A motion was made by Councilman Matney, to approve the agreement
between the City and N:r.•. Aiibroy fTo-r,ji, f.'or management oC construction
operations for the Civic Center and h1brary complex, as ainended9 a. id
that the Mayor and City Clerk be directed to execute same , on behalf'
of the City, subject to prior approval of the City Administrator and
City Attorney. The motion was passed by the following roll .call_ vnte:
AYES: Councilmen: Bartlett, Gibbs , Green, Matney, Coen, McCracken
NOES: Councilmen: None
ABSENT: Councilmen: Shipley
BUDGET - WEST ORANGE COUNTY WATER BOARD - RATIFIED
The City Administrator informed Council of a communication from the
Secretary of the West Orange County Water board presenting; a budget
of the Board for Fiscal Year 1971-72 which had been previously adopted
by said Board.. He stated that the City was requested to ratify their
approval of said budget.
On motion by Green, Council ratified the budget of the West Orange
County Water Board for the Fiscal Year 1971-72. Motion carried .
ORDINANCES FOR INTRODUCTION
On motion by Green, Council directed the City Clerk to read Ordinance
Nos . 1647, 1648 and. 1649, by title and waived further reading by
unanimous consent.

On motion by Matney, Council directed, that the .following persons, be
appointed to the Citizens Steering Committee for Goal,. and Objectives:
Pete Horton, Dick Huston, Brian Kniff, Jim Sheppard, Jeanette Turk,
Prim Keevil, and Bob Sutake, with Lloyd Budwig to ser .ye as alter;�ate .
Motion carried .
Oil Committee
On motion by Green, Cov.ncil directed that a public hearing on the pro-
posed oil ordinance be scheduled for June 21, 1.971. 1.1otion Carried .
COMMENTS FROM COUNCIL
Rotary Mud Dump
Councilman Green reported that Steverson Brothers , ow_.iers of the rotary
mud dump located at the southwest corner of Magnolia ;,treet arid hiamilton
Avenue, had informed the City that they would cease a Ll dumping opera-
tions as of June 1, 1.971, and that the area had been fenced with barked
wire to prevent children from entering the area. He Curther informed-
Council that consideration was being given to a new J 3.panE,,,e process for
removing the oil wastes at the dump site, and that wh,.n more inform€.tion
on this process becomes available , it would be forwar-led to the council.

The Assistant Planning Director presented a resume ' of the Planning
Commission 's reasons for recommending approval of Code Amendment No.
71-4.
The Clerk informed Council that all legal requirements for publication
and posting on said public hearing had been met and that he had received
no communications or written protests to Code Amendment 71-4 or to the
recommendation of approval of the Planning Commission.
Mayor McCracken declared the hearing open.
There being no one present to speak on the matter and there, being no
protests filed , either oral or written, the hearing was closed by the
Mayor.
On motion by Green, Council sustained the decision of the Planning Com-
mission, approved Code Amendment No. 71-4 and directed the City Attorney
to prepare an ordinance amending the Huntington Beach Ordinance Code
to effect same . Motion carried .
PUBLIC HEARING - CODE AMENDMENT NO. 71-6 - APPROVED
Mayor McCracken announced that this was the day and. hour set for a
public hearing on Code Amendment No. 71-6 to consider the following:
(1) Amend Article 973 Miscellaneous Provisions , by adding Section
9730.15.1 which shall read as follows: "Right-of-way dedication for
oil operation sites shall comply with all the requirements of Article
968, " and (2) Amend Article 968 Combining Oil Districts , by .adding cer-
tain .Sections that will provide for dedication and improvements for oil
operation sites .
The Clerk informed Council that all legal requirements for publication
and posting on said public hearing had been met and that he had received

the recommendation of approval of the Planning Commission.

