ENVIRONMENTAL COUNCIL
The Assistant City Administrator informed Council of a. re.quest from
the executive Board of the Environmental Council that Council appoint_..
V_r. Chris Doyle, Goldenwest College student, to fill one of the two
existing vacancies on the Environmental Council.
A motion was made by Councilman Coen, that Mr. Chris Doyle be- appointed.
to the Environmental Council, but was withdrawn befor6 being voted upon.
ORD. N0. 1620 - ZONE CASE NO. 70-19 - DEFERRED
The Clerk presented Ordinance No. 1620 for a second reading by title -�
"AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON
BEACH ORDINANCE CODE BY AMENDING SECTION 9061 THEREOF TO PROVIDE FOR
CHANGE OF ZONING ON REAL PROPERTY LOCATED ON THE NORTH SIDE OF HEIL
AVENUE BETWEEN SAYBROOK LANE AND A P3ONQUIN STREET (ZONE CHANGE CASE
NO. 70-19) . "
The Clerk informed the Council that he had received a communication
from Mr. Wilson Phelps, one of the landowners, requesting that the
second reading of Ordinance No. 1620 be deferred to the meeting of
3'u1y 19, 1971. -
Mayor McCracken directed that consideration of Ordinance No. 1620 be
deferred to the meeting of July, 19, 1971.
ORDINANCES FOR ADOPTION
The Clerk informed Council that they had been provided with a corrected
copy of Ordinance No. 1650.
On motion by Matney, Council directed the Clerk to . read Ordinance Nos .
1650 and. 1651 by title, waived further reading and passed and adopted
same by the following roll call vote:
AYES: Councilmen: Shipley, Bartlett, Matney, Coen, McCracken
NOES: Councilmen: None

ORD. NO. 1654 - DEFERRED'5- AIRPORT REGULATIONS
The Clerk presented Ordinance" No. 1654 for a .first reading by title -
"AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON
BEACH ORDINANCE CODE BY ADDING THERETO ARTICLE 608 REGULATING AIRPORTS
WITHIN SAID CITY."
iMayor VcCracken directed that consideration of Ordnance No: 1654 be.
deferred to the 7: 30 portion of the Council Meeting.

On motion: by Bartlett, Council directed the City Clerk to read Ordi-
nance Nos . 1655 and. 1656 by title and waived further reading by the

Coast Community College Dist. - Joint Police Facilities Training Pro&ram
The City Administrator informed Council of a request from the Police
Department for permission to apply for a Federal Grant which would allow
tree Police Department to participate in the Coast Community College
District Joint Police Facilities Training Program.
Captain Michael Burkenf field, Police Department, addressed Council and
explained that participation in this program would enable police officers
to receive communications training on a twenty-four hour basis through
Computer Terminals which would be installed in the Police Department,
as well as visual instruction by a microfiche unit which would be included
in the second phase of the program.
On motion by Coen, Council directed that the Huntington Beach Police
Department be authorized to apply to the Federal Government for funding
to participate in the Coast Community College District - Joint Facilities
Training Program, by the following vote:
AYES: Councilmen: Shipley, Bartlett, Gibbs, Matney, Coen-, McCracken
NOES: Councilmen: None
ABSENT: Councilmen: Green

The Clerk presented Ordinance No. 1650 for a first reading by title
"AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON
BEACH ORDINANCE CODE BY AMENDING SECTION 9862 THEREOF TO PERMIT THE
PLANNING COMMISSION TO REJECT AN APPLICATION WHICH IS NOT IN ACCORDANCE
WITH THE PROVISIONS OF THE ORDINANCE."
Considerable discussion was held by the Council, City Attorney, and
Planning Director concerning the matter of determining whether an appli-
cant has made the effort to complete the application for the item
petitioned for, as prescribed by the ordinance code . The City Attorney
recommended that the word "completed" be inserted in the section' being
amended immediately following the word "not'" .
The Clerk was directed to give Ordinance No. 1650, a first reading by
title, as amended , and on motion by Coen, Council waived further read-
ing of- Ordinance No. 1650, as amended, by the following vote:
AYES: Councilmen: Shipley, Bartlett, Gibbs, Matney, Coen, McCracken
NOES: Councilmen: None

