HomeMy WebLinkAboutCode Amendment 68-10 - Ordinance 1494 - Pertaining to develo Page #8 - Council Minutes - 5/5/69 BID AWARD`S CAMERON STREET - CC-121 The Clerk read a communication from the Director of Public Works stating that bids for the construction of a water main in Cameron Street, between Slater and Newman had been opened at 9000 A.M. on Monday, May 5, 1969, in the Administration Conference Room by the City Clerk, City Attorney and the Director of Public Works , and that Muniz Pipeline Company, Huntington Beach, California, was the low bidder with a bid in the amount of $9482.00. Mr. Wheeler recommended that the Council award the bid to Muniz Pipeline Company and reject all other bids . The bids submitted were as follows: Muniz Pipeline Co. , Huntington Beach, California - $ 9,482.00 Lomac Construction Co. , San Pedro, California - $ 9,760.00 Barron & Eckhart Const. Co. , Soo El Monte, Calif. - $ 9,940.00 Lynam Woods Construction, Corona Del Mar , Calif. - $13,472.06 On motion by McCracken, Council awarded the contract for Project No. CC-121 to Muniz Pipeline Company, Huntington Beach, California, the lowest responsible bidder, for the bid amount of $9,482.00; rejected all other bids and directed the Clerk to notify the unsuccessful bidders and return their bid bonds . Motion carried. RESOLUTION NO 2982 - EMERGENCY REPLACEMENT - PUMP PARTS - ADOPTED The Clerk presented a transmittal from the Public Works Department of Resolution No. 2982 transferring funds in the amount of $8,400.00 from the Sewer Fund to Operating Account No. 46036 for the purpose of purchasing replacement parts for 22 sewer pump stations . The Clerk read Resolution No. 2982 by title - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE EXPENDITURE OF MONEY FROM THE SEWER FUND.-" On motion by Coen, Council waived further reading of Resolution No. 2982, and passed and adopted same by the following, roll call vote : AYES: Councilmen: Shipley, Bartlett, McCracken, Kaufman, Matney, Coen, Green NOES: Councilmen. " At the request of Councilman McCracken, Mayor Coen directed that Ordinance No. 1494 be continued to the April 21, 1969 meeting. 7.99 Page #9 - Council Minutes - 11/18/68 LEASE ASSIGNMENT - HUNTINGTON DRIFTWOOD - APPROVED The Clerk presented a lease assignment from Huntington Driftwood Inc. to California Electric Company for Council approval. This matter was deferred earlier to the 7 :30 P.M,.: portion of this meeting. On motion by Matney, Council consented to the Assignment from Huntington Driftwood Inc. to California Electric Construction Company and directed the Mayor and City Clerk to execute said Consent To Assignment on behalf of the City. Motion carried. '7r CODE AMENDMENT 68-10 - PUBLIC HEARING - DEVELOPMENT STANDARDS - .CONT.-. ` The Clerk presented Code Amendment No. 68-10 which proposes to amend the Huntington Beach Ordinance Code pertaining to Development Standards in the R5, C2, C4, Ml-A, Ml and M2 Districts - site area, minimum frontage, building height and exceptions for existing legal buildings. The hearing had been opened at the meeting of November 4, 1968 and continued to this meeting. On motion by McCracken, Council continued the public hearing on Code Amendment No. 68-10 to a regular adjourned meeting of November 24, 1968. Motion carried. ZONE CASE NO 68-38 - PUBLIC HEARING - APPROVED Mayor Coen announced that this was the day and .hour .set. for a public hearing on Zone Case No. 68-38, on property located on the north side of Slater Avenue, 970.86 feet westerly from the centerline of: Goldenwest Street and 659.34 feet easterly from the centerline of Edwards Street for a change of zone from RA Residential Agricultural District to Rl Single Family Residence District. The Clerk informed the Council that all legal requirements for notifi- cation, publication and posting on said public hearing had been met and that he had received no communications or written protests to Zone Case No. 68-38. At this time staff reports and the Planning .Director's video-tape review of the property. were presented for Council 's information. Mayor Coen declared the hearing open. There being no one to speak on the matter, and there being no protests filed, either oral or -written, the hearing was closed by the Mayor. On motion by Bartlett, Council concurred with the Planning Commission and approved Zone Case No. 68-38 , and directed the City Attorney to prepare an Ordinance effecting the change of zone. Motion carried. ZONE CASE NO 68-40 - PUBLIC HEARING - APPROVED Mayor Coen announced that this was the day and hour set for a public hearing on Zone Case No . 