Mayor McCracken announced. that this was the day ,!,nd hour set; for a public
hearing on Resolution No . 3289 of the City Counc..i.l, declaring a nuisance
to exist in the form of weeds , and directed. the (;1erk to reed the, le0al
notice .
The Clerk read notice of public hearing on Resolution No . 3289 of the
City Council, as posted conspicuously along all the streets and property
within the district described in said Resolution, setting the hour of
7: 30 P.M. , or as soon therafter as possible, on .Monday, the l9th day of
April, 1971, in the Council Chamber of the Civic Center, Huntington
Beach, California, as the time and place for a public hearing on a
declaration that a nuisance exists and providing for the ab „tement
thereof.
The Clerk informed the Council that he had. received no communications
or written protests to Resolution No. 3289 of the City Council proposing
to abate the weed nuisance, and read the Affidavit of Posting of Notices
to Destroy Weeds which had been executed by the Street Superintendent.

Gentlemen:
Transmitted herewith is a copy of Code Amendment No 71-6. Said amendment
proposes to: 1) Amend Article 973 Miscellaneous Provisions by adding
Section 9730.15.1 which shall read as follows: "Right-of-way dedication
for oil operation sites shall comply with all the requirements of Article
968", and 2) Amend Article 968 Combining Oil Districts by adding certain
Sections that will provide for dedication and improvements for oil opera-
tion sites.
The Planning Commission at their March 23,1971, Study Session meeting
unanimously approved Code Amendment No 71-6 and recommends adoption by
your Honorable Body.
The State Planning Act requires that a public hearing be held after which
the code amendment may be adopted by ordinance.

CODE AMENDMENT NO.71-6
(I) Add New Section 9730 . 15 . 1 March 19, 1971
"Right-of-way dedication for oil operation sites shall
comply with all the requiircments of Article 968 . "
(II) Add New Section 9687
"Dedication of Right-of-Way when Abutting Any
Highway, Street or Alley. - Prior to issuance of a drilling
permit for a new well located on any "01" parcel abutting
a public street , alley or highway, the street, alley
or highway abutting such parcel shall be dedicated to the
City of Huntington Beach to a width determined by either
of the following , whichever is greater :
(a) The current Master Plan of Arterial Streets
and Highways .
(b) An approved precise plan of street, highway
or alley alignment.
(c) Department of Public Works requirements .
(d) By ordinance . "
(III) Add New Section 9687 . 1
"Installation of Improvements when Abuttin
Any Highway , Street or Alley
No final inspection shall be given ;nor shall the well for
which dedication was required be operated until the required
dedication of right-of-way as described in Section 9687 has
been improved by the installation of street improvements
to the centerline of the street including curbs , gutters ,

sidewalks , paving , street trees , street lights , street signs ,
and street drainage in full compliance with City of
Huntington Beach Street Standards . "
(IV) Add New Section 9687 . 2
"When filing for the drilling permit,

the oil operator may file written. application to the
Planning Department to have the requirements of
Sections 9687 and 9687 . 1 waived for the well in question.
Said application shall be set for hearing before the
Board of Zoning Adjustments within 1.4 days following
receipt of the application . The applicant shall receive
at least 10 day' s notice of this meeting .
A majority vote of the Board shall determine the improve-
ment requirements .
In considering the application, the body shall evaluate
the request upon the following criteria :
" (a) Period of time that the parcel has been
previously devoted to oil operations and
contemplated life span of the project .
(b) Development of the surrounding area.
(c) The effect the proposed well has on
traffic at the site .
(d) The relationship between the proposed
requirements and the anticipated e?:pranded use .

Waiver of improvements for one or more wells on a parcel
will not preclude a determination that imT►i•ovements are
necessary prior to the drilling of another well on the
parcel.
Any decision of the Board may be appealed to the
Planning Commission within 10 days of its decision,
which shall be heard .within 30 days , upon 10 days notice
to the applicant.
(V) Note :
Section 9687 will be changed to 9688 and Section 9687 . 1
will be changed to 9688 . 1 .

City Council of the City of Huntington Beach, in the Council
