Statement of Issue:
City Council authorization is requested to amend the City of Huntington Beach Municipal Code
Section 2.109 related to the Finance Commission to help clarify its role and responsibilities as
requested by the City Council on May 20, 2019.
Financial Impact:
Not applicable.
Recommended Action:
Approve for introduction Ordinance No. 4182, "An Ordinance of the City of Huntington Beach
Amending Sections 2.109.020, 2.109.040, 2.109.060 of the Huntington Beach Municipal Code
Relating to the Finance Commission."
Alternative Action(s):
Do not approve the recommended action and direct staff accordingly.
Analysis:
On March 15, 1993, the City Council created a Finance Board by adopting Ordinance No. 3184,
adding Chapter 2.109 to the Huntington Beach Municipal Code (HBMC).
On February 22, 2011, the City Council adopted Ordinance No. 3911, deleting Chapter 2.110, and
amending Chapter 2.109, creating a Finance and Investment Advisory Board.
On November 7, 2011, the City Council adopted Ordinance No. 3923, repealing and deleting Chapter
2.109 pertaining to the Finance and Investment Advisory Board.
On May 18, 2015, the City Council adopted Ordinance No. 4056, adding Chapter 2.109 and creating
the Finance Commission. NO AnTION

HMBC Section 2.109.030 describes the purpose of the Finance Commission as follows. "The
Finance Commission shall act in an advisory capacity to the City Council in matters pertaining to
financial planning." Financial planning touches on nearly every aspect of City operations. This
language provides the City Council full discretion to task the Finance Commission to work on a broad
range of financial matters.
HBMC Section 2.109.040, which describes the duties of the Finance Commission, is also broad
which may inadvertently lead to some confusion. The intent of the proposed changes to HBMC
2.109 is to establish clearer roles and responsibilities for the Finance Commission as an advisory
board to the City Council.
Staff completed a survey of all Orange County cities in order to determine whether there are industry
standards, or best practices, with respect to the role and composition of Finance Commissions. Only
three (3) other Orange County cities have a Finance Commission that consists of local residents
and/or business owners. Those cities are Anaheim, Costa Mesa, and Irvine. Newport Beach has a
Finance Committee that consists of three (3) Councilmembers and two (2) members of the public.
The City of Yorba Linda has a Finance Committee that consists of two (2) Councilmembers. The City
of Dana Point disbanded its Finance Commission in favor of a Financial Review Committee, which
consists of five (5) members: two (2) public, one (1) staff (City Manager) and two (2) Council
Members (Mayor as Chair, and Mayor Pro Tern as Vice Chair).
Staff researched the role of Finance Commissions in other cities and also evaluated the past
practices of the City of Huntington Beach's Finance Commission over the past few years. The
Finance Commission has completed a number of important projects in the past, such as a
comprehensive review of the financial statements and funds of the Downtown Business Improvement
District (BID); an analysis of the proposed amendments to the Citywide Master Fee and Charges
Schedule; and a review of recommendations provided by staff to the City Council on proposed
Budget Balancing Measures.
In each of these cases, the City Council requested that the Finance Commission study these items
and develop recommendations for City Council consideration. Much of the most valuable work that
the Finance Commission has done has been driven by the City Council's priorities and specific
direction providing a clear nexus between the work of the Finance Commission and the priorities of
the City Council. The intent of the proposed ordinance is to clarify the role of the Finance
Commission as an advisory body that fills an important role in providing public transparency and
feedback regarding specific financial matters of particular interest to the City Council. Moreover, the
proposed changes serve to more appropriately align the Ordinance with the City Council's past
practice in tasking the Finance Commission with the special projects and assignments that are of the
greatest priority to the City Council as a governing body.

The City Council of the City of Huntington Beach does hereby ordain follows:
SECTION 1. Huntington Beach Municipal Code Chapter 2.109 ' hereby amended as
follows:
2.109.010 Creation.
There is hereby created a Finance Commission.
2.109.020 Composition.
The Finance Commission shall consist of sev (7) members who are residents of the
City. Each City Council Member shall appoint on member of the Commission to serve the
same term as the City Council member. It is prey rred that members have a background that
includes experience in business administratior. securities trading, financial planning, banking,
auditing, accounting, or a closely related.an elevant field.
The Commission shall adopt suc hyiaws and rules as it deems ne:essary to provide for

Council.
2.109.070 Financia] Disclosure.
In accordance with California Law, member of the Finance Commission shall be
required to file appropriate statements of econom' interest.
2.109.080 Brown Act.
Meetings of the Finance Commis 'on shall be subject to the open meeting law.
SECTION 2. This ordinance hall become effective thirty (30) days from the date of its
adoption.