68-40, on property located on the west side of Bolsa Chica Street approximately 150 feet south of Warner Avenue, for a change of zone from C2 Community Business District to R3 Limited Multiple Family Residence District. The Clerk informed the Council that all legal requirements for notifi- cation, publication and posting on said public hearing had been met and that he had received no communications or written protests to Zone Case No. 68-40. r,A2 Page #10 - Council Minutes - 11/4/68 CODE AMENDMENT NO 68-9 - CONTINUED PUBLIC HEARING - APPROVED The Clerk presented Code Amendment No. 68-9 which proposes to amend the Subdivision Ordinance and requirements for the R1 Zone relating to lot size, open space, front yard setback, encroachment into front and side yards , construction over garages or carports etc. The hearing had been opened at the meeting of October 21, 1968 and continued to this meeting. The Clerk read a letter from the Orange County Chapter of the Building Industry Association of California, Inc, regarding Code Amendment No, 68-9. Mr. Jim Bentson, 16642 Melville Circle, City, attorney representing the Huntington Harbour Property Owners Association, addressed Council and stated his opposition to lot size reduction, Mr. A . W. Knox, 3322 Easter Circle, City, addressed Council and requested that no deviation be made to the 6000 square foot requirements Mr. Bob Jones , 3302 Bounty Circle, addressed Council regarding this matter. Mr. .ferry Shea, Chairman of the Legislative Action Committee of the Huntington Beach Chamber of Coirmierce addressed Council regarding Code Amendment No, 68-9. Mr. Ron Montgomery, Architect of the Huntington Harbour Corporati-on, addressed Council regarding Code Amendment No. 68-9. There being no one further to speak on the matter, and there being no protests filed, either oral or written, the hearing was closed by the Mayor. On motion by McCracken, Council ordered that waterfront properties will not be differentiated in minimum lot size area from other R1 lots On motion by McCracken, Council approved Sections 9103 .2.1.1 and 9103 .3.1 as per the Planning Director's memorandum. Motion carried. On motion by Kaufman, Council directed the City Attorney to prepare an Ordinance covering Code Amendment No. 68-9 as proposed by the Planning_ Commission with the changes proposed by Council included. Motion carried. CODE AMEND 68-10 - PUBLIC HEARING - DEVELOPMENT STANDARDS - DEFERRED Mayor Coen announced that this was the day and hour set for a public hearing on Code Amendment No. 68-10. The Clerk informed the Council that they had been provided with copies of the Planning Secretary's transmittal, and stated that he had received no communications or written protests to Code Amendment No. 68-10 which proposes to amend the Huntington Beach Ordinance Code per- taining to Development Standards in the R5, C2, C4, MMl-A, Ml and M2 Districts - site area, minimum frontage, building height and exceptions for existing legal building. 60060 .:. On motion by McCracken, Council continued the Public Hearing on Code Amendment No. 68-10 to the next regular meeting of November 18, 1968. Motion carried. Request To Install Swimmin& Pool Cover Mr. Lloyd Merrick addressed Council regarding the installation of a swimming pool cover on his property. Council informed Mr. Merrick that he should contact the Department of Building and Safety regarding this matter. Video Tapes On motion by Green, Council directed the City Administrator to instruct the department heads to make video tapes on all zone cases and public— hearings which are to be presented to Council. This Amendment affects building site areas, building heights, minimum frontages, development standards, etc., in the following zone districts: M1-A, M-1, -M-2, C=2, R-5 and C-4. In an effort to summarize the effect of this proposed amendment, the Legislative Action Committee of the Huntington Beach Chamber of Commerce sets forth below their analysis of the proposed new Code sections versus present related sections, where applicable. CONCERNING Ml-A ZONES 1. Minimum building site will be one (1) acres. This is the present rule under MI-A regulations, Section 9518(e), and Subdivision Regulation 5.9941.4 where Type IV lots are specified. Exception to this minimum will be allowed for any parcel or lot existing as a legal building site on or before the effective date of Ordinance Number not yet given.) 