COMMENTS FROM COUNCIL Safety Conditions - Meadowlark Airport Councilman Coen stated. that he believed action should be taken by the Council regarding the safety conditions at Meadowlark Airport . Following brief discussion on the matter, a motion was made by Councilman Coen, that the Administration be directed to take whatever action may be necessary to immediately enforce the Cease and Desist Order issued by the City to Meadowlark Airport. The City Administrator stated that he had just been informed that the owner of Meadowlark Airport had applied for a Conditional Exception to cover the existing runway extension and. two temporary trailers which are being used for a sales office and flight school. He stated that this application was to be heard by the Planning Commission on October 20, 1970. Councilman Matney stated. that the property owners and. the Airport Commit- tee have reached several areas of agreement, such as the necessity of eliminating part of the runway extension and, the establishment of a tree barrier to cause planes to elevate their landing approach, as well as diminishing the dust and. noise generated by departing aircraft. Councilman Green stated that he believed that many of the recommendations set forth by the Homeowners ' Association should be included. as conditions in the granting of a Conditional Exception. Page #2 - Council Minutes - 9/28/70 7e CODE AMENDMENT N0. 70-13 - SETBACK - APPROVED The City Clerk presented a communication from the Planning Commission recommending approval of Code Amendment No. 70-13 to amend Sections 9162.6.1.1 and Section 9202.6.1. 1 of the Huntington Beach Ordinance Code to require three story structures in R2 and R3 Districts to set back 100 feet from any Single Family Residential Development. This item had been continued from the meeting of September 21, 1970. The Planning Director presented a resume ' of the Planning Commission's reasons for recommending approval of Code Amendment No . 70-13. On motion by Bartlett, Council approved Code Amendment No. 70-13, and directed the City Attorney to prepare an ordinance amending the Huntington Beach Ordinance Code effecting same . Motion carried. .r 4" CONDITIONAL EXCEPTION NO. 70-45 - T. T. MAP NO. 6874 - APPROVED The City Clerk presented a communication from the Planning Commission concerning Conditional Exception No. 70-45, on property located south- west of Channel Lane, between Admiralty Drive and Broadway - R1 District to permit the subdivision of a parcel of land into lots having an average frontage of 40 feet - also to permit a public street to have a width of 43 feet in lieu of the 52 feet required by the Huntington Beach Ordinance Code . The Planning Commission recommended. approval. The Planning Director stated that this conditional exception had. been presented to Council and was approved . However, due to litigation problems, application for conditional exception had. to be made again, as the time limit for development of the property had expired . Council held discussion on the matter. On motion by Bartlett, Council sustained the decision of the Planning Commission, and approved Conditional Exception No. 70-45, with condi- tions as stipulated by the Planning Commission. The motion carried with Councilman McCracken abstaining from the vote . MURDY PARK R16REATION FACILITIES - CC-134 - BIDS REJECTED The Public Works Director presented a transmittal from the City Engineer concerning CC-134, construction of Murdy Park Recreational Facilities; with bids received on September 21, 1970, and award continued. to this meeting. The City Clerk read in full the transmittal from the City Engineer, which recommended several options that might be taken by Council. The Clerk also presented a letter from Monteleone and McCrory, Attorneys for Collins and McPherson, Inc . , objecting to the low bidder submitting a list of sub-contractors after the bids were opened. The City Attorney recommended that all bids be rejected and Project CC-134 be readvertised for bid.s . On motion by Matney, Council rejected all bids submitted for Project CC-134, and directed the Clerk to notify the bidders, and return their bid bonds . Motion carried.. s, BOARD OF APPEALS - APPOINTMENT DEFERRED The City Clerk presented. a transmittal from the Director of Building and Safety recommending that Mr. Tom Smith be appointed as a member of the Board of Appeals to fill the vacancy created by the resignation of Mr. Ken Thompson. Said amendment proposes to amend Sections 9162.6.1.1 of the R2 Two Family Residence District and 9202.6. 1.1 of the R3 Limited Multiple Family Residence District to require three-story structures to set back 100 feet from any Single Family Residential Development. That the following sections of the Huntington Beach Ordinance Code are hereby amended and shall read as follows: R2 S. 9162 .6.1.1 The exterior wall of any three-story building shall be set back one-hundred (100) feet or more from the property line of any single family residential development except that such setback may be eighty-five (85) feet where such three-story building site is separated from such single-family residential development by parking struc- tures, such as carports or garages, ' constructed on a common property line, or except where said three-story building site is separated from such single family, residential development by a public right-of-way, school, golf course, public utility right-of-way, flood control right-of-way or channel, which is sixty (60) feet or more in clear width. Harlow DATE: August 4, 1970 RE: ' CODE AMENDMENT NO. 70-13 The above referenced code amendment proposes to amend the R2 and R3 zones to require three-story structures to setback 100 ft. from any single family development . At the present time, the ordinance requires that the exterior wall of any three-story building be setback 100 ft . or more from any single family residential dwell- ing. This matter was discussed at the July 14, 1970, Study Session at which time the Commission stated that it is their intent to require three-story structures to be setback from the boundary of any single family development. Because of this, the Planning Commission instructed the staff to amend the ordinance and to set the matter for public hearing.
