When put to a vote the motion passed unanimously. 719 Page #10 - Council Minutes - 11/4/68 CODE AMENDMENT NO 68-9 - CONTINUED PUBLIC HEARING - APPROVED* The Clerk presented Code Amendment No, 68-9 which proposes to amend the Subdivision Ordinance and requirements for the R1 Zone relating to lot size, open space, front yard setback, encroachment into front and side yards , construction over garages or carports etc. The hearing had been opened at the meeting of October 21, 1968 and continued to this meeting. The Clerk read a letter from the Orange County Chapter of the Building Industry Association of California, Inc. regarding Code Amendment No. 68-9. Mr, Jim Bentson, 16642 Melville Circle, City, attorney representing the Huntington Harbour Property Owners Association, addressed Council and stated his opposition to lot size reduction. Mr. A. W. Knox, 3322 Easter Circle, City, addressed Council and requested that no deviation be made to the 6000 square foot requirement. Mr. Bob Jones , 3302 Bounty Circle, addressed Council regarding this matter, Mr. Jerry Shea, Chairman of the Legislative Action Committee of the Huntington Beach Chamber of Commerce addressed Council regarding Code Amendment No, 68-9, Mr. Ron Montgomery, Architect of the Huntington Harbour Corporati-on, addressed Council regarding Code Amendment No. 68-9. There being no one further to speak on the matter, and there being no protests filed, either oral or written, the hearing was closed by the Mayor. On motion by McCracken, Council ordered that waterfront properties will not be differentiated in minimum lot size area from other Rl lots On motion by McCracken, Council approved Sections 9103 .2.1.1 and 9103.3.1 as per the Planning Director's memorandum. Main Street, Santa Ana, representing. the Building Industry Association, addressed Council stating he was in favor of Code Amendment No. 68-9 with the exception to the section on open spaces. Mr. ,Terry Shea, 2110 Main Street, representing the Legislative Action Committee of the Chamber of Commerce, addressed Council and spoke in favor of Code Amendment No. 68-9. Mr. Hugh Halderman, Engineer, 1833 E. 17th Street, Santa Ana, addressed Council and spoke in favor of Code Amendment No. 68-9. Mr. Ron Montgomery, Architect, 4241 .Warner Avenue, City, addressed Council and spoke in favor of Code Amendment No. 68-9. Mr. Bob Hubbard, 16572 Somerset Lane, City, representing the Huntington Harbour Property Owners Association, addressed Council and stated that their organization objects to certain provisions of Code Amendment No. 68-9 and suggested that different provisions be made for waterfront property. Mr. Robert Helfer, 3472 Gilbert Drive, City, addressed Council and read a letter from the Huntington Harbour Property Owners Association, Inc. , which stated opposition to Code Amendment No. 68-9. Mr. Mark Porter, 19842 Providence Lane, City, addressed Council and gave reasons for his opposition to Code Amendment No. 68-9. On motion by Shipley, Council continued the Public Hearing on Code Amendment No. 68-9 to the next regular meeting of November 4, 1968. Said amendment pertains to Division of 9 of the Huntington Beach Ordinance Code and will (1) amend Sections in the R-1 zone to allow; (a) an average lot size of 6000 sq. ft. for each six contiguous lots ; (b) an average lot width of 60 ft. for each six contiguous lots; ( c) waterfront lots to have a minimum area of 5000 sq. ft. with 50 ft. of frontage; (d) increase the minimum open space requirement to 1200 sq. ft. with a minimum dimension of 25 ft. Variations are permitted as to how this open space should be allotted. (2) Amend Sections in the R-1, R-29 R-3 and R-4 zone that will (a) require the subdivider to submit cal- culations on lot sizes ; (b) permit open unenclosed stair- ways or balconies within the required setback. (3) Add sections in the R-1, R-29 R-3 and R-4 zone that will (a) permit 110" side and rear setbacks at the time of initial construction subject to certain requirements; (b) permit garages entered directly from the street to setback 72 ft. or 22 ft. ; (c) permit a 6 ft. front yard setback for fences; (d) permit side entry garages to setback .10 ft. All of the above setback reductions are intended to provide a variation in the street scene and are subject to review by the Board of Zoning Adjustments. The Planning Commission approved said Code Amendment at their October 1, 1968 meeting and recommends adoption by the City Council. The following items were not unanimously agreed to by the Planning Commission. The points of dis- agreement are as noted: 1. Lot Sizes'. One Commissioner requested a minimum lot size of 6000 sq. ft. Another Commissioner stated that a 5000 sq. ft. lot was too small and preferred a larger minimum lot size. 2 . Setback Side Yard. Two Commissioners ob- jected to the provision permitting the second story portion of a dwelling having a 11011 setback to abut a public street. They suggested that the second story portion be setback 10 ft. from the public street. 3. Setback Rear Yard. A provision permitting a 11011 rear yard setback along an arterial highway was included by the Commission by a three to three vote. Those opposing this provision were concerned with the excessively high walls which could be created along art- erial highway. Those in favor of this provision did not feel that all dwellings on the arterial highway would be of two story construction; also, that there was no reason to treat lots abutting an arterial highway any different from interior lots. Due to technical aspects of portions of the Code Amend- ment governing subdivision regulations , further con- sideration by the Commission is required. This portion of the Code Amendment is undergoing changes in the City Attorney ' s office and will be transmitted to the City Council after a final review by the Planning Commission. Proposed Amend- dated October 3, 1968: A. "0" side yard, page 1. We would recommend more flexibility in the wording of this paragraph as to permit an aggregate of 10 foot side yard rather than a "0" or 10 foot. Example: 10-0, 8-2, 6-4, 5-5, etc. B. We strongly concur in both the "0" side yard con- cept and the "0" rear yard concept. C. We do not concur in the requirement for solid decorative masonry construction building requirements for; "0" side yard and "O" rear yard building walls. We would recommend that the City adhere to the require- ments of the Uniform Building Code which has been adopted and approved by the City. D. Pages 4 and 5. We strongly oppose the minimum open space requirements. The average 6000 square foot lot will rarely have a structure covering more than 2000 square feet, leaving 4000 square feet of open space. Elsewhere the Subdivision Standards limit building , coverage to 50% of the lot. We feel that this is adequate and that further restrictions on the place- ment and dimensions of the open space is not necessary. E. Page 7, sub-section d, which requires garage doors to be equipped with automatic door openers . We make the following requests and recommendations in connection with proposed Code Amendment 68-9 in thebelief that the rejection of two of the proposed changes would better serve the future orderly development of waterfront residential property within the City. First: We urge that the size of waterfront residential lots not be reduced to 5, 000 square feet (Section 9102.2). We do not oppose the.waiver of "open space requirements" (Section 9103. 3. 1. la) as to waterfront lots because waterways do provide light and air not available to other lots. Otherwise, we believe that there is no justification for permitting lots in prime residential areas to fall below the city-wide standard of 6, 000 square feet. Second: We oppose the reduction of garage set backs to as little as 7-1/2 or even 10 feet because-this would completely eliminate driveway park- ing and create greater congestion and parking problems on residential streets, especially on cul-de-sac streets serving waterfront lots. Finally, we recognize that maintenance of present standards might possib- ly impose hardships on particular owners or developers in the cases of irregular or ,problem parcels of land. However, we believe that the present zoning variance procedures provide a proper method .for dealing, case by case, with these hardship,situations; and that general, city-wide standards should not have to'be "compromised in order to meet individual or unique problems.