2. Minimum lot frontage will be 100 feet on an arterial highway. This is new to the MI-A District regulations but similar to the present Type IV lot requirement of. 100' except 50' at end of cul-de-sac. 3 . Height of building and/or structure shall not exceed 40' . Note "structure" which is defined in 5.9700(n) as "Anything constructed or erected, the use of which requires more or less permanent location on the ground, or attachment to the ground or attachment to something having a fixed location on the ground". Present MI-A regulations, Section 9518(f) which is to be deleted, provides that maximum height limitation shall be two stories, or not to exceed 40' . Exception to the new 40' rule will be allowed for 14' additional feet for roof-top mechanical equipment and screening, provided such screening shall set back 15 ' from any exterior building edge and shall not project above the equipment for which it is designed to shield from view. CONCERNING M-1 ZONES 1. Minimum building site will be 10,000 square feet. This is new to the M-1 District regulations but is the same as required for Industrial lots when Subdivision regulation ' Section 9941.4 is applied. Exception to this minimum will be allowed for any parcel or lot existing as a legal building site on or before the effective date of Ordinance (number not yet given) . 2. Minimum lot frontage shall be 80' except those lots at the end of a cul-de-sac may have 45 ' of frontage. This is new to the M-1 District regulations but somewhat similar to the present Section 9941.4 Industrial lot requirement of 80' except 40' at end of cul-de-sac. i -2- 3. Height of building and/or structure shall not exceed 40' . Present M-1 regulation, Section 9532.4, which is to be deleted, provides that "no building or structure in an M-1 zone shall exceed a height of 40' ." The same exception for roof-top mechanical equipment and screening as to be allowed in M-1-A zones, supra, will also be allowed in M-1 zones, i.e ., 14 additional feet, etc. CONCERNING M-2 ZONES 1 . Minimum building site will be 10,000 square feet. This is new to M-2 District regulations but is the same as required for Industrial lots when Subdivision regulation Section 9941.4 is applied. Exception to this minimum will be allowed for any parcel or lot existing as a legal building site on or before the effective date of Ordinance (number not yet given) . 2. Minimum lot frongage shall be 100' on an arterial highway. This is new to M-2 District regulations and is an additional 20' of frontage (if on an arterial highway) than what is presently required'whe°°n/'Section 9941.4 Industrial lot is applied, which requires 80' except 40' at end of cul-de-sac. 3. Height of building and/or structure shall not exceed 40' . Present M-2 regulations, Section 9555, which is to be deleted, provides that "no building or structure in the M-2 District shall exceed a height of 40' ." The same exception for roof-top mechanical equipment and screening as to be allowed in M-1-A and M-1 zones, supra, will also be allowed in M-2 zones, i.e ., 14 additional feet, etc. CONCERNING C-2 ZONES 1. Front yard set back will be 10' except as otherwise designated on a Sectional District Map. Present requirement S.9434.1 is "none except where required for the C-1 District uses." 2. Side Yard setback will be: (a) For Exterior Side Yard, a 10' setback except as otherwise designated on a Sectional District Map. (b) For Interior Side Yard, no setback except where permitted use abuts a residential district, then a minimum of 10' shall be provided. Present side yard requirement, S.9434.2 is, "none except where required for C-1 District use, or where the lot abuts an R District, then 10 feet." 3 . Rear. Yard setback will be, none, except where permitted use abuts a residential