. In view
of this, the Planning Commission requested the staff
to set the matter for public hearing.
The staff recommends approval of Code Amendment No. 71-3.
