RECOMMENDED ACTION(S):
A four-fifths vote is required on Recommended Action one. The requested appropriation, revenue,
transfers in/out and reserve changes are summarized in this section of the report in the Budget Adjustment
Summary. The requested position changes are summarized in the Position Change Summary,
1. Direct the Auditor-Controller to revise appropriations, revenues, transfers in/out, reserves, and
obligated fund balances as detailed in the Budget Adjustment Summary in accordance with
Government Code Sections 29130, 29125 and 25252. (Requires four-fifths vote)
2. Direct Human Resource Services to amend the master position control, subject to final
classification review, as detailed in the Position Change Summary.
3. Approve the FY 2019-20 budget adoption schedule as follows: (a) The FY 2019-20 Recommended
Budget will be available to the public on or before May 15, 2019; (b) A notice stating that the
recommended budget is available to members of the public and the time and place of the public
hearing will be published on or before May 15, 2019; (c) On June 11, 2019,the Board shall conduct
the public budget hearing on the recommended budget; and (d) By June 25, but not later than June
30, 2019, the Board shall adopt the FY 2019-20 Budget by resolution.
4. Approve the addition of events to the FY 2018-19 County Event Calendar, as set forth in
Attachment C, and per Government Code Section 26227, find that the events therein will serve a

public purpose of the County of Orange and will meet the social needs of the population of the
County, including but not limited to, the areas of health, law enforcement, public safety,
rehabilitation, welfare, education, and legal services, and the needs of physically, mentally and
financially handicapped persons and aged persons; that County staff and resources may be used in
furtherance of such events; and that County staff may solicit donations of funds and services for
such events.
5. Repeal Resolution 91-1336 pertaining to parking penalty, fine or forfeiture distributions to funds
per Government Code 76000, effective July 1, 2019.
6. Adopt Board Resolution, dated April 23, 2019, pertaining to parking penalty, fine or forfeiture
distributions to funds per Government Code 76000, effective July 1, 2019.
7. Repeal Resolution 95-241 pertaining to penalty assessment revenue distributions to Funds 13S, 105,
104, 109 and 134, effective July 1, 2019.
8. Adopt Board Resolution, dated April 23, 2019, pertaining to penalty assessment revenue
distributions to Funds 13S, 104, 109 and 134, effective July 1, 2019.
9. Effective April 26, 2019, approve new title code and description, classification specification, and
set pay grade for Dental Hygienist (Title Code 4140HP, Salary Range C-31).
10. Effective April 26, 2019, approve revised title descriptions, classification specifications, and adjust
pay grades for Maintenance Inspector (Title Code 3588GE, Salary Range C-34); and Supervising
Maintenance Inspector(Title Code 3589SM, Salary Range C-39).
11. Effective April 26, 2019, approve revised title description, classification specification, and adjust
pay grade for Safety Specialist (Title Code 8808GE, Salary Range C-37); and approve new title
code and description, classification specification, and set pay grade for Senior Safety Specialist
(Title Code 8809GE, Salary Range C-39).
SUMMARY:
The Quarterly Budget Report provides the Board of Supervisors, members of the public, County
departments, and other interested parties with an overview of the current status of revenues, expenditures,
Net County Cost, total budgeted positions and various departmental issues requiring recommended
changes to the County's budget.