district, then a minimum of 10' shall be provided. _ Present rear yard requirement, S.9434.3 is "none except where required for the C-1 District use or where the lot abuts an R District, then 10 feet." 4. Minimum building site shall be 10,000 square feet. This is a new. regulation for C-2 Districts and is. not presently required. Section 9436(a) presently defines minimum lo.t area requirement as "None". -3- 5 . Minimum lot frontage will be 100' . This is also a new regulation for C-2 Districts. Section 9436(b) presently defines minimum lot dimensions as "None". These proposed minimum building site and frontage requirements may be reduced provided: (a) A plot plan encompassing the entire parcel and delineating all structures proposed for initial and/or future construction is approved by Board of Zoning Adjustments, Planning Commission or City Council prior to approval of a division of land. (b) An Administrative Review application showing the above plot plan is submitted for the Board of Zoning Adjustments approval prior to approval of a division of land. An exception to these proposed new C-2 regulations will be allowed for any parcel and/or lot existing as a legal building site on or before the effective date of Ordinance (number not yet Riven) . 6. Maximum building height shall not exceed 50' . This is the same as presently specified in Section 9436(d) . A similar exception for roof-top mechanical equipment and screening as is to be allowed in M-1-A, M-1, M-2 Districts, i.e., 14 additional feet, etc., will also be allowed for C-2 Districts. 7. Maximum "ground floor area of all enclosed buildings shall not exceed 507. of. the site area". Present regulation of a somehwat similar nature is Section 9436(c) which states maximum "coverage by structures: 507,". CONCERNING R-5 ZONES 1. Minimum building site will be 6,000 square feet. Present requirement sets no minimum except for certain types of uses, i.e. Motels - 9,000 square feet, hospitals - .6,000 square feet, etc. 2. Minimum lot frontage will be 60 feet. None presently required except for certain uses. Exceptions to above minimum will be allowed for any parcel and/or lot existing as a legal building site on or before the effective date of Ordinance (number not yet given). 3. Maximum building height shall not exceed 35 feet or three stories. Present requirement is the same. Exception for roof-top mechanical equipment and screening will be allowed in R-5 Districts . in the same manner .as is to be allowed in the M and C-2 Districts, i.e., 14 additional feet, etc. CONCERNING C-4 ZONES The proposed changes affect the "Professional Services and Offices Section" (5.9471.4) of the C-4 regulations and constitute new regulations as to uses falling under such Section. These new C-4 regulations will require: • -4- 1. Front yard.setback of 10' except as otherwise designated on a Sectional District Map. 2. Side Yard Setback as follows: (a) On Exterior Side Yard, a 10' setback except as otherwise designated on a Sectional District Map. (b) On Interior Side Yards, no setback except where permitted use abuts a residential district, then a minimum of. 10' shall be required. 3. Rear Yard .Se.tback: None, except where permitted use abuts a residential district, then a minimum of 10' will be required. 4. Minimum Building Site will be 6,000 square feet. 5. Minimum lot frontage will be 60' . Exception to minimum building size and lot frontage will be allowed for any parcel and/or lot existing as a legal building site on or before the effective date of Ordinance (number not yet given) . 6. Maximum building height shall not exceed 35 ' or three stories. A similar exception for roof-top mechanical equipment and screening will be allowed in this C-4 zone section affecting Professional Services and Offices uses, as is to be allowed in the aforesaid M, R-5 and C-2 zones, i.e., 14 additional feet, etc. Consideration could be given to allow this same exception for rooftop equipment for other uses presently allowed in C-4 Zones, i.e., Motels and Hotels, Churches, Clubs, Lodges, etc. Section 9473, presently sets the height limit for all uses in C-4 District at 35 ' or three stories but doesn't allow the additional 14 feet, etc., exception for rooftop mechanical equipment and screening.