2.109.010 Creation
There is hereby created a Finance Commission.
2.109.020 Composition

As a SEHB resident for 48 years have several concerns and
questions regarding this
ordinance as it will result in eliminating transparency and
overview of critical items that benefit the taxpayers of HB.
This ordinance will eliminate the following and completely
"gut" the purpose of the Finance Committee and prevent any
oversight by the citizen taxpayers who at present have limited
exposure.
Will eliminate the following common audit performance issues:
1 .Fiscal Polices, Financial Planning and Funding
12. Annual adopted budget review New and increased revenue
sources: proposals related to financial matters
3. Service contracts on an as needed bases
6. Proposed Sate or Federal Allegation which impacts the City
Finances
Now who do you propose will be the citizen taxpayer's overseer
on this measure? We have had in the past years One Mayor and
One City Council person serve time at the Rebar Motel. We had
One Council member who kept his X wife on the City Health
Plan paid by the citizen taxpayers and the HB City Council
never even censured the City Council person nor was an audit
performed on how many dollars he "ripped off' from the city.
What funds if any were paid back and what is the
supporting documentation.
I realize that HB does not have a City Auditor whose position
would be to audit and question various expense items.
My question is: does anyone undertake any Audits:
• Who Audits the Accounts Payable's against the Purchase Orders
• Who Audits the Purchase Orders to see if they comply and are fulfilled with
the Shipping Invoice and the Receiving documentation
• Who audits the Expense Reports to see if the Expenses meet the
requirements
• Who audits the contracts between the amounts billed and the amounts
authorized.
• What is the recovery amount from the Audits.
Does anyone perform any Audits whatsoever.
Yet, a select majority of HB City Council members now want to
shrink the responsibility of the citizen taxpayers oversight
Committee. Evidentially, to cover up some irregularities or
expose and hold Accountable certain Departments for not

following General Accepted Accounting Principles and
Practices.
When 52% of your budget goes to Police and Fire with no
checks and balances, we the Peasant Taxpayers have a problem..
The HB City Council wants citizen taxpayers input and
volunteering, but it now appears only on the HBCC terms. Thou
shall not question any actions taken by the HB City Council as
you and your Commission will be eliminated as democracy does
not exist in HB let alone Transparency.

Dear Council Members,
A periodic council review of all committees and commissions is appropriate.
It would be helpful to understand what prompted a review of the Finance Commission and that any proposal to alter that
commission accompany the proposal. Tightening the requirements for commission membership seems sound; changing
the monthly meetings to "as needed" is not sound.

I am contacting you about an error that occurred in the reporting of Supplemental
Communications for the June 3, 2019 meeting.
We have a dedicated email address used by members of the public to provide agenda
comments. My attempts to open agendacomments(a)surfcity-hb.org on both Friday,
May 31, and Monday, June 3 afternoons failed to display any contents -- the inbox
appeared to me to be empty. I typically rely on support staff to monitor this process,
but I managed the compilation and publication of the 6/3 agenda packet on my own.
Yesterday afternoon my Deputy discovered that the Agenda Comments inbox had

We, as residents of Huntington Beach are concerned to see Agenda Item 30 on your City
Council agenda.
We do NOT support eliminating a citizen oversight committee providing oversight!
The Commission merely advises, suggest and makes recommendations.
Leave the Finance Commission alone!
It's unprofessional and unethical to appoint citizens to a committee and then suggest they
aren't qualified to sit on the committee.
The last time the Finance Commission was disbanded, it was because they dared suggest
changes to pension calculations. .
Now, when they suggest a study to outsource a department, you want to neuter them to the
point they might as well be disbanded.
No way should CITIZENS HAVE LESS INVOLVEMENT, LESS OVERSIGHT AND LESS
TRANSPARENCY into the city's finances.
As local citizens,we ask you to do everything possible to promote good, ethical government.

