Adopt Resolution No. 2019-12 to Acknowledge Receipt of a Fire Department Report Regarding
the Annual Inspection of Certain Occupancies
Statement of Issue:
This is a request for the City Council to approve the attached resolution acknowledging receipt of a
report by the Huntington Beach Fire Department regarding the annual inspection of certain
occupancies. This resolution will be submitted to the State of California in compliance with State
Senate Bill 1205.
Financial Impact:
Not applicable.
Recommended Action:
Adopt Resolution No. 2019-12, "A Resolution of the City Council of the City of Huntington Beach
Acknowledging Receipt of a Report by the Huntington Beach Fire Department Regarding the Annual
Inspection of Certain Occupancies."
Alternative Action(s):
Do not adopt the attached resolution and direct staff accordingly.
Analysis:
California Health & Safety Code Sections 13146.2 and 13146.3 require all fire departments that
provide fire protection services to perform annual inspections in every building used as a public or
private school, hotel, motel, lodging house, apartment house and certain residential care facilities.
This is done for compliance with certain building standards. Section 13146.2 of the Code requires
departments to report annually to its governing body on its conformance to these requirements.
State Senate Bill 1205 requires that effective January 1, 2019, the governing body annually adopt a
resolution or other formal document certifying that these inspections were completed and that this
document be submitted to the State.
During calendar year 2018, the Huntington Beach Fire Department completed annual inspections of
all buildings referenced under Sections 13146.2 and 13146.3 of the California Health and Safety
Code. This includes the following:

A total of 2,655 occupancies were inspected in 2018, representing 100% of all required facilities.
In conformance with Senate Bill 1205, staff recommends the adoption of the resolution shown as
Attachment 1.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ACKNOWLEDGING RECEIPT OF A
REPORT BY THE HUNTINGTON BEACH FIRE
DEPARTMENT REGARDING THE ANNUAL INSPECTION
OF CERTAIN OCCUPANCIES
WHEREAS, California Health & Safety Code Section 13146.4 became effective on
September 27, 2018; and,
WHEREAS, California Health & Safety Code Sections 13146.2 and 13146.3 requires all
fire departments, that provide fire protection services to perform annual inspections in every
building used as a public or private school, hotel, motel, lodging house, apartment house, and
certain residential care facilities for compliance with certain fire building standards, as provided
and,
WHEREAS, California Health & Safety Code Section 13146.2 requires all fire
departments, that provide fire protection services to report annually to its administering authority
on its compliance with Sections 13146.2 and 13146.3 and,
WHEREAS, this Resolution fulfills the requirements of the California Health & Safety
Code regarding acknowledgment of the Huntington Beach Fire Department's compliance with
California Health and Sections 13146.2 and 13146.3.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Huntington Beach as follows:
City Council expressly acknowledges the compliance by the Huntington Beach Fire
Department with California Health and Safety Code Sections 13146.2 and. 13146.3 as follows:
A. EDUCATIONAL GROUP E OCCUPANCIES:
Educational Group E occupancies are generally those public and private schools, used by

more than six persons at any one time for educational purposes through the 12th grade. Within
the City of Huntington Beach, are ninety-three (93) Group E occupancies, buildings, structures
and/or facilities.
During calendar year 2018, the Huntington Beach Fire Department completed the annual
inspection of all ninety-three (93) Group E occupancies, buildings, structures and/or facilities.
B. RESIDENTIAL GROUP R OCCUPANCIES:
Residential Group R occupancies,are sub classified as Group R 1-4 and are generally those
occupancies that include hotels, motels, apartments (three units or more), as well as other
residential occupancies, including a number of residential care facilities. Residential care facilities
are further broken down into sub-classifications, including custodial care, mobility impairments,
cognitive disabilities, etc. Within the City of Huntington Beach are twenty-three (23) R1, two
thousand five hundred thirty-two (2,532) Group R2, four(4) R2.1 and one (1) R4 occupancies.
During calendar year 2018, the Huntington Beach Fire Department completed the annual
inspection of all R1, R2, R2.1 and R4 occupancies, buildings, structures and/or facilities.
