Revocation of Inactive Certificates of Public Need and Necessity
The Acting City Administrator was requested by Council to submit a
list of .the businesses licensed in the City under a Certificate of
Public Need and Necessity which have discontinued operations, so that
Council may take action to revoke their Certificates .

Discussion was held by Council regarding the importance of postponing
implementation of the new requirem nts until the State Water Resour-
ces Control Board has completed their study to determine if this large
expenditure of money will accomplish the purpose intended .
On motion by Matney, Council waived further reading of Resolution
No. 33895 and adopted same by the following roll call vote:

At the request of Councilwoman Gibbs, the Planning Director clari-
fied the reasons why these standards would not be imposed on dwel-
lings located in the townlot area on the north side of the proposed
Pacific Coast Freeway.
On motion by Green, Council waived further reading of Ordinance
No. 16814, by the following roll call vote:

PUBLIC HEARING - CODE AMNDMENT NO. 'r1-8 - APPROVED
Mayor McCracken announced. that this was the day and. hour set for a public
hearing for the purpose of considering a cod.e amendment to the
Huntington Beach Ordinance Code as follows:
1. Require a Use Permit where five or more dwelling
units are proposed for construction in the R2 Two
Family Residential District and require compliance
with the latest Standards for Apartment Developments .
2. Require a Use Permit where nine or more dwelling units are
proposed for construction in the R3 Limited Multiple Family
Residence District and require compliance with the latest
Standards for Apartment Developments.
3. Require a Use Permit where fifteen or more dwelling units are
proposed for construction in the R4 Multiple Family Residence
District and require compliance with the latest Standards for
Apartment Development .
The Clerk informed Council that all legal requirements for publication
and posting had been met, and that he had. received no communications
or written protests to Code Amendment No. 71-8.
The Planning Director presented a resume ' of the Planning Commission's
reasons for recommending approval of Code Amendment No . 71-8.
Mayor McCracken declared the hearing open.
There being no one present to speak on the matter, and. there being no
protests filed either oral or written, the hearing was closed by the
Mayor.
A motion was made by Councilman Matney, to sustain the decision of the
Planning Commission; approve Code Amendment No. 71-8 and direct the
City Attorney to prepare an ordinance amending the Huntington Beach
Ordinance Code . The motion was passed by the following roll call vote:
AYES: Councilmen: Bartlett, Gibbs, Matney, Coen, McCracken
NOES: Councilmen: None
ABSENT: Councilmen: Shipley, Green
PUBLIC HEARING- - ORD. 1651 - FIRST READING - BUDGET - FISCAL YEAR 1971-72
Mayor McCracken announced that this was the day and. hour set for a
public hearing on the Budget for the Fiscal Year 1971-72, and. directed.
the' Clerk to read the legal notice.
The Clerk read. the notice of public hearing as published in the
Huntington Beach News on May 27, 1971, and. June 3, 1971, setting the
hour of 7: 30 P.M. , or as soon thereafter as possible, on Monday, June
1971, in the Council Chamber of the Civic Center, Huntington Beach,
California, as the time and place for a public hearing for the purpose
of giving the first reading of an ordinance adopting the budget for the
City of Huntington Beach for the fiscal ,year 1971-72.
There being no one present to speak on the matter, and there being no
protests filed either oral or written, the hearing was closed by the
Mayor.
The Clerk was directed to give Ordinance No. 1651 a first reading by

Gentlemen.:
Transmitted herewith is a copy of Code Amendment No 71-8 . Said
amendment proposes to :
1) Require a Use Permit where five (5) or more dwelling units are
proposed for construction in the R2 Two Family Residential
District and require compliance with the latest Sfandards for
Apartment Developments ;
2) Require a Use Permit where nine (9) or more dwelling units are
proposed for construction in the R3 Limited Multiple Family
Residence District and require compliance with the latest
Standards for Apartment Developments ; and,
3) Require a Use Permit where fifteen (15) or more dwelling units
are proposed for construction in the R4 Multiple Family Resi-
dence District and require compliance with the latest Standards
for Apartment Developments .
The Planning Commission at their May 18 , 1971 meeting unanimously
approved Code Amendment No 71-8 and recommends adoption by your
Honorable Body.
The State Planning Act requires that a public hearing be held after
which the Code Amendment may be adopted by ordinance .

RE: CODE AMENDMENT NO. 71-8
The above referenced code amendment proposes to require
a use permit application for apartment developments of
5 or more units in the R2 zone, 9 or more units in the
R3 zone, and 15 or more units in the R4 zone, The code
presently requires a use permit application for 10 or
more units in the R2 zone, 20 or more units in the R3
zone, and 30 or more units in the R4 zone,
This code amendment was initiated by the Planning Com-
mission as a means of implementing the apartment stan-
dards which were approved by the Planning Commission at
their May 11 , 1971 Study Session. The staff recommends
approval of Code Amendment No. 71-8.