I am not sure what would prompt the agenda 30 item? I can't imagine a situation that would lead you to want
less resident participation. I can't imagine why you would seek less transparency.
I would ask that you not only oppose this agenda item, but you look further into why the city staff would

This email is to urge a no vote on agenda item 30.
The issue at hand is why is staff politicking and what effect is it having on the city? Is a citizen oversight board proposing
measures to save the voters and taxpayers money something that should be discouraged? Staff are not elected and
therefore, aren't accountable to the voters as members of the city council are. We already know that staff works behind
the scenes to sway the politics in the city as we saw recently with Antonia Graham recruiting outsiders to come and
speak at a city council meeting to sway the vote on Community Choice Aggregation.This city's staff appears to be free to
act as an unelected political body that is unaccountable to voters. With the most recent actions, it appears that staff has
taken it a step further and may have worked directly with council members to exert influence. And what is the
commonality between these two situations? Staff seeking to increase workload to justify their position as operating
outside the purview of the voters.
Frankly, there should be an investigation into the actions and intentions of staff, including Lori Ann Farrell, and whether
they colluded with Council Member Posey and Council Member Carr to intimidate the volunteer citizen finance
commission, as they clearly did at the last finance commission meeting. At the very least, there should be an
investigation into whether all the individuals involved engaged in unethical, and possibly illegal actions leading up and
including to the previous city council study session and the subsequent finance commission meeting.
If it comes down to choosing between paid staff who were possibly working with certain council members against the
best interests of the people of Huntington Beach, and a volunteer citizens group, I'll pick the volunteer citizens group
every time.

Again, I urge you to vote no on agenda item 30 and bring those responsible to bear for behavior and actions detrimental
to a city that seeks to promote good, ethical government.

To say that I am concerned about agenda item 30—and its intent—would be a huge understatement.
I was at the Finance Commission meeting. I am a witness to the shady, backroom intimidations that occurred there.
Some of you should be ashamed of yourselves. But you're not.You worked with staff to come up with this nugget. And
why? Because they dared to investigate ways for the city to save money? How dare they do the job that many of you
charged them with in the first place! So, I ask, are you no longer interested in having a commission investigate, and
suggest, ways to save our city—and, by extension our taxpayers, money?This can only mean that some of you must now
lay down and abandon your mantle of"economic conservatism".
It is well known that this has happened before.The last time the Finance Commission existed, it was disbanded for doing
its job. I find it disturbing that some of you are allowing history to repeat itself.
If you vote for agenda item 30,you are sending a message to the citizen members of every other board and commission.
You are telling them they only exist as"window dressing", something that looks good on our city website. Bottom line,
the message you are sending EVERY citizen in this city is that each of you don't really care about the concerns of the
people you represent. Is that really the message you think is appropriate?
Further, each of you appointed a member of this commission.And yet staff is now proposing to change the
requirements of an appointee.That can only mean one thing.Staff thinks that some of you made poor choices. Who's
choice was poor?Councilperson Hardy? Does staff not think Jay Hudson is qualified to be a member of this commission?
How about Councilman Posey? Perhaps its Laura Romero that they are targeting? No, it must be Councilperson
Delgleize's choice. Can you defend Charles Bunten as your appointment to this commission? Councilperson Carr- not
many people have even heard the name Stephanie Gledhill. Please defend her qualifications to staff. Perhaps it's you
and your choice that staff is targeting. Patrick Brenden with Gracey Van Der Mark, Erik Peterson with Frank Lo Grasso,
Lyn Semeta with Ron Sterud. Staff is targeting each of your rights, as city council people,to make appointments
independent of any interference by staff. Staff is not elected—each of you are.You need to remember that you are
accountable to the citizens that elected you — not to staff. If staff is able top change the qualifications of this
commission, are any of the other commissions and boards safe from their interference?
On a personal note, I will close the sale of my business on June 10. 1 will be semi-retired. As someone who seeks a sense
of purpose in his life, I have been considering what the next chapter of my life might look like. I have considered the

possibility of becoming more involved with the workings of our city. But now, I really am asking myself,would I serve any
vital function to make Huntington Beach a better place to live?Or would I simply be attending meetings where my
involvement was really neither wanted nor meaningful. If you vote for agenda item 30, 1 suspect there will be many
more citizens with the same thoughts as mine. How will our city work without those willing to serve on the Citizen
Participation Advisory Board? How about the Public Works Commission? How would it be if we couldn't even fill a
Planning Commission?Would our city look—and work—differently.
The ramifications of your vote on agenda item 30 will be felt far and wide. Be careful you consider all of them.
And let it go on the public record that this citizen urges you to vote no on agenda item 30.