The Clerk informed Council that all legal requirements for publication
and posting had been met and that he had received no communications
or written protests to Code Amendment No. 71-3, or to the recommenda-
tion of approval of the Planning Commission.
Mayor Pro Tempore Matney declared the hearing open_.
There being no one present to speak on the matter and there being no
protests filed, either oral or written, the hearing was closed by the
Mayor Pro Tempore .
On motion by Bartlett, Council sustained the decision of the Planning
Commission; approved Code Amendment No. 71-5, and directed the City
Attorney to prepare an ordinance amending the Huntington Beach Ordinance
Code effecting same . Motion carried .
PUBLIC HEARING - CODE AMENDMENT N0. 71-7 - APPROVED
Mayor Pro Tempore Matney announced that this was the day and hour set
for a public hearing on Code Amendment No. 71-7 which proposes to amend
the Huntington Beach Ordinance Code as follows: Section 9862-Rejection
of Faulty .Petition - The Planning Director or his representatives shall
refuse to accept for filing, any application required to be filed with
the Planning Department when said application does not contain informa-
tion required to be provided, is improperly filled out, or on its face,
does not meet the requirements of this code .
The Clerk informed Council that all legal requirements for publication
and posting had been met and that he had received no communications or
written protests to Code Amendment No . 71-7 or to the -recommendation
of approval by the Planning Commission.
Mayor Pro Tempore Matney declared the hearing open.
There being no one present to speak on the matter and there being no

the Mayor Pro Tempore.
On motion by Green, Council sustained the decision of the Planning Com-
mission; approved Code Amendment No. 71-7; and directed the City Attorney
to prepare an ordinance effecting the Huntington Beach Ordinance Code
to effect same . Motion carried.
REQUEST FOR RECONSIDERATION - EARL CARRAWAY
Mr. Earl Carraway, representative of the A.L. Gindling Company, Los
Angeles , addressed Council regarding Counil 's rejection of the appeal
filed by A. L. Gindling Company to the denial by the Planning Commis-
sion of Conditional Exception No. 71-7, as said appeal had not been
filed according tc Lhe requirements set forth in Article 988 of the
Huntington Beach Ordinance Code .
He requested that Council grant permission to the A. 1. Gindling Company
to continue the use of the directional sign only until the remainder
of their houses are sold .
Considerable discussion was held between: the Council "nd Mr. Carvaway,
however, no action was taken on the matter.
ADJOURNMENT
On motion by Green, the regular meeting of the City C )unci 1 of t:ie City
of Huntington Beach adjourned at 1: 10 A.M.

Gentlemen:
Transmitted herewith is a copy of Code Amendment No 71-7. Said amendment
proposes to amend Section 9862- Rejection of faulty petition to read as
follows: "The Planning Director or his representative shall refuse to
accept for filing any application required to be filed with the Planning
Department, when said application does not contain information required
to be provided, is improperly filled out, or on its face, does not meet
the requirements of this code."
The Planning Commission at their March 16, 1971 meeting unanimously
approved Code Amendment No 71=7 and recommends adoption by your Hororable
Body.
The State Planning Act requires that a public hearing be held after which
the code amendment may be adopted by ordinance.

RE: CODE AMENDMENT NO. 71-7
The above referenced code amendment proposes to amend
Section 9862 - Rejection of Faulty Petition. This
section of the code presently permits the Planning Com-
mission or City Council to reject an application if it
has not been prepared in accordance with the provisions
of the code.
This code amendment permits the Planning Director or
his representatives to refuse to accept for filing any
application required to be filed with the Planning De-
partment when said application does not contain informa-
tion required to be provided or is improperly filled
out or on its face does not meet the requirements of
the code.
This code amendment was discussed with the Planning
Commission at a prior Planning Commission meeting at
which time it was agreed that the matter should be set
for public hearing.
The staff recommends approval of Code Amendment No. 71-7.