1 RESOLUTION OF THE BOARD OF SUPERVISORS OF
ORANGE COUNTY, CALIFORNIA, PARKING FINE OR FORFEITURE
2 DISTRIBUTIONS TO FUNDS PER GC 76000 ET SEQ.
3 April 23, 2019
4 WHEREAS, on November 12, 1991, the Orange County Board of Supervisors ("Exhibit
A") approved Resolution#91-1336, which is attached to this Resolution as Exhibit A. Exhibit A
5 stated the Legislature had imposed an added penalty of$2.50 for the Courthouse Construction Fund
and an added penalty of$2.50 for the Criminal Justice Facilities Planning Fund, each to be included
6 in every penalty, fine or forfeiture for a parking offense, and the bail schedule is required to be
7 adopted to reflect the penalties prescribed by law; and
8 WHEREAS, as stated in Exhibit A, the Board of Supervisors resolved added penalty of
$2.50 each to every penalty, fine or forfeiture for a parking offense to be imposed for the
9 Courthouse Construction Fund and the Criminal Justice Facilities Planning Fund in lieu of the
10 $1.50 surcharge previously imposed on each such fund, in accordance with Government Code
Section 76000 (b) and that bails schedule amounts should be increased as appropriate to reflect the
I 1 added penalty. The County Treasurer was directed to transmit to the State Controller for deposit in
the General Fund $1.00 of every penalty collected pursuant to Government Code Section 76000(c);
12 and
13 WHEREAS, Government Code Section 76000(d) states the authority to impose the two-
dollar-and-fifty-cent penalty authorized by subdivision(b) shall be reduced to one dollar ($1) as of
14 the date of transfer of responsibility for facilities to the Judicial Council except for money that is
15 needed to pay for construction provided for in Section 76100 and undertaken_prior to_the transfer of
responsibility for facilities from the county to the judicial council; and
16
WHEREAS, in 2002, The Trial Court Facilities Act (SB 1732) established the authority
17 for the transfer of court facilities from the Counties to the State Judicial Council of California. On
18 November 24, 2009, the County transferred the responsibilities for Lamoreaux Justice Center,
Juvenile Justice Center Facility, to the State, Judicial Council of California; and
19
WHEREAS, the Courthouse Temporary Construction Fund (No. 105) is a county
20 construction fund established pursuant Government Code section 76100; and
21
WHEREAS, Government Code section 70402(a) states any amount in a county's
22 courthouse construction fund established by Section 76100 shall be transferred to the State Court
Construction Fund at the later of the following dates: (1) the date of the last transfer of
23 responsibility for court facilities from the county to the Judicial Council, or December 31, 2009,
whichever is earlier, or (2)the date of the final payment of bonded indebtedness for any court
24 facility that is paid from that fund; and
25 WHEREAS, on March 11, 2019, the Judicial Council of California notified the County of
26 Orange by letter that the County's bond indebtedness on the Juvenile Justice Center Facility is
scheduled to conclude on June 1, 2019 and pursuant to Government Code section 70402(a) any
27 amount in the County's Courthouse Construction Fund (CCF) established per Government Code

Attachment E
1 section 76100 will be transferred to the State Court Facilities Construction Fund after that date. A
2 copy of the notification letter is attached to this Resolution as Exhibit B.
3 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF
4 THE COUNTY OF ORANGE, AS FOLLOWS:
5 Section 1. That effective July 1, 2019, the $2.50 penalty authorized under Government
Code 76000(b) is reduced by $1.50 for the completion of bonded indebtedness on Juvenile Justice
6 Facility, responsibility for which has been transferred to the State Judicial Council of California in
2009, the $1.50 added penalty for the Courthouse Construction Fund 105 in accordance with the
7 Government Code Section 76100 shall be eliminated. The remaining $1.00 penalty authorized
8 under the Government Code Section 76000 (b) shall be deposited into the County General Fund in
accordance with the Government Code Section 76000 (c); and
9
Section 2. There will be no change to the $2.50 penalty imposed for the Criminal Justice
10 Facilities Planning Fund, whose facilities remain with the County, in accordance with Government
Code Section 76101 and 76000 (b). The $1.50 of the $2.50 Criminal Justice Facilities penalty
11 imposed shall be deposited into the Criminal Justice Facilities Planning Fund 104 in accordance
12 with the Government Code Section 76101. The remaining $1.00 Criminal Justice Facilities penalty
authorized under the Government Code Section 76000 (b) shall be deposited into the County
13 General Fund in accordance with the Government Code Section 76000 (c);
14 Section 3. That the Clerk of this Board is hereby directed to transmit to the Treasurer,
Auditor-Controller, the Orange County Sheriff's Department, each of the courts in the County, and
15 all cities in the County a copy of this Resolution.

Dear Ms. Bohan-Johnston:
Pursuant to Government Code (GC) section 70402(a) any amount in a county's Courthouse
Construction Fund (CCF) established per Government Code section 76100 shall be transferred to
the State Court Facilities Construction Fund at the later of the following: (1) the date of the last
transfer of responsibility for court facilities from the county to the Judicial Council, or December
31, 2009, whichever is earlier, or(2)the date of the final payment of bonded indebtedness for
any court facility that is paid from that fund. Per our records,the county's bond indebtedness on
the Juvenile Justice Center Facility is scheduled to conclude on 6/1/2019.
As noted in the table below, all agreements have been completed, and the facilities in your
county have transferred to the state. Based upon the square footage transferred to the state, 100
percent of the balance of the county's Courthouse Construction Fund is subject to transfer to the
State Court Facilities Construction Fund, as well as any future collections.