away insight from the citizens. Last meeting. Michael Posey and Kim Carr attempted to intimadate the board.
Which was highly unethical. Along with Lori Ann. Then Mr Posey allowed Kim Kramer to sit at the table. Kim
Kramer is well known in the town for his underhanded ways. I will be there Monday to speak about this blatant

I am appalled to see agenda item 30 on your city council agenda. I can't believe you would support effectively
eliminating a citizen oversight committee for the crime of actually providing oversight!!! It's no coincidence that after
the Commission merely SUGGESTS conducting a STUDY of outsourcing that this item is added to your agenda.
How can you appoint citizens to a committee and then suggest they aren't qualified to sit on the committee by
suggesting in the agenda item that appointees should have financial backgrounds?! What a slap in the face to your own
appointees!
The last time the Finance Commission was disbanded, it was because they dared suggest changes to pension
calculations. And now because they dare suggest a study to outsource a department you want to neuter them to the
point they might as well be disbanded again. It seems to me every time the Finance Commission makes any meaningful
suggestions about the city's finances, City Council decides to get rid of them.
For those of you who were serving as City Council members when the Finance Commission was re-instated (Mayor
Peterson, Council members Posey, DelGleize, and Hardy), I remind you that you VOTED FOR IT.The arguments made
during the discussion to re-instate the Commission were primarily transparency which all of you supported at the time.
So what's changed? Have you changed your minds about transparency? Have you decided that your appointees aren't
smart enough to serve on the Commission? Have you decided that citizens should NOT have an oversight role regarding
the city's finances? If citizens should not have financial oversight,what other board or commission needs to be
disbanded?
How dare you suggest that CITIZENS HAVE LESS INVOLVEMENT, LESS OVERSIGHT AND LESS TRANSPARENCY into the
city's finances.

My family and I strongly oppose Agenda Item 30. This will affect every board in the city. Trying to silence citizen
participation and voices that don't fit political agendas is shameful. Without checks and balances, the city loses the voice
of the people who elected you.
As, I am a union employee, my opposition of this issue is solely based on the attempt to silence a recommendation. A
recommendation to council has seemed to upset particular council members along with Lori Ann Farrell. Why does a
recommendation warrant this agenda item?
The violation of the"Brown Act" (as described by those in attendance) at the finance meeting, should be looked at by our
city attorney. Michael Posey holding a sidebar with Lori Ann during the meeting is grossly inappropriate and a review of
his conduct and ethics should be looked into.
Having attended the Design Review Board meeting on May 9th,councilwoman, Lyn Semeta, did NOT seat herself at the
DRB table, community members did NOT seat themselves at the DRB table. Yet at the finance meeting you have Kim
Kramer sitting alongside Lori Ann?You have Michael Posey and Kim Carr sitting at the board table?
What is considered " Best Practices" in our government?The example of council at this meeting was nothing short of
disrespectful to our community and the finance commission.
The" Brown Act" gives people the opportunity to participate. For example; At the DRB meeting on May 91h, we had
room full of artists in attendance. Shammy Dee, was one speaker, another came from Long Beach, our neighbors both
spoke, who have artwork displayed at the art center. I myself hold an art degree. We were thankful to the DRB for hearing
not only the"Educated Art Community", but ALL neighbors and participants from all over the city. Michael Gioan, did a
fantastic job as well, and he lives in Sunset Beach. Everyone, regardless of what credentials they held, had a chance to
participate and be heard , and when you eliminate and censure, the community no longer has a voice.

When you talk about expertise and credentials, you begin to make this an elitist government, that is by YOUR design and
NOT by design of the community that voted you into office. By removing their ability to provide any citizen input and
oversight to help city council and our city. What message does this send to all citizen participation Boards and
Commission if the city can dismantle or destroy them on a whim?
We oppose Agenda Item 30!

This attempt to "silence" a City Board, one that every one of you appointed a member to,
is nothing more than a vindictive attempt to shut the public input up just because there are certain
Council Members that do not agree with their recommendations. If this is allowed, where will it stop.
All city boards will now be looking over their shoulders wondering if they are next just because a
Council Member doesn't like what they are doing/recommending.
If you don't like what a board is recommending, you don't have to accept said recommendations but
desolving a Board because of that is simply wrong.
